      Defendant No.2 in O.S.No.2590 of 2008 of the court of<\/p>\n
learned Additional Munsiff-II, Thrissur is the petitioner before me,<\/p>\n
challenging Ext.P4, order refusing to set aside the report and<\/p>\n
sketch   (Exts.P2   and     P2(a))     prepared      by  the Advocate<\/p>\n
Commissioner. Respondent\/plaintiff sued petitioner and another<\/p>\n
for a declaration of right of easement by way of necessity over<\/p>\n
plaint B schedule claiming that plaint B schedule is the only access<\/p>\n
to plaint A schedule belonging to the respondent and for a decree<\/p>\n
for mandatory injunction to direct petitioner and defendant No.1 to<\/p>\n
remove the obstruction caused by them.                   The Advocate<\/p>\n
Commissioner inspected property and submitted report and sketch<\/p>\n
(Exts.P2 and P2(a)). Petitioner preferred objection claiming that<\/p>\n
there is no such way as described in plaint B schedule or, as<\/p>\n
reported by the Advocate Commissioner and that the Advocate<\/p>\n
Commissioner has not noted existence of an alternative way<\/p>\n
available to the respondent for access to plaint A schedule. It is<\/p>\n
contended by learned counsel for petitioner that Advocate<\/p>\n
Commissioner has not reported existence of the buildings in plaint<\/p>\n

B schedule and that the intervening wall of the temple compound<\/p>\n
was taken as the outer wall of temple compound. The request<\/p>\n
sought by petitioner to set aside the report and sketch was opposed<\/p>\n
by the respondent. Learned Munsiff passed Ext.P4, order refusing<\/p>\n
to set aside the report and sketch observing that petitioner failed to<\/p>\n
prove that the facts reported by the Advocate Commissioner are<\/p>\n
totally false, if at all there was any shortcoming in the report,<\/p>\n
petitioner could have requested the Court either to remit the report<\/p>\n
and sketch or to direct the Commissioner to once again inspect the<\/p>\n
property for reporting additional facts.      That order is under<\/p>\n
challenge. Learned counsel for petitioner argued that according to<\/p>\n
the respondent, plaint B schedule is puramboke land and that there<\/p>\n
are buildings in the said property. It is the further contention of<\/p>\n
learned counsel that existence of alternative way for access to<\/p>\n
plaint A schedule was not reported by the Advocate Commissioner.<\/p>\n
Learned Senior Advocate appearing for respondent\/plaintiff<\/p>\n
contended that opportunities available to the petitioner to get<\/p>\n
additional facts if any, noted by the Advocate Commissioner were<\/p>\n
not availed and that I.A.No.10286 of 2008 filed by petitioner for<\/p>\n
review of the order on I.A.No.8426 of 2008 was dismissed for the<\/p>\n
reason that petitioner did not take necessary steps on time.<\/p>\n

      2.    Claim of respondent is a right of easement by way of<\/p>\n
necessity along plaint B schedule.     Certainly, question whether<\/p>\n
respondent has any other means of access to plaint A schedule<\/p>\n
which he can use as of right is relevant for consideration. It is true<\/p>\n
that in Ext.P2, report the Advocate Commissioner has reported that<\/p>\n
plaint B schedule is the only access to the plaint A schedule but,<\/p>\n
that of course is controverted by the petitioner who asserts that<\/p>\n
there is alternative access to the plaint A schedule.       Advocate<\/p>\n
Commissioner has not reported whether plaint B schedule is<\/p>\n
puramboke as claimed by the respondent.             It is in these<\/p>\n
circumstances learned Munsiff observed that the proper course<\/p>\n
open to the petitioner was not to seek to set aside Exts.P2 and P2<\/p>\n
(a) but to request the court to remit the report or, appoint an<\/p>\n
Advocate Commissioner to report on matters additionally required<\/p>\n
by petitioner.    I must bear in mind that it is not as if learned<\/p>\n
Munsiff foreclosed right of petitioner to get additional facts<\/p>\n
pleaded by petitioner to be ascertained. The request to set aside<\/p>\n
the report and sketch was disallowed.        Having heard learned<\/p>\n
counsel for petitioner and learned Senior Advocate appearing for<\/p>\n
respondent and gone through the order under challenge, I do not<\/p>\n
find reason to interfere with the order refusing to set aside Exts.P2<\/p>\n
and P2(a).\n<\/p>\n

      3.    Then the question is whether petitioner should be<\/p>\n
permitted to get additional facts as claimed by him noted by the<\/p>\n
Advocate Commissioner. Petitioner has a contention that there are<\/p>\n
several structures in plaint B schedule and that respondent has<\/p>\n
alternative access to the plaint A schedule.   Respondent has a<\/p>\n
contention that plaint B schedule is puramboke land.        These<\/p>\n
aspects can be ascertained by remitting the report and sketch so<\/p>\n
that the Commissioner could ascertain whether any portion of<\/p>\n
plaint B schedule is puramboke land with the help of a qualified<\/p>\n
Surveyor.    Petitioner can also get it ascertained through the<\/p>\n
Commissioner whether there are structures in plaint B schedule<\/p>\n
and whether respondent has alternative access to the plaint A<\/p>\n
schedule, of course at the cost of petitioner. Learned Senior<\/p>\n
Advocate appearing for respondent has stated that even plaint B<\/p>\n
schedule as reported by the Advocate Commissioner has been<\/p>\n
blocked by the petitioner and respondent is left with no access to<\/p>\n
the plaint A schedule.    It is submitted that an application for<\/p>\n
temporary\/mandatory injunction filed by the respondent is pending<\/p>\n
in the trial court and coming up for hearing on 30-10-2010. That<\/p>\n
application was not taken up so far on account of pendancy of this<\/p>\n
petition in this court.  I make it clear that it is open to the<\/p>\n
respondent to request learned Munsiff to take up that application<\/p>\n

for temporary\/mandatory injunction for consideration without<\/p>\n
waiting for the additional report and plan if such a course is<\/p>\n
possible.\n<\/p>\n
     Resultantly this petition is allowed in the following lines:<\/p>\n
               (i)    While holding that there is no reason to<\/p>\n
        interfere with the order of learned Munsiff refusing<\/p>\n
        to set aside Exts.P2 and P2(a). Learned Munsiff is<\/p>\n
        directed to remit the report and sketch to the<\/p>\n
        Advocate Commissioner to ascertain the following<\/p>\n
        matters:-\n<\/p>\n
                        (a) Whether, any portion of plaint<\/p>\n
                 B schedule takes in puramboke land?<\/p>\n<\/blockquote>\n
                        (b) Whether there are structures<\/p>\n
                 in plaint B schedule, if so details and<\/p>\n
                 location?\n<\/p><\/blockquote>\n
                        (c) Whether       there   is    any\n\n                 alternative way to the respondent for\n\n                 access to plaint A schedule and if so, its\n\n                 details?\n\n               (ii)   Learned   Munsiff     may   appoint    a\n\n        qualified     surveyor   to    assist the    Advocate\n\n<\/pre>\n
        Commissioner in ascertaining whether plaint B<\/p>\n
        schedule takes in puramboke land.<\/p><\/blockquote>\n
               (iv)   The batta payable to the Advocate<\/p>\n
        Commissioner and Surveyor shall be paid by<\/p>\n
        petitioner as ordered by the learned Munsiff within<\/p>\n
        three weeks from this day.<\/p>\n
\n\nW.P(C).No. 25530 of 2010\n                                  : 6 :<\/span>\n\n\n               (v)    Learned   Munsiff    shall   direct  the\n\n<\/pre>\n
        Advocate Commissioner and Surveyor to carry out<\/p>\n
        the work and submit report and plan at the earliest<\/p>\n
        so that there is no further delay in the matter.<\/p>\n
               (vi)   In  case   petitioner   fails to   remit<\/p>\n
        Commissioner’s batta as ordered by the learned<\/p>\n
        Munsiff, this writ petition will stand dismissed.<\/p>\n
               (vii) Parties will be at liberty to prefer their<\/p>\n
        objection to the report and plan and adduce<\/p>\n
        evidence in respect of their respective contentions<\/p>\n
        in the suit in the course of trial.\n<\/p>\n<\/p>\n
