Justice V.GIRI\n\n Dated :21\/11\/2007\n\n O R D E R\n                        V.GIRI,J.\n                  -------------------------\n             W.P ( C) No.34406 of 2007\n                 --------------------------\n        Dated this the 21st November, 2007\n\n                   J U D G M E N T\n<\/pre>\n<p>       Petitioners 1 to 6 are Field Workers, 7 to 10 are<\/p>\n<p>Peons and 11th petitioner is Electrician in the Health<\/p>\n<p>Services Department. As per the special rules relating to<\/p>\n<p>appointment to the post of Junior Health Inspector<\/p>\n<p>Grade II, petitioners are also eligible to be considered<\/p>\n<p>for promotion. They contend that ignoring the fact that<\/p>\n<p>they are qualified persons, Government is proposing to<\/p>\n<p>embark upon      direct recruitment. Apparently, on an<\/p>\n<p>earlier occasion, this Court had by Ext.P3 judgment<\/p>\n<p>directed the Government to consider the claim of<\/p>\n<p>similarly situated persons and further held that direct<\/p>\n<p>recruitment may be subject to such claims.<\/p>\n<p>      2.  Petitioners   contend      that  juniors to the<\/p>\n<p>petitioners have been promoted as Junior Health<\/p>\n<p>Inspectors Grade II pursuant to the directions issued by<\/p>\n<p>this Court. Petitioners have filed Exts.P4 to P14 before<\/p>\n<p>the Director of Health Services.<\/p>\n<p>  W.P ( C) No.34406 of 2007<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        3.
