JUSTICE BIRENDRA PRASAD VERMA\n                  ORAL ORDER<\/pre>\n<p>                  (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>2.   08-11-2011                    Feeling aggrieved by the judgment and order dated<br \/>\n                  18th July 2011 passed by the learned single Judge in above<br \/>\n                  C.W.J.C. No. 7557 of 2005, the writ petitioner has preferred the<br \/>\n<span class=\"hidden_text\"> 2   Patna High Court LPA No.1569 of 2011 (2) dt.08-11-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                          2\/3<\/span><\/p>\n<p>             present Appeal under Clause 10 of the Letters Patent.\n<\/p>\n<p>                              The appellant, a Government servant was, by order<br \/>\n             dated 9th June 2003 placed under suspension. While under<br \/>\n             suspension, by order dated 3rd September 2004, the appellant was<br \/>\n             promoted as an Under Secretary to the Government. The said<br \/>\n             order of promotion was later recalled on 27th April 2005. Feeling<br \/>\n             aggrieved, the appellant filed above C.W.J.C. No. 7557 of 2005<br \/>\n             under Article 226 of the Constitution.\n<\/p>\n<p>                              The learned single Judge has noted that the impugned<br \/>\n             order of recall of the order of promotion was made without<br \/>\n             affording opportunity of hearing to the appellant. The order is<br \/>\n             made in violation of principle of natural justice. However, keeping<br \/>\n             in view the further developments that the criminal prosecution<br \/>\n             lodged against the appellant has been quashed in exercise of power<br \/>\n             conferred by Section 482 Cr.P.C.; the order of suspension has been<br \/>\n             revoked and; the appellant has been reinstated in service, the<br \/>\n             learned single Judge has reserved liberty to the appellant to make<br \/>\n             representation before the concerned authority. The concerned<br \/>\n             authority has been reserved liberty to make an order afresh as may<br \/>\n             be required. Feeling aggrieved, the writ petitioner has preferred the<br \/>\n             present Appeal.\n<\/p>\n<p>                              Learned advocate Mr. Dinu Kumar has appeared for<br \/>\n             the appellant. He has submitted that the impugned order dated 27th<br \/>\n             April 2005 of recall of the order of promotion was made in<br \/>\n             violation to the principle of natural justice and was thus void ab<br \/>\n             initio. The learned single Judge should have set aside the order<br \/>\n             dated 27th April 2005 and revived the order of promotion dated 3 rd<br \/>\n             September 2004. He has submitted that the representation and<br \/>\n             reconsideration afresh will not compensate the prejudice caused to<br \/>\n<span class=\"hidden_text\"> 3         Patna High Court LPA No.1569 of 2011 (2) dt.08-11-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                3\/3<\/span><\/p>\n<p>                   the appellant. In support thereof, he has relied upon the judgments<br \/>\n                   in the matters of Raj Kishore Singh v. State of Bihar, [(2006 (4)<br \/>\n                   PLJR 71]; and of <a href=\"\/doc\/23341272\/\">Ramnandan Prasad v. State of Bihar,<\/a> [1983<br \/>\n                   PLJR 266].\n<\/p>\n<p>                                    We do appreciate that the impugned order dated 27 th<br \/>\n                   April 2005 was made in violation of principle of natural justice. It<br \/>\n                   may be noted that the very order of promotion made on 3rd<br \/>\n                   September 2004 was wholly illegal as the appellant could not have<br \/>\n                   been promoted as he was placed under suspension. The<br \/>\n                   discretionary jurisdiction conferred by Article 226 of the<br \/>\n                   Constitution cannot be exercised to set aside an order which will<br \/>\n                   have the effect of reviving a totally illegal order. Besides, the<br \/>\n                   cancellation of the promotion did not entail civil consequences as<br \/>\n                   the appellant was already undergoing suspension.\n<\/p>\n<p>                                    In view of the further development the learned single<br \/>\n                   Judge has rightly allowed the appellant to make a representation<br \/>\n                   and has rightly directed the respondents to consider such<br \/>\n                   representation.\n<\/p>\n<p>                                    No case for interference is made out.\n<\/p>\n<p>                                    Appeal is dismissed in limine.\n<\/p>\n<p>                                                          (R.M.
