The appellant was the claimant before the Motor\n\nAccidents Claims Tribunal seeking enhancement ufcompensatiun.\n\n4\n\n\n\nThe appellant was aged about 49 at the time \n\nwith the alleged accident, resulting iri \u00bbinjuries\"'teii2er\"'iight \n\nand she was left with a permanent  tvaathe  \n\nto the arm. And it is on ttiisiitiasts that  sgipemehed at\nMotor Accidents Claims  \u00b0E7sr etirnwnsaiititin. The\nTribunal has awarded   It is this which\n\nis under ehallenge. *_-.\n\n3___ would submit that the\nMedieul hsri been examined in support 91' the\n\nclaim hasiiclearlyiiepihied  there was a large extent of disability\n\n _ \ufb02 tov_\u00bbtlii;e  W--he__reb3,\u00ab the appellant is totally incapable of using.\n\n '  _appellant's avueatiun being that of a euolie, the\n\narid the disability is to a greater extent and therefore,\n\n the  was not justified in not addressing a claim towards\n\n s,;\u00a2::i:1ii'pens:-ztiori under the head of disability. The Tribunal has\n\n .?v'__Eailed to address conventional heads of claim in granting\n\ncompensatiun. The Tribunal has not thought it lit to award any\n\n6\n\n\n\nsum towards loss of amenities or towards the attendant:\u00ab.i_elie1ges\nand other charges, which the_appeI1ant was  \nduring the time of her treatment. The'\"lcss  \nof two months, though allowed,    ii\ncompensation being granted. iTl--ie:iV'appelliant  to\nenhanced compensalicri4\"unde:-:*'    iclaim, which\nthe Tribunal has    the Counsel would\nseek all--rot1n\u00e9_l    V. \n\n __   respondent would point out<\/pre>\n
that the   opinion as to the percentage of<\/p>\n
disithility is faul.t\u00a7t and is not in aecordamce with the established<\/p>\n
‘  this doubtful evidence which has prompted the<\/p>\n
i’ i*ihunai’i–i’ltoiihegate the claim towards disability. Though the<\/p>\n
 Practitioner has assessed the disability to the particular<\/p>\n
in ,  at 90%, his further opinion that it would translate to 50%<\/p>\n
 disability to the whole body, is not supported by any special<\/p>\n
reasons. Hence, this would run counter to the established norms<\/p>\n
3<\/span><\/p>\n
that in respect of the upper limb, the whole body <\/p>\n
normally translate to about 25% of  6Xl6Hl”(‘Jf.tii3t-.tl3illl}{ {l’1t’,3i”~<\/p>\n
upper limb. In the instant case, tlie  ‘being <\/p>\n
98%, the disability to the   i229:xi:3;\n<\/p>\n
Hence, the inconsistenoy    of any
\ncompensation insofar  is concerned.\n<\/p>\n
Insulin’ as othetlieads   the appellant herself
\nhad claimed”  per month and the
\n  income. This has resulted
\nin the   a higher sum. Insulin as the pain<\/p>\n
andA.sutTering andstnedieal expenses are concerned, the Tribunal<\/p>\n
it ” has” awe:-al,eda just amounts of compensation. The only marginal<\/p>\n
    appellant may be entitled is under the head of<\/p>\n
loss ofvwneiiitties which would be at the discretion of the Court.<\/p>\n

‘sitlditional claims either under the head of disability or towards<\/p>\n
“other expenses in the absence of material made available and<\/p>\n
therefore the Counsel would submit that the appeal be dismissed.<\/p>\n
