Mates  with the  appellant. It  is their  grievance\tthat<br \/>\nthough they  were holding  the\tposts  of  clerks  and\twere<br \/>\nperforming the\tduties of the post in the appellant&#8217;s Board,<br \/>\nthey were  not being  paid the\tsalaries on par with regular<br \/>\nclerks. Therefore, they are entitled to the payment of equal<br \/>\npay on\tpar  with  clerks.  The\t High  Court  accepted\tthat<br \/>\ncontention and directed payment of equal pay on par with the<br \/>\nclerks.\n<\/p>\n<p>     Two contentions  have been\t raised by  the appellant in<br \/>\nthe  High   Court.  Firstly,  on  merits  and  secondly,  on<br \/>\njurisdiction. With  regard  to\tthe  merits,  namely,  their<br \/>\nentitlement to\tpayment of  equal pay  for equal work on par<br \/>\nwith  the   clerks,  there  was\t a  settlement\tbetween\t the<br \/>\nappellant and  the employees.  In terms\t thereof, they\twere<br \/>\npaid the wages. That settlement was brought to the notice of<br \/>\nthis Court  in pending\tW.P. (C)  No.788\/87 and\t batch. This<br \/>\nCourt, by  order dated\tMay 10,\t 1991, disposed\t of the writ<br \/>\npetitions  in\tterms  of   the\t settlement.   Thereby\t the<br \/>\ncontroversy on merits no longer survives.\n<\/p>\n<p>     The only  question that remains for decision is whether<br \/>\nthe High Court has jurisdiction to decide the dispute of the<br \/>\ndaily wage  employees working  under the appellant. The High<br \/>\nCourt took  the view that since the daily wage employees are<br \/>\nnot appointed  to a  post, the\tAdministrative Tribunal Act,<br \/>\n1985  (for   short,  `the  Act&#8217;)  is  not  applicable.\tThis<br \/>\ncontroversy also is no longer res integra. <a href=\"\/doc\/198453\/\">In Union of India<br \/>\nvs. Deep  Chand Pandey,<\/a>\t [AIR 1993  SC 382], same contention<br \/>\nwas raised  with regard\t to the casual typists working under<br \/>\nthe Deputy  Chief Engineer  (Construction) Central  Railway,<br \/>\nGwalior. They  contended that under s.14 of the Act, all the<br \/>\njurisdiction, power  and authority exercisable by all courts<br \/>\nexcepting the  Supreme Court have been vested in the Central<br \/>\nAdministrative Tribunal. Therefore, it was contended for the<br \/>\nUnion that  the High  Court had no jurisdiction to entertain<br \/>\nthe claims of the casual typists on daily wage basis. It was<br \/>\ncontended on  behalf of\t the daily  wage typists  that since<br \/>\nthey were  not holding\tany civil  post under  the Union and<br \/>\nwere engaged only on casual basis, the provisions of the Act<br \/>\nwere not  attracted. This Court negatived the contention and<br \/>\nheld thus :\n<\/p>\n<blockquote><p>     &#8220;The scope\t of Article  323-A permitting<br \/>\n     the  Parliament   to  legislate  on  the<br \/>\n     subject  covered\ttherein\t is,   having<br \/>\n     regard to\tthe language,  very wide, and<br \/>\n     by enacting 1985 Act this power has been<br \/>\n     exercised in  almost  full\t measure.  An<br \/>\n     examination of  Section 14\t and  Section<br \/>\n     3(q)  clearly  indicates  that  the  Act<br \/>\n     covers a  very wide  field, and there is<br \/>\n     nothing to\t suggest that  the provisions<br \/>\n     dealing with  the\tjurisdiction  of  the<br \/>\n     Tribunal\tshould\t receive   a   narrow<br \/>\n     interpretation. This  is also  supported<br \/>\n     by the clarification offered by the then<br \/>\n     Minister of  Law, who  was piloting  the<br \/>\n     Bill, while  replying to  the demand for<br \/>\n     the   further    enumeration   of\t  the<br \/>\n     conditions of  service in Section 15 and\n<\/p><\/blockquote>\n<blockquote><p>     15. x x x x x x x x x x &#8220;<\/p><\/blockquote>\n<p>     In view  of the  law thus\tlaid, we  hold that the High<br \/>\nCourt had  been divested,  in the  present case\t too, of the<br \/>\npower and jurisdiction under Article 226 of the Constitution<br \/>\nand  the   same\t vested\t  in  the  Administrative  Tribunals<br \/>\nconstituted in that behalf under the Act.\n<\/p>\n<p>     However, since  the claims on merits have been settled,<br \/>\nwe decline  to interfere  with the  matter.  The  appeal  is<br \/>\naccordingly disposed of. No costs.\n<\/p>\n<p>No.8087\/95<br \/>\nC.A.@ SLP (C) No.3171\/89<br \/>\n     Leave granted.\n<\/p>\n<p>     In view  of the  above judgment, the appeal is disposed<br \/>\nof.
