Justice C.K.ABDUL REHIM\n\n Dated :19\/01\/2011\n\n O R D E R\n                       C.K.ABDUL REHIM, J\n                  ---------------------------------------\n                    W.P(C) No.1291 of 2011-J\n                 ----------------------------------------\n           Dated this the 19th day of January, 2011.\n\n                          J U D G M E N T\n<\/pre>\n<p>     The    petitioners    claim    to    be    registered owners of<\/p>\n<p>autorickshaw which are being plied by themselves as self<\/p>\n<p>employment venture. According to the petitioners all of them<\/p>\n<p>have crossed the age of 60 years. Under such circumstances<\/p>\n<p>contention is that they will not come within the definition of<\/p>\n<p>worker under the Kerala Motor Transport Workers Welfare Fund<\/p>\n<p>Act. Since the vehicles are plied by themselves they will not<\/p>\n<p>come within the definition of &#8217;employer&#8217; or &#8217;employee&#8217; under<\/p>\n<p>Section 2(d) and (e) respectively, is the contention. In view of<\/p>\n<p>the situation, the petitioners claim exemption from payment of<\/p>\n<p>contributions to the Kerala Motor Transport Workers Welfare<\/p>\n<p>Fund.\n<\/p>\n<p>     2.    Grievance of the petitioners is that the motor vehicles<\/p>\n<p>tax due with respect to the vehicles owned by them is not being<\/p>\n<p>accepted by the 2nd respondent insisting upon production of<\/p>\n<p>proof regarding payment of contributions, which according to<\/p>\n<p>them is illegal in the above mentioned circumstances.<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.1291 of 2011-J         2<\/span><\/p>\n<p>      3.   The issue now stands covered in favour of the<\/p>\n<p>petitioners by a decision of this Court in Ta-Aleemul Islam<\/p>\n<p>Trust &amp; Others V State of Kerala &amp; others (2009(4) KHC<\/p>\n<p>259).   Therefore I am of the opinion that the insistence for<\/p>\n<p>payment of contributions to the welfare fund could not be<\/p>\n<p>sustained.\n<\/p>\n<p>      4.
