(C) No.25070 of 2005)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order passed by a<br \/>\nlearned Single Judge of Uttaranchal High Court. Appellant had<br \/>\nquestioned the correctness of the order passed by the<br \/>\nPresiding Officer, Labour Court, Haldwani, Nainital (in short<br \/>\nthe &#8216;Labour Court&#8217;) in the writ petition.\n<\/p>\n<p>3.\tThe Claim of the respondent was that he was working as<br \/>\na sweeper in the hospital of the appellant and was appointed<br \/>\non 1.7.1995 and worked up to 16.8.1996. But his services<br \/>\nwere terminated on 17.8.1996 without any notice and without<br \/>\nany retrenchment allowances. A dispute was raised which was<br \/>\nreferred to the Labour Court for adjudication under Section 6N<br \/>\nof the U.P. Industrial Disputes Act, 1947 (in short &#8216;the Act&#8217;).<br \/>\nThe Labour Court held that the respondent was entitled to the<br \/>\nbenefit of reinstatement and 50% of back wages. The stand of<br \/>\nthe appellant that the respondent was engaged on a daily wage<br \/>\nbasis for doing a part time job of sweeping was held to be not<br \/>\nacceptable. It was held that the respondent had rendered more<br \/>\nthan 240 days of service. Before the High Court, the stand of<br \/>\nthe appellant was that the respondent did not render service<br \/>\nfor more than 240 days as claimed. His appointment was only<br \/>\non temporary basis and that too for one hour daily. This stand<br \/>\nwas not accepted by the High Court.\n<\/p>\n<p>4.\tLearned counsel for the appellant in support of the<br \/>\nappeal submitted that voluminous documents were produced<br \/>\nto show that the respondent was working on a temporary<br \/>\nengagement basis and that too for one hour or some times for<br \/>\na little more than an hour. The question for having worked<br \/>\nmore than 240 days in the year preceding the alleged<br \/>\ntermination did not arise.\n<\/p>\n<p>5.\tLearned counsel for the respondent on the other hand<br \/>\nsupported the order passed by the Labour Court and the High<br \/>\nCourt.\n<\/p>\n<p>6.\tIt is undisputed that the work of cleaning the hospital<br \/>\nhas been given to a contractor w.e.f. 17.8.1996. Materials were<br \/>\nplaced before the Labour Court to show that the workman was<br \/>\nengaged for doing a part-time job and that he had worked for a<br \/>\nfew days in several months. The Labour Court itself on<br \/>\nconsideration of the documents and records produced noted<br \/>\nas follows:-\n<\/p>\n<p>&#8220;It is evident that the workman had<br \/>\nworked in August, 1996 -16 days, July, 1996 &#8211;<br \/>\n30 days, May, 1996 &#8211; 30 days, April, 1996 &#8211; 30<br \/>\ndays, March, 1996 &#8211; 29 days, February, 1996 &#8211;<br \/>\n29 days, January, 1996 &#8211; 31 days, December,<br \/>\n1995 &#8211; 31 days, November, 1995 &#8211; 20 days<br \/>\n(Full), October, 1995 &#8211; 19 days (Full),<br \/>\nSeptember, 1995 &#8211; 25 days (Full ) @ Rs. 35\/-<br \/>\nper day.\tIn addition to this, in November,<br \/>\n1995  3 days, October, 1995 &#8211; 9 days @<br \/>\nRs.20\/- per day towards part time work and in<br \/>\nSeptember, 1995  3 days part time @ Rs.5\/-<br \/>\nper day, had worked.&#8221;\n<\/p>\n<p>7.\tThe basic difference between a person who is engaged on<br \/>\na part-time basis for one hour or few hours and one who is<br \/>\nengaged as a daily wager on regular basis has not been kept in<br \/>\nview either by the Labour Court or by the High Court. The<br \/>\ndocuments filed clearly establish that the claim of having<br \/>\nworked more than 240 days is clearly belied.\n<\/p>\n<p>8.\tThe stand of the appellant that the respondent was called<br \/>\nfor work whenever work was available, and as and when<br \/>\nrequired and that he was not called for doing any work when<br \/>\nthe same was not available has been established. The Labour<br \/>\nCourt itself noted that the workman was engaged in work by<br \/>\nothers as he was working in the appellants&#8217; establishment for<br \/>\none hour or little more on some days.  It is  also seen from the<br \/>\ndocuments produced before the Labour Court that whenever<br \/>\nrespondent was working for full period of work he was being<br \/>\npaid Rs.35\/- per day  and on other days when he worked for<br \/>\none hour he was getting Rs.5\/-.\n<\/p>\n<p>9.\tIn the aforesaid position, the inevitable conclusion is<br \/>\nthat the Labour Court and the High Court were not justified<br \/>\nin directing the reinstatement with partial back wages.\n<\/p>\n<p>10.\tThe appeal is allowed with no order as to costs.\n<\/p>\n<p>11.\tIt is made clear that the fact we have allowed the appeal<br \/>\nshall not stand in the way of the appellant giving engagement<br \/>\nto the respondent on such terms as deemed proper.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Uttaranchal Forest Hospital &#8230; vs Dinesh Kumar on 27 November, 2007 Author: .
