(2) 173\n 1990 SCC  Supl.  709\t  JT 1989 (4)\t315\n 1989 SCALE  (2)1126\n\n\nACT:\n    Constitution of India, 1950: Article 32--Public interest\nlitigation--School     admission     for     children\t  of\nprostitutes--Plea for separate schools and  hostels--Reject-\ned--Committee set up to examine all aspects of the  problems\nand to submit report.\n\n\n\nHEADNOTE:\n    This writ petition has been filed pleading for  separate\nschools and hostels for the children of prostitutes.\n    On\tbehalf of respondents, it was contended\t that  since\nthey  are in fact unwanted children of prostitutes it is  in\nthe interest of such children and the society at large\tthat\nthey  are  segregated from their mothers and be\t allowed  to\nmingle with others and become part of the society.\n    Setting  up a Committee consisting of 4 Advocates and  3\nSocial Workers to look into the matter and directing listing\nof  the\t matter on receipt of the Committee's  report,\tthis\nCourt.\n    HELD: 1. Children of prostitutes should not be permitted\nto  live  in  inferno and the  undesirable  surroundings  of\nprostitute  homes. This is particularly so for\tyoung  girls\nwhose body and mind are likely to be abused with growing age\nfor  being  admitted into the profession of  their  mothers.\nWhile  separate schools and hostels for prostitute  children\nare not desirable, accommodation in hostels and other refor-\nmatory\thomes  should be adequately made available  to\thelp\nsegregation  of these children from their mothers living  in\nprostitute  homes  as soon as they  are\t identified.  [174H;\n175A-B]\n    2. The Committee now set up will look into the  problems\nand submit its report within 8 weeks. Pillai for the Respondents.\n<\/p>\n<p>The Order of the Court was delivered by<br \/>\n    MISRA, J. This application under Art. 32 of the  Consti-<br \/>\ntution is at the instance of an advocate by way of a  public<br \/>\ninterest litigation asking for direction to the\t respondents<br \/>\nfor  making  provision of separate schools  with  vocational<br \/>\ntraining  facilities  and separate hostels for\tchildren  of<br \/>\nprostitutes.  Notice  was issued not only  to  the  original<br \/>\nrespondents but at the instance of the Court also to a11 the<br \/>\nStates and the Union Territories. Many of them have respond-<br \/>\ned  and affidavits have been filed by way of return  to\t the<br \/>\nrule nisi.\n<\/p>\n<p>    Though  Mr. Mahajan for the petitioner has pleaded\tthat<br \/>\nseparate  schools and hostels be raised for the children  of<br \/>\nthe  prostitutes, we are not inclined to accept the  submis-<br \/>\nsion.  Segregating prostitute children by locating  separate<br \/>\nschools\t and  providing separate hostels,  in  our  opinion,<br \/>\nwould  not be in the interest of such children. It  is\tsaid<br \/>\nthat prostitutes do not want to have children and ordinarily<br \/>\nwhen children are born to them it is inspite of their desire<br \/>\nnot  to\t rear children. But once such children are  born  to<br \/>\nthem, it is in the interest of such children and of  society<br \/>\nat  large that the children of prostitutes should be  segre-<br \/>\ngated  from  their  mothers and be allowed  to\tmingle\twith<br \/>\nothers\tand  become part of the society.  In  fact,  counsel<br \/>\nappearing for several States have stated at the Bar the same<br \/>\nway. We, therefore, reject the prayer for locating  separate<br \/>\nschools and hostels for children of the prostitutes.<br \/>\n    Children of prostitutes should, however, not be  permit-<br \/>\nted  to live in inferno and the undesirable surroundings  of<br \/>\nprostitute homes. This<br \/>\n<span class=\"hidden_text\">175<\/span><br \/>\nis  particularly so for young girls whose body and mind\t are<br \/>\nlikely to be abused with growing age for being admitted into<br \/>\nthe profession of their mothers. While we do not accept\t the<br \/>\nplea  for  separate hostels for prostitute  children  it  is<br \/>\nnecessary that accommodation in hostels and other reformato-<br \/>\nry homes should be adequately available to help\t segregation<br \/>\nof  these children from their mothers living  in  prostitute<br \/>\nhomes as soon as they are identified.\n<\/p>\n<p>    Legislation\t has been brought to  control  prostitution.<br \/>\nProstitution has, however, been on the increase and what was<br \/>\nonce restricted to certain areas of human habitation has now<br \/>\nspread into several localities. The problem has,  therefore,<br \/>\nbecome\tone of serious nature and requires considerable\t and<br \/>\neffective attention.\n<\/p>\n<p>    We\tare  of the view that instead of disposing  of\tthis<br \/>\nwrit  petition with a set of directions, a Committee  should<br \/>\nbe constituted to examine the material aspects of the  prob-<br \/>\nlem  and submit a report containing recommendations  to\t the<br \/>\nCourt  on the basis of which further orders can be made.  We<br \/>\naccordingly  direct that a Committee for such purpose  shall<br \/>\nbe  set\t up  and it shall examine the  matter  from  various<br \/>\nangles of the problem taking into consideration the  differ-<br \/>\nent laws relevant to the matter and place its report  before<br \/>\nthe  Court within eight weeks from now.
