Heard the learned counsel appearing for the appellant as well as the<br \/>\nlearned counsel for the respondent Nos.1 to 4 and the notice to R5 is dispensed<br \/>\nwith as he remained ex-parte before the Tribunal.\n<\/p>\n<p>\t3. The Tribunal vide Judgement dated 08.09.2006 awarded compensation to a<br \/>\ntune of Rs.7,46,000\/- (Rupees seven lakhs and forty thousand only) on the<br \/>\nfollowing sub-heads:\n<\/p>\n<p>\tFor loss of income\t\t&#8211;\tRs.6,48,000\/-\n<\/p>\n<p>\tFor loss of consortium<br \/>\n\t(first petitioner wife)\t\t&#8211;\tRs.  50,000\/-\n<\/p>\n<p>\tFor loss of love and affection<br \/>\n\t(first petitioner wife)\t\t&#8211;\tRs.  20,000\/-\n<\/p>\n<p>\tFor loss of love and affection<br \/>\n\t(petitioners 2 and 3)\t\t&#8211;\tRs.  20,000\/-\n<\/p>\n<p>\tFor loss of love and affection<br \/>\n\t(petitioner No.4)\t\t&#8211;\tRs.   5,000\/-\n<\/p>\n<p>     For funeral expenses\t\t&#8211;\tRs.   3,000\/-\n<\/p>\n<p>\t\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t\t\t\tTotal\t&#8211;\tRs.7,46,000\/-\n<\/p>\n<p>\t\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>\t4. The gist and kernel of the grounds of appeal would run thus:<br \/>\n\tThe Tribunal in page No.9 of its Judgment erroneously calculated some<br \/>\nmethod and arrived at the monthly earning of the deceased at Rs.4,500\/- (Rupees<br \/>\nfour thousand and five hundred only); the multiplier 18 chosen by the Tribunal<br \/>\nis wrong; even under the other sub heads loss of consortium, awarding a sum of<br \/>\nRs.50,000\/- (Rupees fifty thousand only) was on the higher side and accordingly<br \/>\nthe learned counsel for the appellant Insurance Company prays for modification<br \/>\nof the quantum of the award.\n<\/p>\n<p>\t5. The point for consideration is as to whether the Tribunal arrived at<br \/>\n&#8216;just compensation&#8217;?\n<\/p>\n<p>6. On point:\n<\/p>\n<p>\tThe learned counsel for the appellant Insurance Company by placing<br \/>\nreliance on the grounds of appeal would develop his arguments to the effect that<br \/>\nthe monthly income of the deceased could at the most be taken Rs.3000\/- (Rupees<br \/>\nthree thousand only) and out of that one third (1\/3) has to be deducted and the<br \/>\nmonthly dependency should be arrived at Rs.2000\/- (Rupees two thousand only) and<br \/>\nthat too the learned counsel for the appellant Insurance Company would focus his<br \/>\narguments on the point that before the Tribunal there was no authentic salary<br \/>\ncertificate to show that what was the actual income of the deceased and mere<br \/>\nmarking of salary certificate allegedly issued by the Managing Director of the<br \/>\nP.R.P. Granites, Melur cannot be taken as sufficient evidence.\n<\/p>\n<p>\t7. By way of torpedoing the arguments of the learned counsel for the<br \/>\nappellant Insurance Company, the learned counsel for the respondent Nos.1 to 4\/<br \/>\nclaimants would develop his arguments to the effect that before the Tribunal<br \/>\nEx.P7, the salary certificate was marked and it demonstrated that the deceased<br \/>\nwas earning a sum of Rs.6000\/- (Rupees six thousand only) per month.  Such fact<br \/>\nis in commensurate with the present trend of salary being obtained by persons<br \/>\nlike the deceased.  No doubt, mere marking of the salary certificate would not<br \/>\namount to proof.  However, the Tribunal held that as on the date of his death,<br \/>\nit could be taken that he was earning a sum of Rs.3000\/- (Rupees three thousand<br \/>\nonly) per month, the supervisor working in a granite industry would have earned<br \/>\na sum of Rs.3000\/- (Rupees three thousand only) per month and there need not be<br \/>\nany further dilation on that.  However, the future prospects should be taken<br \/>\ninto account.\n<\/p>\n<p>\t8. According to the learned counsel for the appellant Insurance Company,<br \/>\nthe Post Mortem Certificate would reveal that the deceased was 31 years old at<br \/>\nthe time of his death, but the Tribunal took it as 28.  Even upholding that he<br \/>\ndied at the age of 31 as revealed by the Post Mortem Certificate, he had long<br \/>\nnumber of years to work and support his family and hence, in such a case to some<br \/>\nextent subject to uncertainties of future, his monthly income could be taken as<br \/>\nRs.4000\/- (Rupees four thousand only) and that would meet the ends of justice.<br \/>\nOut of that one third (1\/3) has to be deducted on a flat rate basis irrespective<br \/>\nof the fact whether the deceased lead the life of a bohemian or that of a<br \/>\nsparten.  Taking a cue from the second schedule appended to the Motor Vehicles<br \/>\nAct, the multiplier 17 could be chosen as the deceased died at the age of 31.<br \/>\nHence, the compensation  under the head &#8216;loss of income&#8217; is re-fixed and arrived<br \/>\nat Rs.5,44,000\/-  [Rs.4000 X 12 X 17 X 2\/3= Rs.5,44,000\/-] (Rupees five Lakhs<br \/>\nand forty four Thousand only).\n<\/p>\n<p>\t9. Under the caption loss of consortium a sum of Rs.50,000\/- (Rupees fifty<br \/>\nthousand only) was awarded; taking into account the young age of the widow; even<br \/>\nthen it is non-pecuniary damage and at a flat rate a sum of Rs.20,000\/- (Rupees<br \/>\ntwenty thousand only) could be awarded and that would serve the purpose and it<br \/>\nis done so normally in other cases.\n<\/p>\n<p>\t10. Towards loss of love and affection for each minor children Rs.10,000\/-<br \/>\n(Rupees ten thousand only) could be awarded and towards father a sum of<br \/>\nRs.5000\/- (Rupees five thousand only) could be awarded and as such under that<br \/>\ncaption broadly Rs.25,000\/- (Rupees twenty five thousand only) could be awarded.\n<\/p>\n<p>\t11. Towards funeral expenses a sum of Rs.3,000\/- (Rupees three thousand<br \/>\nonly) was awarded is the appropriate compensation and for transport expenses<br \/>\nRs.2000\/- (Rupees two thousand only) would be sufficient.  Accordingly, the<br \/>\ncompensation is modified as under:\n<\/p>\n<p>\tFor loss of income\t&#8211;\tRs.5,44,000\/-\n<\/p>\n<p>\tFor loss of consortium<br \/>\n\t(first petitioner wife)\t&#8211;\tRs.  20,000\/-\n<\/p>\n<p>\tFor loss of love and<br \/>\n\taffection\t\t&#8211;\tRs.  25,000\/-\n<\/p>\n<p>     For funeral expenses\t&#8211;\tRs.   3,000\/-\n<\/p>\n<p>\tFor transport expenses \t&#8211;\tRs.   2,000\/-\n<\/p>\n<blockquote><p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-<br \/>\n\t\t\tTotal\t&#8211;\tRs.5,94,000\/-\n<\/p><\/blockquote>\n<p>\t\t\t\t\t&#8212;&#8212;&#8212;&#8212;-\t<\/p>\n<p>\t12. In the result, this Civil Miscellaneous Appeal is partly allowed and<br \/>\nthe award of the Tribunal is reduced from Rs.7,46,000\/- (Rupees seven lakhs and<br \/>\nforty thousand only) to Rs.5,94,000\/- (Rupees five lakhs and ninety four<br \/>\nthousand only), which shall carry interest at the rate of 7.5%. Proportionately<br \/>\nthere will be variation in the allotments to each of the claimants depending<br \/>\nupon the variation in the total compensation awarded herein.
