\nMember, MACT, Dakshina Kannada, Manga1ore,’,partIy
\nallowing the claim petition for compensat;ionf”–\u00ab.a’nd

2. Heard. ‘.w.'[v”he appeal  and with the
\nconsent oft Clcunsel for the parties, it<\/p>\n

3. Briefgpfacts’df.the.__c’ase are:<\/p>\n
 ~ That   when the claimant was riding<\/p>\n
   bicycle  Parangipet to Maripalla side near<\/p>\n
 _  house at Parangipet on NH 48 a car<\/p>\n
bearing registration No. KA 01\/ GA 136 came in a rash<\/p>\n
 is and negligent manner and dashed against his bicycle,<\/p>\n
 asda result he fell down and sustained injuries. Hence,<\/p>\n
 he \ufb02ied a claim petition before MACT, Mangalore<\/p>\n
seeking compensation of Rs.3,00,000\/– and the
\n6?.\n<\/p>\n

Tribunal has awarded compensation of Rs.28,000\/—<\/p>\n
with interest at 6% p.a.<\/p>\n
4. As there is no dispute regarding occur’rer1_”ce”*.of<\/p>\n
accident, negligence and liability of the  <\/p>\n
offending vehicle the only point   florid’<\/p>\n
consideration is:\n<\/p>\n
Whether the cornp’en_sation’awardeti by

5. After hearing   appearing for
\nthe parties  and award of the
\n“cf  llx\u00e9iew-“Vthat the compensation
\nawarded  not just and reasonable, it
\nis on  therefore it is deserved to be<\/p>\n
H ”   certi\ufb01cate Ex. P 6 the claimant has<\/p>\n
sustained the following injuries.<\/p>\n
N1) Swelling (L) thigh, (L) calf with
\nFracture hip bone [inferior Ramus}<\/p>\n
ii] Pain abdomen.\n<\/p>\n
The injury No.1 is described as grievous in nature.<\/p>\n

Injuries sustained by him are also evident from
\ndischarge summary Ex. P 7, case sheet Ex. P 22 and<\/p>\n
supported by oral evidence of the claimant van\u00a5d’\u00bba.the<\/p>\n
doctor examined as PWS 1 and 2 <\/p>\n
Bischarge summary Ex. P 7 shows he ‘adlrnittedll <\/p>\n

doctor has not stated anyth_ing..about theidisability.<\/p>\n
7. Considering the   Rs.l5,000\/–
\nawarded by”   and suffering is

 The Tribunal has awarded only<\/p>\n

 9. Considering the year of accident, age of the<\/p>\n
claimant and his occupation the income assessed by<\/p>\n
\ufb01g<\/p>\n
the Tribunal at Rs.3,000\/– p.m. is just and proper.
\nNature of injuries suggests that he must have been<\/p>\n
under treatment and rest at ieast for a period v(V.)il’7’_th.I.’\u20ac\u20ac<\/p>\n

Rs.28,000\/~ awarded by the Tribunal with  _<\/p>\n
6% p.a. on the enhanced compepnVsation”of–‘\u00bb <\/p>\n
