Shri Dave for the petitioner<br \/>\n\tvehemently submitted that the award passed, whereupon, the recovery<br \/>\n\tcertificate is issued is absolutely contrary to law and therefore,<br \/>\n\tthe impugned notice in this proceeding deserves to be quashed and<br \/>\n\tset aside. Shri Dave has submitted that as the petitioner has<br \/>\n\talready filed proceedings for ex-parte order and award whereupon the<br \/>\n\trecovery certificate is based, the notice issued by Mamlatdar, Alian<br \/>\n\tRecovery impugned in this petition deserves to be quashed and set<br \/>\n\taside. In the award, no findings are recorded with regard to<br \/>\n\tgranting for back wages and therefore, that ex-parte award is bad in<br \/>\n\tlaw and therefore, it could not have been executable. Shri Dave<br \/>\n\trelies upon the decision of Madras High Court in case of  M.S.N.S.<br \/>\n\tTRANSPORTS, TIRUCHIRAPPALLI VS. RAJARAM (K.) AND ANOTHER,<br \/>\n\treported in 1961 (1) LLJ p.336 in support of his submission that in<br \/>\n\tsuch a case, the application for payment of wages would not be<br \/>\n\tmaintainable and recovery application would be maintainable and<br \/>\n\ttherefore, the notice issued by respondent No. 2 is required to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p>Following<br \/>\n\tundisputed facts as submitted by learned counsel for the petitioner<br \/>\n\tdeserve to be set out as under:\n<\/p>\n<p>The<br \/>\n\temployee had been allegedly terminated on 18.5.2004.\n<\/p>\n<p>The<br \/>\n\tIndustrial Dispute was raised and referred to the concerned Labour<br \/>\n\tCourt for adjudication, which came to be numbered as Reference LCA<br \/>\n\t1379 of 2004 and the same was decided ex-parte on 20.9.2006. As for<br \/>\n\tthe reasons recorded in restoration application pending before the<br \/>\n\tCompetent Authority, the petitioner was prevented from even filing<br \/>\n\twritten statement resisting the Reference.\n<\/p>\n<p>The<br \/>\n\tex-parte award is dated 20.9.2006.\n<\/p>\n<p>The<br \/>\n\tpayment of wages application was allowed ex-parte on 10.8.2007.\n<\/p>\n<p>Shri<br \/>\n\tDave fairly submitted that the respondent workman in fact approached<br \/>\n\tthis Court by preferring Special Civil Application No. 8366 of 2008<br \/>\n\tfor realizing the dues and implementation of the award. In that<br \/>\n\tproceedings, the present petitioner was represented by an advocate,<br \/>\n\twherein, this Court (Coram: S.R.Brahmbhatt, J.) passed the following<br \/>\n\torder on 15.9.2008:\n<\/p>\n<p>Rule.\n<\/p>\n<p>\tMs. Pathak, learned AGP waives service of Rule for respondent No. 1.<br \/>\n\tNo one appear for respondent No. 2.\n<\/p>\n<p>The<br \/>\n\tpetitioner has approached this Court under Article 226 of the<br \/>\n\tConstitution of India seeking appropriate writ of mandamus or any<br \/>\n\tother writ, order or direction to respondent No. 1 for implementing<br \/>\n\tand effecting the recovery certificate dated 28.9.2007 for<br \/>\n\trecovering of the sum mentioned thereunder.\n<\/p>\n<p>Ms.\n<\/p>\n<p>\tPathak, learned AGP submitted that certificate is required to be<br \/>\n\teffected and hence some time be stipulated so that the same could be<br \/>\n\teffected.\n<\/p>\n<p>In<br \/>\n\tview of this, this petition is disposed of with following direction<br \/>\n\t:\n<\/p>\n<p>The<br \/>\n\trespondent No. 1 is hereby directed to have the recovery certificate<br \/>\n\timplemented and recovered the amount mentioned thereunder in<br \/>\n\taccordance with law within a period of 90 days from the receipt of<br \/>\n\tthe process of writ of this Court.\n<\/p>\n<p>With<br \/>\n\taforesaid direction, the petition is disposed of. Rule is made<br \/>\n\tabsolute to the aforesaid extent. There shall be no order as to<br \/>\n\tcosts.\n<\/p>\n<p>It<br \/>\n\tdeserves to be noted that during pendency of the said application,<br \/>\n\tCivil Application No. 10551 of 2008 had also been filed making<br \/>\n\tprayer for removal of the attachment and seals, which was sought to<br \/>\n\tbe withdrawn and the permission was granted by this Court on<br \/>\n\t9.9.2008. The said order is produced at Pg. 44 of the petition.\n<\/p>\n<p>Shri<br \/>\n\tDave has submitted that restoration proceedings being Misc. Civil<br \/>\n\tApplication Nos. 226 of 2008 and 252 of 2008 are pending.\n<\/p>\n<p>Shri<br \/>\n\tDave submits that the petitioner is not likely to run away as lot of<br \/>\n\timmovable properties available for attachment and therefore some<br \/>\n\tindulgence be granted. Shri Dave also submit that the petitioner is<br \/>\n\tfacing great hardship.\n<\/p>\n<p>This<br \/>\n\tCourt has heard learned counsel for the petitioner at length. The<br \/>\n\tvery prayer in this petition indicates that the petition is confined<br \/>\n\tto validity of the notice issued by respondent No. 2 and there is no<br \/>\n\tsubmission whatsoever with regard to authority and\/or jurisdiction<br \/>\n\tfor issuance of such notice. The submission made at length with<br \/>\n\tregard to serious infirmities in ex-parte award and based upon<br \/>\n\twhich, recovery certificate has been issued cannot be examined in<br \/>\n\tabsence of any prayer made in the petition. It also deserves to be<br \/>\n\tnoted that in light of the pendency of the restoration proceedings<br \/>\n\tbefore the Competent Court, a question arises as to whether would it<br \/>\n\tbe proper for this Court to examine the contention raised with<br \/>\n\tregard to validity or propriety of the ex-parte award. The answer<br \/>\n\twould be emphatic  NO . The<br \/>\n\trespondent No. 2 has rightly issued the notice and as there is no<br \/>\n\tchallenge to that notice with regard to its jurisdiction and\/or<br \/>\n\tcompetence, the other grounds raised with regard to validity and<br \/>\n\tpropriety of ex-parte award cannot be taken aid to assail the<br \/>\n\trecovery notice.\n<\/p>\n<p>\tThe<br \/>\n\tjudgment cited at bar by the petitioner would not have applicability<br \/>\n\tin view of the aforesaid facts, as this Court is not examining the<br \/>\n\tvalidity and\/or propriety of the ex-parte award as substantive<br \/>\n\tproceedings for quashing them aside have been preferred.\n<\/p>\n<p>\tIn<br \/>\n\tview of this, the petition being bereft of merits, deserves<br \/>\n\trejection and is accordingly rejected.
