KUMAR, J.\n<\/pre>\n<p>             The prayer made in the instant petition is for issuance of<\/p>\n<p>direction to the respondents to issue transfer letter in respect of Plot<\/p>\n<p>No. 1019, Sector 7 (UE) Part-II, Kurukshetra, in favour of petitioner<\/p>\n<p>No. 2. A further prayer has also been made for issuance of direction<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 10326 of 2007                                            2<\/span><\/p>\n<p>to respondent Nos. 1 to 3 to initiate appropriate legal as well as<\/p>\n<p>disciplinary action against respondent Nos. 4 and 5.<\/p>\n<p>2.           The allegations made in the instant petition are that<\/p>\n<p>petitioner No. 2 was asked to pay bribery of Rs. 2,000\/- by<\/p>\n<p>respondent Nos. 4 and 5 in order to enable her to obtain a copy of the<\/p>\n<p>transfer letter in respect of the aforementioned plot and when she<\/p>\n<p>refused to succumb to the pressure then different transfer letter<\/p>\n<p>demanding extension fee of Rs. 11,340\/- was issued. In that regard<\/p>\n<p>reliance has also been placed on the findings recorded by the<\/p>\n<p>Additional Deputy Commissioner, Kurukshetra on the complaint filed<\/p>\n<p>by the petitioners, in his order dated 21.2.2007 (P-4). The allegation<\/p>\n<p>leveled is that the Additional Deputy Commissioner never<\/p>\n<p>incorporated the last line in the order concluding that the allegation of<\/p>\n<p>bribery of Rs. 2,000\/- against respondent Nos. 4 and 5 have not been<\/p>\n<p>proved. Reliance has also been placed on the forwarding letter sent<\/p>\n<p>by the Deputy Commissioner, Kurukshetra, dated 26.2.2007 (P-5),<\/p>\n<p>which does not, in fact, in terms conclude that respondent Nos. 4 and<\/p>\n<p>5 have been indicted for taking bribery of Rs. 2,000\/-.<\/p>\n<p>3.           The stand of the respondents in their separate written<\/p>\n<p>statement is that in fact the petitioners have forged the transfer letter<\/p>\n<p>dated 11.10.2006 because they have deleted the amount of extension<\/p>\n<p>fee, which was mentioned in clause 9(e) of the letter as well as<\/p>\n<p>removed the tick marks which were put on condition Nos. 1, 2, 3 and<\/p>\n<p>9.<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 10326 of 2007                                             3<\/span><\/p>\n<p>4.           The petitioners have already set the machinery of<\/p>\n<p>criminal justice in motion against respondent Nos. 4 and 5 by filing a<\/p>\n<p>complaint before the Illaqua Magistrate, Kurukshetra, under Sections<\/p>\n<p>166, 167, 409, 420, 217, 218, 500, 506, 499, 120-B IPC and Section<\/p>\n<p>7, 12 and 13 of the Prevention of Corruption Act, 1988. Likewise,<\/p>\n<p>respondent No. 4 has also filed a complaint dated 8.10.2007 (R-3)<\/p>\n<p>against both the petitioners and two others, in the Court of Chief<\/p>\n<p>Judicial Magistrate, Kurukshetra.        The matter with regard to<\/p>\n<p>allegations and counter allegations is already sub judice before the<\/p>\n<p>regular Court of law, which shall be decided in due course of time.<\/p>\n<p>5.           The only issue which remains to be examined by this<\/p>\n<p>Court is whether the petitioners are entitled to issuance of transfer<\/p>\n<p>letter in respect of Plot No. 1019, Sector 7, Part-II, Kurukshetra,<\/p>\n<p>which is to be issued in favour of petitioner No. 2. The stand of the<\/p>\n<p>respondents in that regard is that already such a letter has been issued<\/p>\n<p>on 11.10.2006 (R-2) and a copy of the postal information, dated<\/p>\n<p>12.2.2007, has also been attached as Annexure R-1, showing that<\/p>\n<p>Surinder Vaid son of Shri Som Nath (petitioner No. 1) was delivered<\/p>\n<p>the aforementioned letter in original.      The subject of letter dated<\/p>\n<p>11.10.2006    (R-2)   is   &#8216;Provisionally    Transfer   permission       of<\/p>\n<p>Residential\/Commercial Plot No. 1019, Sector 7, Urban Estate,<\/p>\n<p>Kurukshetra through GPA Sh. Anil Kumar S\/o Sh. Rajpal H. No.<\/p>\n<p>111-A, Model Town, Karnal&#8217;. Transfer of plot in question has been<\/p>\n<p>made provisionally in favour of petitioner No. 2 subject to fulfillment<\/p>\n<p>of various conditions. Mr. Ajay Kansal, learned counsel for the<br \/>\n<span class=\"hidden_text\"> C.W.P. No. 10326 of 2007                                           4<\/span><\/p>\n<p>respondents has also handed over another attested photocopy of the<\/p>\n<p>letter dated 11.10.2006 (R-2) to the learned counsel for the petitioners<\/p>\n<p>and stated that for all intents and purposes it should be considered as<\/p>\n<p>a copy of the provisional transfer permission. The aforementioned<\/p>\n<p>controversy also comes to an end.\n<\/p>\n<p>6.           In view of the statement made by the respondents<\/p>\n<p>through Mr. Ajay Kansal, it is for the petitioners now to take further<\/p>\n<p>steps. The period of 90 days will commence not from the date of<\/p>\n<p>communication of letter on 11.10.2006 but from today, which would<\/p>\n<p>be subject to any further charges in accordance with law.<\/p>\n<p>7.
