Justice R.BASANT\n\n Dated :08\/01\/2008\n\n O R D E R\n                            R.BASANT, J.\n                         ----------------------\n                         B.A.No.8126 of 2007\n                     ----------------------------------------\n           Dated this the 8th day of January 2008\n\n                                O R D E R\n<\/pre>\n<p>     Application for anticipatory bail.                    The petitioners are<\/p>\n<p>accused 1 to 3. They face allegations in a crime registered for<\/p>\n<p>offences punishable inter alia under Sections 3(i)(x) and 3(i)(xi)<\/p>\n<p>of the Scheduled Castes and Scheduled Tribes (Prevention of<\/p>\n<p>Atrocities) Act. All the other offences are bailable. In the wake<\/p>\n<p>of Section 18 of the Scheduled Castes and Scheduled Tribes<\/p>\n<p>(Prevention of Atrocities) Act, a criminal court is not<\/p>\n<p>jurisdictionally competent to grant anticipatory bail under<\/p>\n<p>Section 438 Cr.P.C.       Of course the allegations raised do not<\/p>\n<p>constitute an offence under the Scheduled Castes and Scheduled<\/p>\n<p>Tribes (Prevention of Atrocities) Act and such Section is<\/p>\n<p>erroneously included in the F.I.R, such inclusion may not oust<\/p>\n<p>the jurisdiction of this court under Section 438 Cr.P.C.<\/p>\n<p>     2.    The learned Public Prosecutor contends that the<\/p>\n<p>allegation, if accepted, do constitute an offence punishable under<\/p>\n<p>Section 3 of the Scheduled Castes and Scheduled Tribes<\/p>\n<p>(Prevention of Atrocities) Act and I find merit in the opposition<\/p>\n<p>raised by the learned Public Prosecutor.                     A more detailed<\/p>\n<p>discussion appears to be not necessary in the facts and<\/p>\n<p>circumstances of this case.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.8126\/07                    2<\/span><\/p>\n<p>      3.    It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate having jurisdiction and then seek regular bail in the<\/p>\n<p>ordinary course. This court has time and again reiterated in &#8211; <a href=\"\/doc\/559544\/\">Ali<\/p>\n<p>v. State of Kerala<\/a> [2000(2) KLT 280, Shanu v. State of Kerala<\/p>\n<p>[2000(3) KLT 452, <a href=\"\/doc\/962608\/\">Krishnakumar v. State of Kerala<\/a> [20005(1)<\/p>\n<p>KLD(Cri.)42] and      <a href=\"\/doc\/93591\/\">P.P.Kader v. State of Kerala<\/a> [2005(1) KLD<\/p>\n<p>(Cri.)250] that the mere fact that the offence under Section 3 of<\/p>\n<p>the Scheduled Castes and Scheduled Tribes (Prevention of<\/p>\n<p>Atrocities) Act is triable exclusively by a court of Session will not<\/p>\n<p>oust the jurisdiction of the learned Magistrate under Section 437<\/p>\n<p>Cr.P.C. The petitioner must hence surrender before the learned<\/p>\n<p>Magistrate and seek regular bail.\n<\/p>\n<p>      4.    If the petitioners surrender before the         learned<\/p>\n<p>Magistrate and apply or bail after giving sufficient prior notice to<\/p>\n<p>the prosecutor in charge of the case, needless to say, the learned<\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits in<\/p>\n<p>accordance with law and expeditiously &#8211; on the date of surrender<\/p>\n<p>itself.\n<\/p>\n<p>      5.
