Justice K.SURENDRA MOHAN\n\n Dated :23\/02\/2010\n\n O R D E R\n                 K.SURENDRA MOHAN, J.\n             -------------------------------------------\n                 W.P.(C) No.5744 of 2010\n             -------------------------------------------\n        Dated this the 23rd day of February, 2010\n\n                          JUDGMENT\n<\/pre>\n<p>     The petitioner has approached this Court challenging<\/p>\n<p>Ext.P4 order of the State Transport Appellate Tribunal in<\/p>\n<p>MVARP No.167\/2009.\n<\/p>\n<p>     2. The petitioner had sought variation of his timings<\/p>\n<p>in respect of stage carriage vehicle No.KL-8\/AG 4921<\/p>\n<p>conducting services on the route Guruvayur-Thrissur.<\/p>\n<p>According to the petitioner, at the time of settling the<\/p>\n<p>timings of his service, there was a wrong representation by<\/p>\n<p>the operator of stage carriage vehicle bearing Reg.No.KL-<\/p>\n<p>8\/U 787. Relying on the said wrong representation, a set of<\/p>\n<p>timings were issued by the second respondent fixing his<\/p>\n<p>departure time as 8.38 p.m. from Thrissur. Subsequently,<\/p>\n<p>the petitioner came to know that the other operator had<\/p>\n<p>made a false representation and had stated his departure<\/p>\n<p>timings wrongly. Therefore, he submitted a request for the<\/p>\n<p>variation of his timings. The request was considered by the<\/p>\n<p>second respondent and rejected by Ext.P2 order.<\/p>\n<p><span class=\"hidden_text\">wpc No.5744\/2010           2<\/span><\/p>\n<p>         3. The petitioner challenged Ext.P2 before the STAT.<\/p>\n<p>   However, the STAT also confirmed the order of the second<\/p>\n<p>   respondent.\n<\/p>\n<p>         4. According to the counsel for the petitioner, the<\/p>\n<p>   request of the petitioner was to correct a decision that was<\/p>\n<p>   taken relying on a false representation made by another<\/p>\n<p>   operator. Therefore, the same should not be considered to<\/p>\n<p>   be a request for variation of the petitioner&#8217;s timings.<\/p>\n<p>         5. The learned Government Pleader on the other hand<\/p>\n<p>   points out that the petitioner had not made out any of the<\/p>\n<p>   circumstances that were necessary for changing his<\/p>\n<p>   timings as required by Rule 145(7) of the Kerala Motor<\/p>\n<p>   Vehicles Rules.\n<\/p>\n<p>         6. I notice that the petitioner has not made the other<\/p>\n<p>   operator,    who   is   alleged   to  have    made   a   false<\/p>\n<p>   representation before the second respondent, a party to<\/p>\n<p>   this writ petition. The petitioner has also not produced<\/p>\n<p>   before this Court, the certified copy of the timings issued to<\/p>\n<p>   the other operator to substantiate his case that the said<\/p>\n<p>   person had represented his timings wrongly before the<\/p>\n<p>   second respondent.        Therefore, as matters stand at<\/p>\n<p><span class=\"hidden_text\">wpc No.5744\/2010           3<\/span><\/p>\n<p>   present, the petitioner is only making unsubstantiated<\/p>\n<p>   allegations against the other operator who is not made a<\/p>\n<p>   party hereto.     In the above circumstances, the only<\/p>\n<p>   conclusion possible is that the petitioner is making wild<\/p>\n<p>   allegations for the reason that the particular timings<\/p>\n<p>   sought for by him were not granted to him.<\/p>\n<p>         I do not find any grounds to interfere with the orders<\/p>\n<p>   under challenge.
