S.J. MUKHOPADHAYA)<\/p>\n<p>This<br \/>\n\tappeal, on grant of leave, has been preferred by the appellant, a<br \/>\n\tthird party, against order dated 15th<br \/>\n\tFebruary 2011 passed by the learned Single Judge in a writ petition\n<\/p>\n<p>\t&#8211; Special Civil Application No.601 of 2011.  In the said case,<br \/>\n\tlearned Single Judge giving  reference to the Supreme Court decision<br \/>\n\tin the case of  <a href=\"\/doc\/32632\/\">T.N.Godavarman<br \/>\n\tThirumulpad v. Union of India &amp; Ors.,<\/a><br \/>\n\treported in (2010) 13 SCC 740 and taking into consideration the fact<br \/>\n\tthat often the problem arises on account of non-coordination amongst<br \/>\n\tdifferent departments of the State Government, the learned<br \/>\n\tGovernment Pleader was asked to see that a required High Power<br \/>\n\tCommittee of the Principal Secretaries of the Industries and Mines<br \/>\n\tDepartment, Forest and Environment Department and Revenue Department<br \/>\n\tis constituted for an effective implementation of Government<br \/>\n\tResolution dated 2nd<br \/>\n\tApril 2008, as also directed the State Government to see that even<br \/>\n\tif, without grant of NOC<br \/>\n\tif anybody has resorted to mining or industrial activity within one<br \/>\n\tkilometer from the boundary of any Sanctuary \/ National Park \/<br \/>\n\tConservation Reserve in the State of Gujarat, the same shall be<br \/>\n\tstopped with immediate effect, but not later than 18th<br \/>\n\tFebruary 2011.    That direction was given in light of the decision<br \/>\n\tof the Supreme Court in the case of  <a href=\"\/doc\/1531060\/\">Anand<br \/>\n\tArya and Another v. Union of India &amp; Ors.,<\/a><br \/>\n\treported in (2011) 1 SCC 744 (paragraphs 73 and 74).\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel appearing on behalf of the appellant would contend that the<br \/>\n\tappellant  had a mining lease for limestone since 1955 for captive<br \/>\n\tconsumption.  It is situated outside Wild Life Sanctuary.   Now, in<br \/>\n\tview of the general order issued by the learned Single Judge, the<br \/>\n\tState Government has issued orders stopping the mining activity.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the appellant would contend that the direction of the<br \/>\n\tSupreme Court  contained in order dated 4th<br \/>\n\tAugust 2006 passed in I.A.No.1598 to 1600 in WP (Civil) No.202 of<br \/>\n\t1995  in the case of T.N. Godavarman Thirumulpad (supra) relates to<br \/>\n\tinterim order passed with regard to mining in Aravalli Hills and in<br \/>\n\tthe order relating to State of Gujarat, no such interim direction<br \/>\n\thas been issued by the Supreme Court.\n<\/p>\n<p>\tNotices were<br \/>\n\tissued on the respondent including 6th respondent &#8211; writ<br \/>\n\tpetitioner.   They have appeared in this case.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the 6th<br \/>\n\trespondent submitted that the writ petition was preferred for a<br \/>\n\tdirection on the respondents &#8211; State of Gujarat (Forest and<br \/>\n\tEnvironment Department) to grant No Objection Certificate for mining<br \/>\n\tin favour of the 6th<br \/>\n\trespondent\n<\/p>\n<p>\t&#8211; writ petitioner.   As it was refused by the State giving<br \/>\n\treference to the Supreme Court decision in interim order, by filing<br \/>\n\tpetition for amendment the sixth respondent &#8211; writ petitioner<br \/>\n\thas also prayed for grant of similar treatment to those who are<br \/>\n\tsimilarly situated.   In view of such prayer, learned Single Judge<br \/>\n\tpassed the impugned order dated 15th<br \/>\n\tFebruary 2011.\n<\/p>\n<p>Mrs<br \/>\n\tManisha L Shah, learned Assistant Government Pleader appearing on<br \/>\n\tbehalf of the State Government has submitted that pursuant to order<br \/>\n\tdated 15th<br \/>\n\tFebruary 2011  passed by the learned  Single Judge in light of the<br \/>\n\tSupreme Court decision, a policy decision prohibiting mining  has<br \/>\n\talso been taken by the State Government.\n<\/p>\n<p>\tWe have heard<br \/>\n\tthe learned counsel for the parties and perused the record.\n<\/p>\n<p>\t It will be<br \/>\n\tevident that after refusal of grant of NOC in favour of 6th<br \/>\n\trespondent &#8211; writ petitioner, the State Government took a plea<br \/>\n\tthat no mining can be made within one kilometer area from the<br \/>\n\tboundary of the Sanctuary \/ National Park \/ Conservation Reserve.<br \/>\n\tIn view of the said stand taken by the respondent-State, the order<br \/>\n\twas passed by the learned Single Judge.\n<\/p>\n<p>\tFrom the<br \/>\n\troster, it will be evident that by the order of the Honourable the<br \/>\n\tChief Justice of this Court, the learned Single Judge was empowered<br \/>\n\tto deal with  only the following matters:-\n<\/p>\n<p> &#8220;SCA<br \/>\n(Non-Service) Group-III<\/p>\n<p>\t\t\t(which are<br \/>\n\t\t\tnot specified in Group I and II) Including the matters relating to<br \/>\n\t\t\tthe Passport Act, the Stamp Act and the Right to Information Act,<br \/>\n\t\t\tAdvocates Act, Electricity Act, Motor Vehicles Act, Registration<br \/>\n\t\t\tof Birth and Death Act, Bombay Police Act, Education Acts, Public<br \/>\n\t\t\tTrusts Act, Mines and Minerals Act, Essential Commodities Act,<br \/>\n\t\t\tNotaries Act, Trade Marks Act, Earth Quake Matters, Cinema Act,<br \/>\n\t\t\tWakf Act and other Miscellaneous Acts.&#8221;\n<\/p>\n<p>As<br \/>\n\tper<br \/>\n\tthe original prayer, as was made by the sixth respondent &#8211;<br \/>\n\toriginal petitioner, it was rightly placed by the Registry before<br \/>\n\tthe learned Single Judge.  However, when a general prayer has been<br \/>\n\tmade by the sixth respondent &#8211; original petitioner by filing<br \/>\n\tan amendment  praying for a direction to prohibit mining within one<br \/>\n\tkm radius from the the boundary of the Sanctuary \/<br \/>\n\tNational Park \/ Conservation Reserve, the nature of the prayer being<br \/>\n\tin public interest, we are of the view that the learned Single Judge<br \/>\n\tought to have referred the matter to Division Bench hearing Public<br \/>\n\tInterest Litigation.   In this background, without going into merit<br \/>\n\tof the case, as we find that the learned Single Judge has no<br \/>\n\tjurisdiction to decide such issue while sitting as a Single Judge<br \/>\n\tand the matter ought to have been referred to the Division Bench<br \/>\n\thearing public interest litigation matters. We set aside order dated<br \/>\n\t15th February 2011<br \/>\n\tpassed by the learned Single Judge in Special Civil Application<br \/>\n\tNo.601 of 2011  The said writ petition is revived and be listed<br \/>\n\tbefore the appropriate Division Bench hearing public interest<br \/>\n\tlitigation matters in view of the amendment made in the prayer<br \/>\n\tclause.   The 6th<br \/>\n\trespondent &#8211; writ petitioner will submit second set of the<br \/>\n\tpaper book within a week.\n<\/p>\n<p>\tPost<br \/>\nSpecial Civil Application No.601 of 2011 before the Division Bench<br \/>\nhearing public interest litigation matters on 26th<br \/>\nApril 2011 within 10 cases.\n<\/p>\n<p>\tLetters Patent<br \/>\nAppeal  and Civil Application both stand disposed of with the<br \/>\naforesaid observations.\n<\/p>\n<p>\t\t(S.J.
