No. I-98\/2002 in which in one of the suburbs<br \/>\n\tof city of Ahmedabad righteous  mob committed murders killing<br \/>\n\tseveral people belonging to a particular community. Initially the<br \/>\n\tinvestigation into the said crime was carried out by local police.<br \/>\n\tSuch investigation however, was later on handed over to the Special<br \/>\n\tInvestigation Team (SIT for short) appointed by the Apex Court.<br \/>\n\tFurther investigation was undertaken. Statements of several<br \/>\n\twitnesses were recorded including further statements of witnesses<br \/>\n\twhose statements were already previously recorded by the police. In<br \/>\n\tfurther investigation, involvement of the petitioner was revealed.<br \/>\n\tWitnesses stated before the investigating agency having cited the<br \/>\n\tpetitioner as part as part of righteous mob. Essentially three<br \/>\n\twitnesses namely, Imtiaz Ahmedbhai Kureshi(PW-131) exh.546,<br \/>\n\tAbdulkadar Rasulmiya Malek(PW-65)exh.329 and Sadikhussen Nannumiya<br \/>\n\tMalek(PW-128) exh. 540, involved the petitioner in the alleged<br \/>\n\tincident. The petitioner was arrested on 13.9.2008. He had<br \/>\n\tpreviously moved the Sessions Court seeking regular bail. Such bail<br \/>\n\tapplication was turned down by the Sessions Court by order dated<br \/>\n\t29.12.2008. The petitioner has thereupon filed Criminal Misc.<br \/>\n\tApplication No.692\/2009 before this Court seeking bail. Such bail<br \/>\n\tapplication however, was dismissed as not pressed by order dated<br \/>\n\t13.11.2009. Thereafter, the petitioner has moved this fresh bail<br \/>\n\tapplication on various grounds including the ground that witnesses<br \/>\n\twho had involved the petitioner have now been examined before the<br \/>\n\tCourt, there is no question of tampering with evidence, that trial<br \/>\n\tis likely to take much longer time, all the other accused have been<br \/>\n\treleased on bail, petitioner is already in jail since nearly two<br \/>\n\tyears.\n<\/p>\n<p>Counsel<br \/>\n\tfor the petitioner drew my attention to the relevant portion of the<br \/>\n\tstatements of the witnesses recorded by the investigating agency<br \/>\n\tdescribing the role of the petitioner in the said offence. He also<br \/>\n\tdrew my attention to the deposition of these witnesses before the<br \/>\n\tCourt where reference to the petitioner has been made. From the<br \/>\n\tabove he submitted that petitioner who was already in jail since<br \/>\n\tmore than two years should be released on bail pending trial since<br \/>\n\ttrial is likely to take longer time for completion. He further<br \/>\n\tsubmitted that other accused who have been attributed roles much<br \/>\n\tmore serious than the petitioner have been released on bail by<br \/>\n\tdifferent Courts by different orders.\n<\/p>\n<p>Counsel<br \/>\n\tfor the petitioner opposed the bail application contending that the<br \/>\n\tpetitioner was part of unlawful assembly. He is not only identified<br \/>\n\tbefore the  Court by several witnesses, he has also been attributed<br \/>\n\tspecific role. It is further contended that this is a successive<br \/>\n\tbail application. In the previous round, petitioner has not pressed<br \/>\n\tthe application for bail.\n<\/p>\n<p>Having<br \/>\n\tthus heard learned advocates appearing for the parties and having<br \/>\n\tperused the material on record, I find that insofar as witnesses who<br \/>\n\thad involved the petitioner in statements before the police, have<br \/>\n\talready been examined by the prosecution before the trial Court.<br \/>\n\tWitness Imtiaz Ahmedbhai Kureshi(PW-131) exh.546 has stated before<br \/>\n\tthe Court that while he was in the camp at Shah-alam he had learnt<br \/>\n\tthat in house of Sattarbhai where shouts of help were heard, three<br \/>\n\tpersons had been burnt alive. He had further learnt that besides<br \/>\n\tothers, the present petitioner was also responsible for setting the<br \/>\n\thouse on fire. Witness Abdulkadar Rasulmiya Malek(PW-65)exh.329  has<br \/>\n\talso spotted the petitioner being part of the mob and throwing<br \/>\n\tstones. Witness Sadikhussen Nannumiya Malek(PW-128) exh. 540 in his<br \/>\n\tdeposition had also stated to have seen the petitioner as part of<br \/>\n\tthe mob. He had also attributed role to the petitioner of being<br \/>\n\tresponsible for setting the house of Sattarbhai  on fire where four<br \/>\n\tpeople were burnt alive.\n<\/p>\n<p>Though<br \/>\n\tit is true that the present application has been filed after once<br \/>\n\tprevious bail application was withdrawn, in facts of the present<br \/>\n\tcase, I am of the opinion that petitioner is required to be released<br \/>\n\ton bail. Firstly, previous bail application was withdrawn more than<br \/>\n\ta year back. Secondly, though it is stated that as many as 149<br \/>\n\twitnesses have already been examined before the trial Court and<br \/>\n\tfurther at-least 25 to 30 witnesses still remain to be examined, it<br \/>\n\tis therefore not possible to foresee within the near future trial<br \/>\n\tgetting completed. Thirdly, as pointed out by the counsel for the<br \/>\n\tpetitioner virtually all the accused in the said case have been<br \/>\n\tenlarged on bail by different Courts. Fourthly, the petitioner has<br \/>\n\tbeen in jail for nearly two years. Fifthly, witnesses who have<br \/>\n\tinvolved the petitioner, their deposition is already recorded before<br \/>\n\tthe Sessions Court. No possibility of tampering with evidence<br \/>\n\ttherefore, remains.\n<\/p>\n<p>In<br \/>\n\tthe result the petitioner is ordered to be released on bail in<br \/>\n\tconnection with C.R. No. I-98\/2002 on his furnishing bond of<br \/>\n\tRs.50,000\/-(Rupees Fifty Thousand only ) with one surety of like<br \/>\n\tamount to the satisfaction of the lower Court and subject to<br \/>\n\tfollowing conditions that he shall  :\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\tpresence before the Naroda Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm:\n<\/p>\n<p>not<br \/>\n\tleave the Ahmedabad District without prior permission of the<br \/>\n\tSessions  Judge concerned, till the trial is over;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
