On hearing deceased's screams the neighbours rushed to\nthe  house and extinguished the flames. Thereafter, she\t was\ntaken to the hospital where on the basis of questions put by\nthe  doctor (P.W. 2), Head Constable (P.W. 7)  recorded\t her\nstatement.  She\t expired  on June 1, 1974.  It\twas  further\nalleged that the husband and his parents were unhappy  about\nthe  quantum of dowry brought by the deceased and  she\twas,\ntherefore being subjected to severe harassment and maltreat-\nment. In a letter written by the deceased to her father\t she\nhad  set out the details of the iII treatment meted  to\t her\nand expressed grave apprehension that her life was in  immi-\nnent danger.\n    The trial court convicted the appellant and her daughter\nof  the\t offence  under s. 302 I.P.C. acting  on  the  dying\ndeclaration made by the deceased, the letter written by\t her\nto  her father and his evidence as to the demands for  dowry\nand  the torture inflicted on his daughter. The husband\t was\ngiven benefit of doubt and acquitted.\n    The High Court confirmed the conviction of the appellant\nbut acquitted the daughter giving her benefit of doubt.\nDismissing the appeal, the Court,\n    HELD:  1.1. The conviction of the appellant by the\tHigh\nCourt was fully justified. The dying declaration made by the\ndeceased wherein\n1222\nshe  has given a clear and vivid account of the\t pouring  of\nkerosene  oil  over her body and being set on  fire  by\t the\nappellant,  has\t the  ring of truth. The  testimony  of\t the\ndoctor\t(P.W.  2) and the Head Constable  (P.W.\t 7)  clearly\nestablishes  that  she was in a fit condition  to  make\t the\nstatement.  There was, therefore, no reason whatever not  to\nact upon it. [1224D; G]\n    1.2.  In addition, there was also  clear  circumstantial\nevidence furnished by the letter written by the deceased  to\nher  father  and the testimony of the father  regarding\t the\ndemands\t for dowry and the harassment and torture  inflicted\non  the\t deceased as part of the endeavour to  extract\tmore\ndowry. Whenever a case of gruesome murder of a young wife by\nthe  barbaric process of pouring kerosene oil over the\tbody\nand setting her on fire as the culmination of a long process\nof  physical  and mental harassment for extraction  of\tmore\ndowry comes before the court and the offence is brought home\nto  the accused beyond reasonable doubt, it is the  duty  of\nthe  court  to\tdeal with the case in the  most\t severe\t and\nstrict\tmanner and award the maximum penalty  prescribed  by\nthe law in order that it may operate as a deterrent to other\npersons\t from  committing such anti-social  crimes. Judgment of the Court was delivered by<br \/>\n    BALAKRISHNA\t ERADI, J. This is yet\tanother\t unfortunate<br \/>\ninstance of gruesome murder of a young wife by the  barbaric<br \/>\nprocess\t of pouring kerosene oil over the body\tand  setting<br \/>\nher on fire as the culmination of a long process of physical<br \/>\nand mental harassment for extraction of more dowry. Whenever<br \/>\nsuch cases come before the Court and the offence is  brought<br \/>\nhome to the accused beyond reasonable doubt, it is the\tduty<br \/>\nof the Court to deal with it in most severe and<br \/>\n<span class=\"hidden_text\">1223<\/span><br \/>\nstrict\tmanner and award the maximum penalty  prescribed  by<br \/>\nthe law in order that it may operate as a deterrent to other<br \/>\npersons from committing such anti-social crimes.<br \/>\n    Amandeep Kaur, deceased, was married to Avtar Singh\t who<br \/>\nfigured\t as  the first accused in the case in  the  Sessions<br \/>\nCourt. Kailash Kaur, the appellant, is the mother-in-law  of<br \/>\nthe  deceased  and Mahinder Kaur who figured  as  the  third<br \/>\naccused\t in the case is the sister of Avtar Singh. The\thus-<br \/>\nband and his parents were allegedly unhappy about the  quan-<br \/>\ntum  of\t dowry\tbrought by the deceased and  she  was  being<br \/>\nsubjected to severe harassment and maltreatment with a\tview<br \/>\nto  extract  more dowry from her parents. Exhibit  PK  is  a<br \/>\nletter\twritten\t by the deceased to her father\tAvtar  Singh<br \/>\n(P.W. 3) in which she has set out the details of the harass-<br \/>\nment  and maltreatment and expressed her grave\tapprehension<br \/>\nthat  unless she was immediately taken back to the  father&#8217;s<br \/>\nhouse,\ther life itself was in imminent danger. On  may\t 30,<br \/>\n1974, in the evening. Kailash Kaur and Mahinder Kaur started<br \/>\nquarreling with the deceased and severely abused and threat-<br \/>\nened  her.  Thereupon,\tthe deceased went to  her  room\t and<br \/>\nbolted\tits  door from inside. Sometime later  Avtar  Singh,<br \/>\nhusband\t of  the  deceased, came to the\t house\tand  started<br \/>\nknocking  at  the  door of the said room  with\tgreat  force<br \/>\nbecause of which the door got unbolted. It would appear that<br \/>\nafter  the  door was opened Avtar Singh went away  from\t the<br \/>\nhouse. It is the prosecution case that immediately  thereaf-<br \/>\nter  Mahinder Kaur caught hold of the deceased\tand  Kailash<br \/>\nKaur  (appellant) poured kerosene oil on her and set her  on<br \/>\nfire.  The deceased started screaming on hearing  which\t the<br \/>\npeople\tresiding in the locality rushed to the house.  Avtar<br \/>\nSingh,\tthe husband also reached there in the  meantime,  As<br \/>\nshe was engulfed in flames, somebody put a blanket on  Aman-<br \/>\ndeep  Kaur and extinguished the flames. Thereafter  she\t was<br \/>\ncarried\t to the Civil Hospital, Hoshiarpur. Dr. Har  Parkash<br \/>\nBhatia\t(P.W. 2), who examined her sent information  to\t the<br \/>\nlocal  police  station on receipt of  which  Head  Constable<br \/>\nNaranjan  Singh\t (P.W. 7), went over to\t the  hospital.\t The<br \/>\ndoctor\tsent everybody other than the Head Constable out  of<br \/>\nthe  room where the patient was lying. He told the  deceased<br \/>\nthat  he  would\t put her questions about the  cause  of\t her<br \/>\ndeath. On the basis of the questions put by the doctor, Head<br \/>\nConstable Naranjan Singh (P.W. 7) recorded her statement, on<br \/>\nthe  basis  of\twhich formal First  Information\t Report\t was<br \/>\nlodged at Police Station, Hoshiarpur. Amandeep Kaur  expired<br \/>\non June 1, 1974.\n<\/p>\n<p>    At\tthe  trial the prosecution relied on Ex.  PF\/3,\t the<br \/>\ndying  declaration made by the deceased&#8211;Amandeep Kaur,\t the<br \/>\nletter Ex. PK writ-\n<\/p>\n<p><span class=\"hidden_text\">1224<\/span><\/p>\n<p>ten  by her to her father Atar Singh (P.W. 3) and  the\tevi-<br \/>\ndence  of P.W. 3 wherein he stated that the  appellant,\t her<br \/>\nson  and  daughter were dissatisfied about  the\t quantum  of<br \/>\ndowry brought by Amandeep Kaur and on that account they\t had<br \/>\nbeen  torturing her. The learned trial Judge acting  on\t the<br \/>\naforesaid evidence convicted Kailash Kaur and Mahinder\tKaur<br \/>\nof the offence under Section 302 I.P.C.-and acquitted  Avtar<br \/>\nSingh, the husband, accused giving him the benefit of doubt.<br \/>\n    Kailash  Kaur  and Mahinder Kaur carried the  matter  in<br \/>\nappeal before the High Court of Punjab and Haryana. The High<br \/>\nCourt  confirmed  the conviction  of  the  appellant&#8211;herein<br \/>\nnamely, Kailash Kaur, but acquitted Mahinder Kaur giving her<br \/>\nthe  benefit of doubt. Aggrieved by the said  judgment,\t the<br \/>\nappellant has preferred this appeal before this Court  after<br \/>\nobtaining special leave.\n<\/p>\n<p>    Notwithstanding  the  learned and  persuasive  arguments<br \/>\nadvanced  before us by Shri A.N. Mulla, Senior\tCounsel\t ap-<br \/>\npearing\t on behalf of the appellant, we find  absolutely  no<br \/>\nmerit in this appeal. There is no reason whatever not to act<br \/>\nupon  the dying declaration of the deceased wherein she\t has<br \/>\ngiven  a clear and vivid account of the pouring of  kerosene<br \/>\noil  over body and her being set on fire by  the  appellant.<br \/>\nShe had also implicated Mahinder Kaur as the person who held<br \/>\nher  while the kerosene oil was being poured on her body  by<br \/>\nthe appellant. We have very grave doubts about the legality,<br \/>\npropriety and correctness of the decision of the High  Court<br \/>\nin  so far as it has acquitted Mahinder Kaur by\t giving\t her<br \/>\nthe benefit of doubt. But since the State has not  preferred<br \/>\nany  appeal, we are not called upon to go into\tthat  aspect<br \/>\nany further.\n<\/p>\n<p>    In addition to the dying declaration there is also clear<br \/>\ncircumstantial\tevidence furnished by the fetter Ex. PK\t and<br \/>\nthe testimony of Atar Singh (P.W. 3) father of the  deceased<br \/>\nregarding  the\tdemands\t for dowry and\tthe  harassment\t and<br \/>\ntorture inflicted on the deceased by the accused as part  of<br \/>\nthe  endeavour to extract more dowry. The dying\t declaration<br \/>\nmade by the deceased has the ring of truth and the testimony<br \/>\nof  the\t doctor&#8211;P.W. 2 and of the  Head  Constable&#8211;P.W.  7<br \/>\nclearly establishes that she was in a fit condition to\tmake<br \/>\nthe  statement. The conviction of the appellant by the\tHigh<br \/>\nCourt was, therefore, fully justified and there is absolute-<br \/>\nly  no ground for interference with the same by this  Court.<br \/>\nWe  only express our regret that the Sessions Judge did\t not<br \/>\ntreat  this as a fit case for awarding the  maximum  penalty<br \/>\nunder the law and that no steps were taken by the<br \/>\n<span class=\"hidden_text\">1225<\/span><br \/>\nState  Government before the High Court for  enhancement  of<br \/>\nthe sentence.\n<\/p>\n<p>    The\t appeal is accordingly dismissed.
