Ltd.\n<\/p>\n<p>In<br \/>\n\tpresent petition, prayer is made by petitioner to direct respondent<br \/>\n\tto pass an order of retirement of petitioner and till then to pay<br \/>\n\tfull salary and allowances as if petitioner is on duty and arrears<br \/>\n\tto be paid with 10%.  In alternative, further prayer is made in para<br \/>\n\t15(B) to direct respondent to pay retirement benefits including<br \/>\n\tpension, gratuity, commuted pension leave encashment w.e.f. 1\/5\/2010<br \/>\n\tand arrears to be paid with 10% interest.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Supehia submitted that petition was filed by New India<br \/>\n\tAssurance Co. Ltd being SCA no. 7448\/2010. This Court has passed an<br \/>\n\torder on 30\/8\/2010 wherein this Court has directed to petitioner in<br \/>\n\tpara 8 and 9, which are quoted as under:\n<\/p>\n<p>8.\tLearned<br \/>\nadvocate Mr.Supehia for respondent No.5 submitted that respondent<br \/>\nNo.5 has retired from service on 30.4.2010 and therefore, more than 4<br \/>\nmonths have passed but, till date because of this dispute<br \/>\n(controversy) the respondent No.5 has not received any retirement<br \/>\nbenefits from petitioner &#8211; Insurance Co. Therefore, he<br \/>\nsubmitted that some suitable direction may be issued to petitioner &#8211;<br \/>\nInsurance Co.  so that petitioner &#8211; Insurance Co. may pay all<br \/>\nthe retirement benefits which are legally available to respondent<br \/>\nNo.5, as early as possible.\n<\/p>\n<p>9.\tIn<br \/>\nview of above submissions made by learned advocate Mr.Supehia, it is<br \/>\ndirected to petitioner &#8211; Insurance Co. to pay all retirement<br \/>\nbenefits which are legally due and available to respondent No.5 under<br \/>\nservice rules, as early as possible, preferably within a period of<br \/>\ntwo months from date of receiving copy of present order without any<br \/>\nfurther delay.&#8221;\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr. Joshi appearing for respondent submitted that order<br \/>\n\tpassed by this Court has been challenged by respondent in LPA no.<br \/>\n\t667\/2011 where division Bench of this Court has passed an order on<br \/>\n\t27\/4\/2011 and dismissed LPA preferred by respondent, which is quoted<br \/>\n\tas under:\n<\/p>\n<p>&#8220;1.\tWe<br \/>\nhave heard Mr. Gautam Joshi, learned counsel appearing for the<br \/>\nappellant, Mr. N.J.Shah, learned Assistant Government Pleader<br \/>\nappearing for respondent nos.1 to 4 and Mr. A.S.Supehia, learned<br \/>\ncounsel appearing for the respondent no.5.\n<\/p>\n<p>2.\t\tThe<br \/>\nappellant filed the writ petition before the learned Single Judge<br \/>\npraying the following reliefs:\n<\/p>\n<p>&#8220;(A)<br \/>\n Your Lordship may be pleased to issue writ of mandamus or writ of<br \/>\ncertiorari or any other appropriate writ, order or direction in the<br \/>\nnature of mandamus directing the respondent no. 2 and 3 to verify the<br \/>\nCaste Certificate of respondent no. 5 declaring the caste certificate<br \/>\nof respondent no. 5 as genuine or not and further issue status of<br \/>\ncaste certificate;\n<\/p>\n<p>(B)<br \/>\nYour Lordship may be pleased to grant any other and further relief as<br \/>\nthink fit and proper in the facts and circumstances of the case and<br \/>\nin the interest of justice;\n<\/p>\n<p>(C)<br \/>\n Costs may be provided for.&#8221;\n<\/p>\n<p>3.\t\tFrom<br \/>\nthe aforesaid, it is clear that the only relief claimed by the<br \/>\nappellant was with regard to application of caste certificate of<br \/>\nrespondent no.5 and declare the caste certificate of respondent no. 5<br \/>\nas genuine or not and further issue status of caste certificate.<br \/>\nThey have stated that if the caste certificate was issued as<br \/>\nrespondent no.5 belonged to scheduled caste category and it was a<br \/>\ngenuine certificate and the caste certificate would stand.\n<\/p>\n<p>4.\t\tThe<br \/>\ncontention of the learned counsel for the appellant is that after<br \/>\nissuance of caste certificate, the respondent no.5 has changed his<br \/>\ncaste and has now become Christian and therefore, the caste<br \/>\ncertificate deserves to be cancelled. But this was not the relief<br \/>\nprayed by the appellant before the authority concerned nor before the<br \/>\nlearned Single Judge. Therefore, we do not find any illegality in the<br \/>\nimpugned order passed by the concerned authority dated 30th August,<br \/>\n2010 and the order of the learned Single Judge. This Letters Patent<br \/>\nAppeal is devoid of any merits and accordingly it deserves to be<br \/>\ndismissed.&#8221;\n<\/p>\n<p>In<br \/>\n\tlight of this back ground, learned advocate Mr. Supehia submitted<br \/>\n\tthat petitioner has been retired from service on 30\/4\/2010, more<br \/>\n\tthan one year has passed till date petitioner has not received any<br \/>\n\tretirement benefits from respondent.\n<\/p>\n<p>At<br \/>\n\tthis stage, learned advocate Mr. GM Joshi made mention to this Court<br \/>\n\tthat he is having instruction that matter has been carried by<br \/>\n\trespondent to Apex Court.  However, apart from this facts, it is<br \/>\n\tdirected to respondent to pay all retirement benefits for which<br \/>\n\tpetitioner is entitled according to service Rules and Regulation of<br \/>\n\trespondent within a period of three months from date of receiving<br \/>\n\tcopy of present order.
