PUBLIC PROSECUTOR\nfor Respondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/09\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe present<br \/>\napplication has been filed by the applicants for grant of regular<br \/>\nbail under sec. 439 of the Code of Criminal Procedure.\n<\/p>\n<p>2.\tThe applicant-accused<br \/>\nis charged with having committed offences under sections 465, 467,<br \/>\n471, 472, 114 of IPC and sec. 18(1)(6) &amp; 18 of the Drugs and<br \/>\nCosmetics Act for which FIR, being C.R. No. I-123\/2010, has been<br \/>\nregistered with Panigate Police Station, Baroda.\n<\/p>\n<p>3.\tLearned advocate Ms.<br \/>\nLopa Bhatt referred to the FIR and other papers and submitted that<br \/>\nconsidering the nature of offence, the present application may be<br \/>\nallowed. The applicant is a broker and other co-accused have been<br \/>\nreleased.\n<\/p>\n<p>4.\tLearned APP Ms.<br \/>\nLavkumar  resisted the application.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Ms. Lopa Bhatt and learned APP Ms. Lavkumar<br \/>\nand having considered the nature of offence, the role attributed and<br \/>\nalso considering the fact that other co-accused have been<br \/>\nreleased,the present application deserves to be allowed.\n<\/p>\n<p>6.\tThe application is<br \/>\naccordingly allowed.  The applicant is ordered to be released on bail<br \/>\nin connection with C.R. No. I-123\/2010 registered with  Panigate<br \/>\nPolice Station, Baroda on his executing a personal bond of Rs.<br \/>\n5,000\/- (Rupees Five Thousand only) with one solvent surety for the<br \/>\nlike amount to the satisfaction of the lower court and subject to the<br \/>\nfurther conditions that he shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the charge sheet is<br \/>\nfiled.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
