  of the vehicle is ordered to indemnify the owner of the<\/p>\n
 fveh.ie1e.. Being aggrieved, the appeliant-insurer has \ufb01led these<\/p>\n
appeais.\n<\/p>\n
2. The only short point involved in these appeals is
\nwhether the Commissioner for workmen Compensation,<\/p>\n
Bagalkot is justi\ufb01ed in fastening the liability on the appelaint to
\npay compensation to the claimants] respondent No.1  all<\/p>\n
these appeals? I<\/p>\n
3. The contention of the learned counsel   _  <\/p>\n
is that since the vehicle involved in tiieeeeioeot<\/p>\n
vehicle, according to the permit TissuecVi4′!33}”i;1;1e   <\/p>\n
respondent No.2, appellant is  to coyfer.  VV<\/p>\n
the owner of the vehicie to;eo”t’11<:'Ve.:':e\u00a7\u00e9'te;'zt of i.e., 2<\/p>\n
cooiies\/hamalies and one 4%\u00a21\ufb01y\u00a2g~.e+o  liability \ufb01xed<\/p>\n
on the  _\u00bb _ Commissioner for workmen<\/p>\n

owner has contnzavened the terms and conditions of the permit<\/p>\n
of the policy as per which the appeilant is liable to <\/p>\n
the owner of the vehicle only in respect of the 3  <\/p>\n

 Sreh\u00e9eie tviiabstizle extent of driver and two cooiies who sustained<\/p>\n
  'i\ufb01itiries during the course of employment. Since the vehicle<\/p>\n
  -~i;mViolved in the case is a light goods vehicle, six coolies may not<\/p>\n
vbe required for loading and unloading. Therefore, -the<\/p>\n
Commissioner for Workmen Compensation has wrongly relied<\/p>\n
on the above said decisions rendered by the Madras High;<\/p>\n
and Andhxa Pradesh High Couxt.\n<\/p>\n

\ufb01e  these appeals deserve to be allowed<\/p>\n
