Commissioner\n                                           Lajpat Nagar, New Delhi - 110024\n\nRTI application filed on          :        28\/04\/2008\nPIO replied                       :        24\/06\/2008\nFirst appeal filed on             :        07\/08\/2008\nFirst Appellate Authority order   :        not replied.\nSecond Appeal filed on            :        01\/12\/2008\n\n<\/pre>\n<p>The appellant had asked in RTI application for earmarked, terms and conditions,<br \/>\ncontractor of the parking lots in Greater Kailash-I and Kailash Colony for public<br \/>\ncar parking.\n<\/p>\n<p>                            Detail of required information:-\n<\/p>\n<p> S. No.           Information Sought.                        The PIO replied.\n<\/p>\n<p>1.       Which are the areas earmarked in The sketch of the parking allotted by<br \/>\n         Greater Kailash -I and Kailash Colony MCD in G.K.-I and Kailash Colony<br \/>\n         for public car parking where one has are enclosed for perusal.<br \/>\n         to pay.\n<\/p>\n<p>2.       What are the terms and conditions Copy of the terms of condition for<br \/>\n         under which the parking lot has been parking are also enclosed for kind<br \/>\n         contracted out to individuals? A copy perusal.<br \/>\n         of the same may be provided.\n<\/p>\n<p>3.       Who should be approached for Addl. Deputy Commissioner (PPCell)<br \/>\n         complaints against the contractors of and Deputy Commissioner\/ Central<br \/>\n         the parking lots?                         Zone.\n<\/p>\n<p>The First Appellate Authority ordered: &#8211;\n<\/p>\n<p>Not replied.\n<\/p>\n<p> Relevant Facts emerging during Hearing:\n<\/p>\n<p>The following were present<br \/>\nAppellant: Mr. S. Gopal<br \/>\nRespondent: Mr. Krishen Kumar on behalf of Mr. S.K. Midha PIO<br \/>\nThe appellant was given the information very late. What is surprising is that a purported<br \/>\nagreement allotting the Parking lot in Kailash Colony market to Ashiana Security (P) Ltd.<br \/>\nhas no dates on the agreement which is supposedly for 5 years. There does not even<br \/>\nappear to be a proper signature of any recognizable person from MCD.<br \/>\nThe PIO has given this information also very late which raises a reasonable doubt about<br \/>\nthe intentions.\n<\/p>\n<p>The PIO will provide to the appellant a complete list of authorized Parking licencees as<br \/>\nwell a list of unauthorized parking licensees in Central Zone to the appellant.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The Appeal is allowed.\n<\/p>\n<p>The complete information will be sent to the appellant before 25 February, 2009.<br \/>\nThe issue before the Commission is of not supplying the complete, required<br \/>\ninformation by the PIO within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the PIO is guilty of not<br \/>\nfurnishing information within the time specified under sub-section (1) of Section 7 by not<br \/>\nreplying within 30 days, as per the requirement of the RTI Act. It appears that the PIO&#8217;s<br \/>\nactions attract the penal provisions of Section 20 (1) .<br \/>\nA showcause notice is being issued to him, and he is directed give his reasons to the<br \/>\nCommission to show cause why penalty should not be levied on him.\n<\/p>\n<p>He will give his written submissions showing cause why penalty should not be imposed<br \/>\non him as mandated under Section 20 (1) before 5 March, 2009.
