Respondents\n\n        Prayer:- Petition filed under Article 226 of the Constitution of India\npraying for the issuance of a writ of Habeas Corpus calling  for  the  records\nrelating   to  the  detention  order  No.B.D.F.G.I.S-V.No.53  of  2005,  dated\n12.11.2005 passed by the second respondent and set aside the same  and  direct \nthe  respondents  to  produce  the  body of the detenue, by name, Tmt.Indhira,\nW\/o.Ranganathan, aged about 35 years, who is now confined  in  Special  Prison\nfor Women, Vellore before this Court and set her at liberty forthwith and pass\nsuch further orders.\n\n!For Petitioner :  Mr.A.K.S.Thahir\n\n^For Respondents        :  Mr.Abudukumar Rajarathinam\n                Government Advocate (Crl.  Side)\n\n\n:O R D E R \n<\/pre>\n<p>(ORDER OF THE COURT WAS MADE BY P.SATHASIVAM, J.)             <\/p>\n<p>        The  petitioner,  the  uncle of the detenue, by name, Tmt.Indhira, who<br \/>\nwas detained as a &#8220;Bootlegger&#8221; under the Tamil Nadu  Prevention  of  Dangerous<br \/>\nActivities of Boot-leggers, Drug Offenders, Forest Offenders, Goondas, Immoral<br \/>\nTraffic  Offenders,  Slum Grabbers and Video Pirates Act, 1982 (Tamil Nadu Act<br \/>\n14 of 1982) by the impugned order, dated 12.11.2005, challenges  the  same  in<br \/>\nthis petition.\n<\/p>\n<p>        2.   Heard  the  learned  counsel  for  the  petitioner as well as the<br \/>\nlearned Government Advocate for the respondents.\n<\/p>\n<p>        3.  At the foremost, the learned counsel for the petitioner by drawing<br \/>\nour attention to the fact that the detaining authority, though relied  on  the<br \/>\nbail  application  in  Crl.M.P.No.13924  of  2005,  which was dismissed by the<br \/>\nlearned Principal District and Sessions Judge, Chengalpattu on 07.11.2005, the<br \/>\ntranslated copies of the same were not supplied to the detenu, which  vitiates<br \/>\nthe order  of detention.  It is the case of the petitioner that she knows only<br \/>\nTamil.\n<\/p>\n<p>        4.  In such circumstances, as  rightly  pointed  out  by  the  learned<br \/>\ncounsel  for  the  petitioner,  the detaining authority having relied upon the<br \/>\nbail application and the order of dismissal  while  considering  the  imminent<br \/>\npossibility  of the detenue coming out on bail, it is but proper to supply the<br \/>\ntranslated copies to the detenue and failure to  do  the  same,  vitiates  the<br \/>\ndetention order.  On this ground, the impugned order of detention is liable to<br \/>\nbe quashed and accordingly it is quashed.\n<\/p>\n<p>        5.   The Habeas Corpus Petition is allowed and the detenue is directed<br \/>\nto be set at liberty  forthwith  from  custody,  unless  she  is  required  in<br \/>\nconnection with any other case.\n<\/p>\n<p>To\n<\/p>\n<p>1.
