Justice V.GIRI\n\n Dated :05\/09\/2007\n\n O R D E R\n                                  V.GIRI, J.\n             -------------------------\n                     W.P.(C).No.9311 of 2007 H\n             -------------------------\n             Dated this the 5th day of September, 2007.\n\n\n                               JUDGMENT\n<\/pre>\n<p>             On 14.8.2007, this court passed an interim order directing that<\/p>\n<p>the entire liability of the 4th respondent towards the liability of which the<\/p>\n<p>petitioners are sureties, shall be realised from the gratuity of the 4th<\/p>\n<p>respondent which is withheld and the amount shall be paid by<\/p>\n<p>respondents 2 and 3 to the Service Co-operative Bank, Cherthala. If the<\/p>\n<p>amount withheld is inadequate to discharge the liability, then the balance<\/p>\n<p>amount may be adjusted from the gratuity dues of the first petitioner.<\/p>\n<p>             2. Learned Government Pleader, on instructions, submits that<\/p>\n<p>the entire amount due to the Service Co-operative Bank, Cherthala has<\/p>\n<p>been adjusted from the Death cum Retirement Gratuity due and<\/p>\n<p>admissible to the 4th respondent. It is also submitted that the petitioners<\/p>\n<p>have already been issued non-liability certificates. This submission is<\/p>\n<p>recorded.
