JUSTICE R.M.DOSHIT)<\/p>\n<p>\tHeard<br \/>\nthe learned advocates. With the consent of the learned advocates, the<br \/>\npetition is heard and decided today.\n<\/p>\n<p>\tThis<br \/>\npetition under Article 226 of the Constitution is filed by one<br \/>\nDipakbhai Jagdishchandra Damor against the decision of the authorised<br \/>\nofficer in upholding the objection raised by the respondent no. 3 and<br \/>\nin rejecting the nomination filed by the petitioner for contesting<br \/>\nelection to the Board of Directors of Sabarkantha District<br \/>\nCo-operative Bank Limited-the respondent no. 2 (hereinafter referred<br \/>\nto as  the Bank ).\n<\/p>\n<p>\tThe<br \/>\npetitioner is a member of the managing committee of one Dhandhasan<br \/>\nGroup Seva Sahkari Mandali Limited (hereinafter referred to as  the<br \/>\nDhandhasan Society ), a Primary Co-operative Society registered<br \/>\nunder the Gujarat Co-operative Societies Act, 1961 (hereinafter<br \/>\nreferred to as  the Act ). The Bank is a specified society<br \/>\nwithin the meaning of Section 74-C read with Section 145-B of the<br \/>\nAct.\n<\/p>\n<p>\tPursuant<br \/>\nto the election programme declared by the authorised officer, the<br \/>\npetitioner filed his nomination for contesting election to the Board<br \/>\nof Directors of the the Bank. The petitioner&#8217;s name had been included<br \/>\nin the preliminary list of voters at serial no. 25 as  Damor<br \/>\nDipakbhai Jagdishchandra . The respondent no. 3 raised objection<br \/>\nagainst the nomination filed by the petitioner. Pursuant to the said<br \/>\nobjection the authorised officer by his order dated 27th<br \/>\nJanuary 2010 rejected the nomination of the petitioner. According to<br \/>\nthe authorised officer, the nomination of the petitioner was in<br \/>\ncontravention of the election rules 3(1); 3(4); 3(16); 3(18). Feeling<br \/>\naggrieved the petitioner has preferred the present petition.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>Shelat has taken us through the record, counter affidavits and the<br \/>\nrejoinder. He has referred to the election rules of the Bank,<br \/>\nparticularly the rules under which the petitioner has been<br \/>\ndisqualified. Mr. Shelat has submitted that the petitioner answered<br \/>\nall the requirements for contesting election to the Board of<br \/>\nDirectors of the Bank. He has submitted that the petitioner is a<br \/>\nmember of the Managing Committee of the Dhandhasan Society. The<br \/>\nDhandhasan Society is a member of the Bank. The petitioner is,<br \/>\ntherefore, eligible to contest the election. He has submitted that<br \/>\nthe petitioner&#8217;s original name was  Damor Naileshkumar<br \/>\nJagdishchandra  which he had changed to  Damor Dipakkuamr<br \/>\nJagdishchandra  as early as in the year 2002. The Notification to<br \/>\nthat effect was published in the Gujarat Government Gazette on 29th<br \/>\nAugust 2002. The petitioner had also produced evidence that the<br \/>\npetitioner was a member of the Dhandhasan Society for last 10 years.<br \/>\nThe Dhandhasan Society had passed resolution to nominate the<br \/>\npetitioner to vote for and to contest the election to the Board of<br \/>\nDirectors of the Bank; that the Dhandhasan Society had no pending<br \/>\nclaim against the petitioner; that the petitioner had no outstanding<br \/>\ndues to the Bank. The petitioner&#8217;s name was proposed by one<br \/>\n Manharbhai Hotha . The said  Manharbhai Hotha  is a member<br \/>\nof one Ritoda Thuravas Group Seva Sahakari Mandali Limited, a member<br \/>\nPrimary Co-operative Society. The said Ritoda society had passed<br \/>\nresolution permitting the said Manharbhai Hotha to propose the name<br \/>\nof the petitioner for election to the Board of Directors of the Bank.<br \/>\nThe said proposal was seconded by one Gameti Chunilal Manjibhai. The<br \/>\nsaid Gameti Chunilal Manjibhai is a member of one Merawada (Khari)<br \/>\nSeva Sahakari Mandali Limited a Primary Co-operative Society and a<br \/>\nmember of the Bank. The said Merawada Society had passed resolution<br \/>\npermitting the aforesaid Gameti Chunilal Manjibhai to second the name<br \/>\nof the petitioner for contesting election to the Board of Director of<br \/>\nthe Bank. In the submission of Mr. Shelat not only the petitioner is<br \/>\neligible for contesting the forthcoming election but he has completed<br \/>\nall the formalities. The rejection of the nomination of the<br \/>\npetitioner is illegal and is made on the ground legally not<br \/>\nsustainable. Not only the nomination does not suffer from the<br \/>\ninfirmities referred to in the impugned communication, but the<br \/>\npetitioner answers all requirements. Therefore, there should not be<br \/>\nany reason not to accept the nomination filed by the petitioner. In<br \/>\nsupport of his submission Mr. Shelat has relied upon the judgment of<br \/>\nthe Hon&#8217;ble Supreme Court in the matter of <a href=\"\/doc\/1247997\/\">Election Commission of<br \/>\nIndia vs. Ashok Kumar &amp; others<\/a> [2000 (8) SCC 216] and of this<br \/>\nCourt in the matter of <a href=\"\/doc\/1669351\/\">Ukabhai Jivabhai Kanjaria vs. State of<br \/>\nGujarat &amp;<\/a> ors [2007(2) GLH 242].\n<\/p>\n<p>\tIn<br \/>\nresponse to the notice issued by this Court, the petition is<br \/>\ncontested by the authorised officer through learned Government<br \/>\nPleader Mr. P.K. Jani and by the objector through learned advocate<br \/>\nMr. K.M. Patel.\n<\/p>\n<p> \tAt<br \/>\nthe outset, Mr. P.K. Jani has submitted that the petition is not<br \/>\nmaintainable. He has submitted that the petitioner&#8217;s name was not<br \/>\nproperly proposed or seconded by an appropriate resolution passed by<br \/>\nthe concerned society. He has questioned veracity of the resolution<br \/>\nproduced by the petitioner. Mr. Jani has relied upon the election<br \/>\nrules. In the submission of<br \/>\nMr. Jani the  resolution purportedly passed by the Merawada Society<br \/>\nis a mere letter and does not comply with the requirement under rule<br \/>\n16 of the election rules. He has submitted that though<br \/>\nthe petitioner has changed his name from  Naileshkumar  to that<br \/>\nof  Dipakkumar , he is also known as  Dilipkumar . Thus the<br \/>\npetitioner does not have reliable identity nor can he be permitted to<br \/>\ncontest the election. Nor the aforesaid Chunilal Gameti was<br \/>\nauthorized to second the nomination of the petitioner. In support of<br \/>\nhis submission Mr. Jani has relied upon the judgment in the matter of<br \/>\nGujarat State Co-operative Bank Limited &amp; anr vs. State of<br \/>\nGujarat &amp; ors [2009 (1) GLH 371].\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. K.M. Patel has appeared for the respondent no. 3- the<br \/>\nobjector. He has contested the petition and has supported the<br \/>\nimpugned order made by the authorized officer.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>K.M. Patel has submitted that the impugned order is erroneous in so<br \/>\nfar as reference is made to election rule 3(4). He has relied upon<br \/>\nelection rules and submitted that the petitioner is not disqualified<br \/>\nunder election rule 3(4) but under rule 3(3). He has also relied upon<br \/>\nthe prevalent bye-laws of the Bank. He has submitted that the<br \/>\nprevalent bye-laws require that if the society which the contestant<br \/>\nrepresents is indebted to<br \/>\nthe Bank or any other society affiliated to the Bank, such member is<br \/>\ndisqualified from contesting election. He has submitted that the<br \/>\nDhandhasan Society is indebted to one Shamlaji Vibhagiya Sahakari<br \/>\nKharid Vechan Sangh Limited. Hence, the petitioner who represents the<br \/>\nDhandhasan Society is disqualified to contest election to the Board<br \/>\nof Directors of the Bank. He has also challenged the veracity of the<br \/>\nresolution purportedly passed by the Merawada Society. He has<br \/>\nsubmitted that the Merawada Society had not met on 22nd<br \/>\nJanuary 2010, nor the aforesaid Gameti Chunilal Manjibhai was<br \/>\nauthorized to second the nomination of the petitioner.\n<\/p>\n<p> 9\/2\/2010<\/p>\n<p>\tAs<br \/>\nthe seconding of the petitioner&#8217;s nomination by the aforesaid  Gameti<br \/>\nChunilal Manjibhai is seriously in dispute, we had given opportunity<br \/>\nto the petitioner to produce the original resolution before the<br \/>\nCourt. Learned advocate Mr. Shelat has failed to produce the original<br \/>\nresolution.\n<\/p>\n<p>\tIn<br \/>\nthe aforesaid fact situation, we do not examine larger issue whether<br \/>\nthe petitioner is disqualified on account of Dhandhasan Society being<br \/>\nindebted to the aforesaid Shamlaji Vibhagiya Sahakari Kharid Vechan<br \/>\nSangh Limited. We hold that the petitioner&#8217;s name was not properly<br \/>\nseconded by a person duly authorized by the society, which he<br \/>\nrepresents. Unless the petitioner&#8217;s name was properly proposed and<br \/>\nseconded, his nomination could not have been accepted. The decision<br \/>\nof the authorized officer to reject the nomination of the petitioner<br \/>\ndoes not warrant interference.\n<\/p>\n<p>\tFor<br \/>\nthe aforesaid reasons, we dismiss the petition.
