Tileshwar Singh\n\n                                          Versus\n                                      STATE OF BIHAR\n                                          ------\n<\/pre>\n<p>2\/      28.01.2011                 Heard learned counsel for the petitioners and learned<\/p>\n<p>                     counsel for the State.\n<\/p>\n<p>                                   Petitioners are alleged for harvesting crop from<\/p>\n<p>                     complainant&#8217;s field is claimed by petitioners about their possession<\/p>\n<p>                     basing an agreement to sell. Submission is that to enforce the<\/p>\n<p>                     agreement, Title Suit No. 44 of 2009 is filed and pending, on the<\/p>\n<p>                     other hand criminal case is filed on behalf of the complainant<\/p>\n<p>                     challenging agreement to sell as forged document. In any case, there<\/p>\n<p>                     is claim and counter claim in between the parties.<\/p>\n<p>                                   Considering the facts and circumstances of the case, the<\/p>\n<p>                     prayer of the petitioners is allowed.\n<\/p>\n<p>                                   In the event of arrest or surrender within one month<\/p>\n<p>                     from the date of receipt\/production of a copy of this order in<\/p>\n<p>                     connection with Complaint Case No. 366 of 2010 (Tr. No. 1757 of<\/p>\n<p>                     2010) above named petitioners shall be released on bail on<\/p>\n<p>                     furnishing bail bond of Rs. 10,000\/- (ten thousand) each with two<\/p>\n<p>                     sureties of the like amount each to the satisfaction of J.M., Ist Class,<\/p>\n<p>                     Bhabhua subject to the conditions as laid down under Section 438(2)<\/p>\n<p>                     of Cr.
