Dabhi, learned APP wavies service of notice of Rule on behalf<br \/>\nof the respondent-State.\n<\/p>\n<p>\tThe<br \/>\napplicant prays for regular bail in connection with the offences<br \/>\nregistered with Dabhoi Police Station, vide C.R.No.I-66 of 2011 for<br \/>\nthe offences punishable under Sections 376 and 506(2) of the Indian<br \/>\nPenal Code.\n<\/p>\n<p>\tI<br \/>\nhave heard learned advocate Mr. Ashish M. Dagli for the applicant and<br \/>\nMr.L.B. Dabhi, learned APP for the respondent-State.\n<\/p>\n<p>\tPrima-facie<br \/>\nit appears as per the case of the prosecutrix who is aged about 32<br \/>\nyears that on the date of the incident i.e. on 28.04.2011, she was at<br \/>\nher home and in the night hours the accused &#8211; applicant<br \/>\nforcefully entered into the house and forcibly committed rape on the<br \/>\nprosecutrix.\n<\/p>\n<p>\tIt<br \/>\nappears that the FIR was also lodged after a period of two days i.e.<br \/>\non 30.04.2011, however, the entire case put up by the prosecutrix<br \/>\nprima-facie does not inspire any confidence. Investigation is<br \/>\npractically over and in this view of the matter, the accused &#8211;<br \/>\napplicant can be released on regular bail subject to certain terms<br \/>\nand conditions.\n<\/p>\n<p>\tTaking<br \/>\ninto consideration the aforesaid prima facie aspects, I order release<br \/>\nof the accused &#8211; applicant on regular bail in connection with<br \/>\noffence registered with Dabhoi Police Station, being C.R.No.I-66 of<br \/>\n2011 on his executing a bond in the sum of Rs.15,000\/- (Rupees<br \/>\nfifteen thousand only) with one solvent surety of the like amount to<br \/>\nthe satisfaction of the Lower Court and subject to the conditions<br \/>\nthat he shall,<\/p>\n<p>\t(a)\tnot<br \/>\ntake undue advantage of or misuse liberty;\n<\/p>\n<p>\t(b)\tmaintain<br \/>\nlaw and order and should co-operate with the  \t\tInvestigating<br \/>\nOfficer;\n<\/p>\n<p>(c)<br \/>\n \tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(d)\tsurrender<br \/>\nhis passport, if any, to the Lower Court within a week;\n<\/p>\n<p>(e)\tshall<br \/>\nmark his presence before the concerned Police Station in a month of<br \/>\nevery 4th<br \/>\nSunday between 10:00 A.M.  and 5:00 P.M.\n<\/p>\n<p>(f)\tnot<br \/>\nleave the local limits of the State of Gujarat without prior<br \/>\npermission of the Sessions Judge concerned;\n<\/p>\n<p>(g)\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt.\n<\/p>\n<p>(h)\tshall<br \/>\nnot enter the Village Bamboj,  Navi Nagri till the filing of<br \/>\nchargesheet.\n<\/p>\n<p>\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the Lower Court having jurisdiction to try<br \/>\nthe case. This application is allowed.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
