Justice HARUN-UL-RASHID\n\n Dated :09\/09\/2010\n\n O R D E R\n      C.N.RAMACHANDRAN NAIR &amp; HARUN-UL-RASHID, JJ.\n      -------------------------------------------------------------------------------------------\n                            W.P.(C).No.28069 of 2010\n                            ------------------------------------------------\n                  Dated this the 9th day of September, 2010.\n\n                                       J U D G M E N T\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>     Heard the counsel for the petitioner and the Standing<\/p>\n<p>Counsel for the respondents.\n<\/p>\n<p>     2.       Petitioner seeks regularisation with retrospective effect<\/p>\n<p>as L.D.Clerk on the ground that he was appointed in the cadre of<\/p>\n<p>L.D.Clerk on ad-hoc basis earlier. Retrospective claim was with<\/p>\n<p>effect from 1981 onwards whereas regularisation was in 1992.<\/p>\n<p>However, CAT found that the claim was decided by them along<\/p>\n<p>with claim of others in an earlier round of O.A filed by the very<\/p>\n<p>same petitioner along with others.                            So much so, the Tribunal<\/p>\n<p>dismissed the case as not maintainable and by applying the<\/p>\n<p>principle of res judicata.\n<\/p>\n<p>     3.       Before us, counsel for the petitioner contended that<\/p>\n<p>the Government is considering the claim of the petitioner and<\/p>\n<p>others favourably and therefore a direction may by issued by this<\/p>\n<p>Court to consider his case. He has also pointed out that Supreme<\/p>\n<p>Court judgments later rendered are in their favour.
