Tribunal (Aux.) (FTC), Rajkot in<br \/>\nMACP No.388 of 2001, on the  grounds stated in the application.\n<\/p>\n<p>2.\tReasons<br \/>\nas to why the appeal could not be filed in time are detailed  in<br \/>\nparas 4 and 5 of the application. It is pleaded that there was<br \/>\nsufficient cause on the part of the applicants for not filing the<br \/>\nappeal in time. It is therefore prayed to condone the delay.\n<\/p>\n<p>3.\tWe<br \/>\nhave considered the submissions advanced by Ms. Paurami B Sheth,<br \/>\nlearned advocate for the applicants, Mr. Bhavin S Raiyani, learned<br \/>\nadvocate for opponent No.2 and Mr. Hasmukh Thakker, learned advocate<br \/>\nfor opponent No.3. Though served, opponent No.1 has not appeared and<br \/>\ncontested the application. We have also considered the celebrated<br \/>\nprinciples governing the discretionary exercise of powers under<br \/>\nSection 5 of the Act and the reported decisions of the Supreme Court<br \/>\nconstruing Section 5 of the Act liberally.\n<\/p>\n<p>4.\tSo<br \/>\nfar as the question of condonation of delay is concerned, it has to<br \/>\nbe decided having regard to the principles laid down by the Supreme<br \/>\nCourt in the case of (i)  <a href=\"\/doc\/644440\/\">State of Bihar &amp; others v. Kamleshwar<br \/>\nPrasad Singh &amp;<\/a> another, AIR 2000 SC 2306 (paras 11 to 14 of the<br \/>\nreported judgment), (ii) <a href=\"\/doc\/1240908\/\">N. Balakrishnan v. M. Krishnamurthy,<br \/>\nJudgment Today,<\/a> 1998 (6) SC 242, (iii) <a href=\"\/doc\/852301\/\">State of Haryana v. Chandra<br \/>\nMani &amp; others<\/a>, AIR 1996 SC 1623, (iv) <a href=\"\/doc\/1909040\/\">Spl. Tehsildars, Land<br \/>\nAcquisition, Kerala v. K.V. Ayisumma, AIR<\/a> 1996 SC 2750, (v) Punjab<br \/>\nSmall Industries and Export Corporation Limited and others v. Union<br \/>\nof India and others, 1995 Suppl. (4) SCC 681, (vi) P.K. Ramachandran<br \/>\nv. State of Kerala and another (1997) 7 SCC 566 and (vii) <a href=\"\/doc\/1117226\/\">Collector,<br \/>\nLand Acquisition, Anantnag v. Mst. Katiji, AIR<\/a> 1987 SC 1353 and<br \/>\nother relevant decisions on the point.\n<\/p>\n<p>5.\tApplying<br \/>\nthe principles laid down by the Supreme Court in the above referred<br \/>\nto judgments to the facts of the present case,  we are satisfied that<br \/>\nsufficient cause is made out by the applicants for condonation of<br \/>\ndelay. The record does not indicate that there was any inaction or<br \/>\nnegligence on the part of the applicants in prosecuting the appeal.<br \/>\nThe explanation for delay offered by the applicants is not only<br \/>\nplausible but acceptable and, therefore,  the application deserves to<br \/>\nbe granted.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, the application succeeds and accordingly it is<br \/>\nallowed. Delay  of 493 days caused in filing the above stamp-numbed<br \/>\nFirst Appeal is condoned. Rule is made absolute.
