L.B.DABHI, APP for Respondent(s) :\n1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 07\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>By<br \/>\n\tfiling instant Application through jail authority, the applicant &#8211;<br \/>\n\tconvict has prayed to release him on temporary bail for a period of<br \/>\n\t30 days to enable him to get the treatment from the Doctor of his<br \/>\n\town choice as he is a known patient of HIV Positive since 2008.\n<\/p>\n<p>We<br \/>\n\thave considered the submission advanced by Mr.L.B.Dabhi, learned APP<br \/>\n\tfor the Respondent &#8211; State of Gujarat and a perusal of the<br \/>\n\taverments made in the application, and also the jail remark sheet<br \/>\n\tforwarded by the jail authority along with the Application, so also<br \/>\n\tthe medical certificate dated 21.1.2011 issued by Medical Officer,<br \/>\n\tCentral Jail Dispensary, Ahmedabad, wherein, it is mentioned that<br \/>\n\tthe Applicant convict is getting symptomatic treatment from time to<br \/>\n\ttime according to his minor complaints such as mild fever, cough,<br \/>\n\tbody ache as per the advice of jail medical officers, and at present<br \/>\n\the can do his routine activities and his health is improving.<br \/>\n\tBesides this, earlier Criminal Misc.
