Re.\ufb01ClAlel.lefuhder\ufb01ectien 138 of N.l.Act is net proved. as the\n\n \" \u00ab--eomele'ihz;n}t has net\" preeed the transaction between the petitioner end\n\nV' the reesgeepiere.\u00bb  ' ----.\n\nA   Counsel appearing for the reependent submitted that.\n\n  'the petitimjier and respondent are the close relatives. The petitioner was<\/pre>\n<p>  &#8220;&#8216;l&#8211;ih\ufb01_hei_:clei crieie. in order to help the petitioner, the respondent agreed<br \/>\n  telpurehase the running concern and in this regard. he had paid R520<\/p>\n<p>ii iakhe to the petitioner. when the cheques were ciiehoneurecl. a notice<\/p>\n<p>was leeued. if really the running concern belongs to the partnership<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>firm. the petitioner could not have kept quite even after receipt of notice.<br \/>\nNo repiy is given to the tenet notice. He relied on Exs.P?&#8217; anti*.i?8 &#8211;~<br \/>\nmemorandum of undertaking wherein the petitioner<br \/>\nissue of cheque. He also submitted that the cheeoee..ioeior&#8217;ini&#8221;&#8221;to<br \/>\npetitioner is not in dispute. The petitioner&#8217;has&#8217;e.i_ieeect&#8217;th.et..  nest&#8217;<br \/>\nanomer transaction and the cheques: are connection<br \/>\ntraneaction. He reiied on the evioencepof A\u00e9wgt&#8217; ..ir:eii&#8217;ia:cused ends&#8217;<br \/>\npointed out that, the accused atcimitsr-the.&#8217;rnon*ey due to~&#8211;thevv:\u00a7respondent.<br \/>\nbut admits to the extent of Rs.2 .Wnett&#8217;Vthe.:trensaction is admitted<br \/>\nand nothing contrefyto the     court and the tower<br \/>\nappeiiate court   iieiriiciieince have concurrentiy<br \/>\nfound in fa;v.ou,r_ettheiicornpiieinetrt eubrnitteci that. being the<\/p>\n<p>concurreni:_ \ufb01nciinn. it does .noi\u00a7au for interference.<\/p>\n<p>7, _The&#8221;&#8216;cese  the &#8216;compiainent is that. in connection with<\/p>\n<p> &#8216;~ ptrrchtt\u00e9ie ofrunningh &#8216;concern. the amount was paid and when it was not<\/p>\n<p>V.*..meterieiized;~ttheicheoues were issued. Though the defence is taken<\/p>\n<p>that hitwae refrjunfning concern of the partnership fine. however. except<\/p>\n<p>{the st.e&#8217;teni&#8217;ent&#8217;ot Manager of the State Bani: of indie. no documents are<\/p>\n<p>it it &#8221; prociucedto show that the business run by the petitioner is a partnership<\/p>\n<p>nothing prevented the petitioner to produce documents to prove the<\/p>\n<p>i  &#8221; seine. if petitioner takes a defence that, it is a partnership \ufb01rm. it was<\/p>\n<p>i &#8221; unto him to prove the same. Apart trom this. the other defence taken by<\/p>\n<p>the petitioner is that. there was a reai estate business. In this regarct. he<\/p>\n<p>had examined DW&#8212;-3. but his evidence does not prove the case of the<br \/>\npetitioner. The cheques are concerned. they are issued  the<\/p>\n<p>petitioner and the account also shows that the petitioner <\/p>\n<p>holder and further. though the signature on  arid  <\/p>\n<p>memorandum of understanding is denied.:vhe\u00a3 it &#8216;dieoiosos eftei&#8217; the &#8216;<\/p>\n<p>cheques were issued, the petitioner has eh&#8217;t~:-2r\u00e9dV_into the memoir-afndum.u<\/p>\n<p>of undertaking agreeing to pay the azhoeint n&#8217;\u00a3&#8217;entioned&#8221;_;iri&#8221;%hebheque.&#8221; &#8216;<\/p>\n<p>The evidence produced by th*e..&#8217;respondehiioieaily eetaizriiehes that. the<br \/>\ncheques were issued in conheoiioniivsiihiia  and this is aiso<br \/>\nsupported by other.&#8217; m;ate_ria!   reieoondent. When the<br \/>\ncheques have hash  !he&#8211;..i&#8217;ni\u00a3iai Voieeumption under Section<br \/>\n139 of N.I,Ao.t, efi~ses&#8221;:&#8217;eepor:\u00a7&#8217;dent. To dietodge the said.<br \/>\npresumptioh. theie~eom.e*materia! to support the case of the<\/p>\n<p>petitioner.
