(J)\n\nCITATION:\n 1986 AIR 1923\t\t  1986 SCR  (1) 585\n 1986 SCC  (2) 293\t  1986 SCALE  (1)326\n\n\nACT:\n     Justice in Public Interest - Power of the Supreme Court\nto issue  directions or\t orders -  Out-of-turn allotment  of\nMaruti Cars  out of manufacturer's discretionary quota of 5%\nto  several   categories  like\t defence,  VIPs,   judiciary\nincluding lawyers  etc. - Whether the method adopted, namely\n(a) for the promotion of commercial interest of the company;\n(b) for\t the promotion of public interest; and (c) avoidance\nof undue  individual hardships\tetc. violative of Article 14\nof the\tConstitution  and  arbitrary  -\t Guidelines  by\t the\nSupreme Court.\n\n\n\nHEADNOTE:\n     The petitioner  applied for  allotment of\t\"Maruti\t Car\n800\" and  due to  an error  of the computer his name was not\nincluded for  the allotment  of \"Maruti 800\" but for \"Maruti\nTruck\". When  the petitioer  pointed out the discrepency the\nerror was accepted by the respondents who however, agreed to\nconsider the case of the petitioner for allotment out of the\nmanufacturers' discretionary  quota of\t5%. Accordingly, the\npetitioner was\talloted Serial\tNo.8 under the discretionary\nquota. In  the course  of certain correspondence that ensued\nbetween the  petitioner and  the respondent, the respondents\nindicated the  usual guidelines\t adopted in the allotment of\nthe car\t out of\t the manufacturers'  discretionary quota  to\ndefence forces,\t judiciary, Constitutional  heads, MPs\tetc.\nThe petitioner\thas  challenged\t such  a  classification  as\narbitrary and  violative of the provisions of the Article 14\nof the Constitution.\n     Disposing of the petitions,\n^\n     HELD :  The interest  of justice  would be\t met, if the\nallotment  of\tMaruti\tvehicles   out\t of   manufacturers'\ndiscretionary  quota   is  made\t  in  favour  of  the  named\ncategories specified  in the  order and\t subject  to  strict\nobservance of the conditions indicated therein. [586 E-F]\n586\n     (The Court\t ordered that  the guidelines  would  be  in\nforce for  a period  of three  years and  will be subject to\nreview\tlater\ttaking\tinto  consideration  the  prevailing\ncircumstances  which  may  exist  at  that  point  of  time.\nApplying non-liquet for the present, the Court left open the\nseveral contentions raised in the petitions.)\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     ORIGINAL JURISDICTION  : Writ  Petition (Civil) No. 588<br \/>\nand 11716 of 1984.\n<\/p>\n<p>     Under Article 32 of the Constitution of India.<br \/>\n     Soli J. Chari for the Respondents.\n<\/p>\n<p>     The Order of the Court was delivered by<br \/>\n     TULZAPURKAR, J. We have heard Mr. Soli J. Sorabjee, Mr.<br \/>\nPrashant Bhushan  and Mr. R. Karanjawala for the petitioners<br \/>\nand  the   learned  Attorney-General,\ton  behalf   of\t the<br \/>\nrespondents. Various  submissions were made on behalf of the<br \/>\nparties.  After\t consideration\tdiscussion  of\tthe  various<br \/>\nproposals and  suggestions made\t by parties and after having<br \/>\ngiven our anxious and deep consideration to the matter it is<br \/>\nordered that  in public\t interest the  following  guidelines<br \/>\nshould regulate\t the allotment of Maruti vehicles out of the<br \/>\nmanufacturers quota of 5 per cent.\n<\/p>\n<p>     The  allotment   of  Maruti   vehicles   out   of\t the<br \/>\nmanufacturers&#8217; quota of five per cent will be made in favour<br \/>\nof the following categories only:\n<\/p>\n<p>     I.\t Any   organisation\/institution\t coming\t within\t the<br \/>\ndefinition of  &#8216;State&#8217; under  Article 12 of the Constitution<br \/>\nof India.\n<\/p>\n<p>     II. Any  hospital or recognised charitable organisatior<br \/>\nor educational institutions registered or incorporated under<br \/>\na statute  or having  recognition under\t Section 80-G of the<br \/>\nIndian Income Tax Act, 1961.\n<\/p>\n<p><span class=\"hidden_text\">587<\/span><\/p>\n<p>     III. Individuals<br \/>\n     a. An individual suffering from physical handicap so as<br \/>\nto render  him incapable  of using public transport would be<br \/>\neligible for allotment provided his income together with the<br \/>\nincome of  his or her spouse or his or her guardian does not<br \/>\nexceed Rs. 60,000 per year.\n<\/p>\n<p>     b. The  President of  India, Vice-President  of  India,<br \/>\nCabinet Ministers,  Ministers of  State in the Union Cabinet<br \/>\nand Governors  of States  and  Cabinet\tMinisters  in  State<br \/>\nGovernments, the  Chairman of the Public Service Commission,<br \/>\nthe Chief Election Commissioner, the Auditor and Comptroller<br \/>\nGeneral of India and the Attorney General of India.\n<\/p>\n<p>     c. The Speaker and the Deputy Speaker of the Lok Sabha,<br \/>\nthe Chairman  and the  Deputy Chairman\tof the\tRajya Sabha,<br \/>\nSpeakers of  State Legislative\tAssemblies, Chairpersons  of<br \/>\nState  Legislative   Councils,\tand  Leaders  of  Opposition<br \/>\nparties in Parliament and in the State Legislatures.\n<\/p>\n<p>     d. The  Chief Justice  and other  Judges of the Supreme<br \/>\nCourt and  the Chief  Justice and  other Judges\t of the High<br \/>\nCourts.\n<\/p>\n<p>     e. Public\tservants not  below the\t rank of  Additional<br \/>\nSecretary to the Government of India.\n<\/p>\n<p>     f. Serving\t members of  the Armed\tForces not below the<br \/>\nrank of Brigadier in the Army or equivalent rank in the Navy<br \/>\nor the Air Force;\n<\/p>\n<p>     g. manufacturers  of component parts for utilisation in<br \/>\nthe manufacture\t of Maruti  vehicles.  The  number  of\tthis<br \/>\ncategory will be restricted to ten per year;\n<\/p>\n<p>     h. employees  of Maruti  Udyog Ltd.,  limited to  fifty<br \/>\nvehicles per year;\n<\/p>\n<p>     i. individuals  in\t recognition  of  their\t outstanding<br \/>\nhumanitarian services  to the  society or to the Nation. The<br \/>\nnumber in this category will be restricted to ten per year;\n<\/p>\n<p><span class=\"hidden_text\">588<\/span><\/p>\n<p>     j. individuals  cases of undue hardship on humanitarian<br \/>\ngrounds. The  number in\t this category will be restricted to<br \/>\nfive per year.\n<\/p>\n<p>IV.  Error category  i.e. individuals whose applications for<br \/>\nregular allotment  could not be registered on account of any<br \/>\ngenuine error.\n<\/p>\n<p>\t  The following conditions will be strictly observed<br \/>\nin     the\tallotment     of     vehicles\t  to\t any<br \/>\norganisation\/institution, person or individual in any of the<br \/>\naforesaid categories:\n<\/p>\n<p>     a. There  will be\tno resale  of  the  vehicle  by\t the<br \/>\nallottee for a period of three years.\n<\/p>\n<p>     This  condition  will  be\tinserted  in  the  order  of<br \/>\nallotment issued  in favour  of the  allottee. Maruti  Udyog<br \/>\nLtd. will  further obtain  before  giving  delivery  of\t the<br \/>\nvehicle a written undertaking from the allottee that he will<br \/>\nnot sell  the vehicle  for a  period of three years from the<br \/>\ndate of delivery.\n<\/p>\n<p>     b. There  will  be\t no  second  allotment\tout  of\t the<br \/>\nmanufacturers&#8217; quota to the same individual.\n<\/p>\n<p>     c. In  each of  the aforesaid  categories allotment, as<br \/>\nfar as\tpossible, will\tbe made\t on first  come first served<br \/>\nbasis in  accordance with  the date  of the  receipt of\t the<br \/>\napplication   for    allotment\t out\tof   the   aforesaid<br \/>\nmanufacturers&#8217;\tquota.\t In  cases   where  more   than\t one<br \/>\napplication is\treceived on the same day from individuals in<br \/>\nthe same  category, priority of allotment in such cases will<br \/>\nbe determined by draw of lots under proper supervision.\n<\/p>\n<p>     It\t  is\tclarified   that    allotments\t made\t for<br \/>\nmilitary\/paramilitary  purposes\t  and  against\tfirm  export<br \/>\norders for  supply outside  of India,  will not\t be included<br \/>\nwithin 5% of the Manufacturers&#8217; quota.\n<\/p>\n<p>     These guidelines will be in force for a period of three<br \/>\nyears  and   will  be\tsubject\t to   review   taking\tinto<br \/>\nconsideration the  prevailing circumstances  which may exist<br \/>\nat that point of time.\n<\/p>\n<p><span class=\"hidden_text\">589<\/span><\/p>\n<p>     In view  of the  aforesaid guidelines,  we think, it is<br \/>\nunnecessary for\t us to determine the various submissions and<br \/>\ncontentions raised  on\tbehalf\tof  the\t parties  which\t are<br \/>\nhowever left open.\n<\/p>\n<p>     All  general   interim  orders  are  vacated.
