Justice S.S.SATHEESACHANDRAN\n\n Dated :20\/05\/2010\n\n O R D E R\n          THOTTATHIL B.RADHAKRISHNAN\n           &amp; S.S.SATHEESACHANDRAN, JJ.\n          ---------------------------------------\n                 W.P.(C)No.15104 of 2010\n          ---------------------------------------\n        Dated this the 20th day of May, 2010\n\n                       JUDGMENT\n<\/pre>\n<p>THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>         Having    regard    to    the   nature   of  the<\/p>\n<p>directions we    issue herein, notice to           the 3rd<\/p>\n<p>respondent is dispensed with, reserving his right<\/p>\n<p>to  seek  re-hearing     of   this   writ    petition, if<\/p>\n<p>aggrieved.\n<\/p>\n<p>         2.   According to the petitioner, his life<\/p>\n<p>is under threat on account of certain commercial<\/p>\n<p>disputes between him and the private respondent. He<\/p>\n<p>attributes it to certain transactions relating to<\/p>\n<p>partnership etc.     He has made representations to<\/p>\n<p>the police complaining about the actions\/inactions<\/p>\n<p>of the private respondent touching the business.<\/p>\n<p>We are clear in our mind that it is not for the<\/p>\n<p>police  to   meddle    such    situation.        But, the<\/p>\n<p>apprehension of the petitioner that he has threat<\/p>\n<p>to life for his peaceful residence in a house in<\/p>\n<p>which he says that he resides in S.R.M.Road, in<\/p>\n<p>Ernakulam  and    he   is    feeling     apprehensive  of<\/p>\n<p>probable invasion to his life and liberty needs to<\/p>\n<p>be addressed.\n<\/p>\n<p>W.P.(C)No.15104 of 2010<\/p>\n<p>                              :: 2 ::\n<\/p>\n<\/p>\n<p>          3.      The concerned police officials under<\/p>\n<p>the control of the 1st respondent will, therefore,<\/p>\n<p>ensure that there is no law and order problem or<\/p>\n<p>any  invasion       of  the  life and     liberty of   the<\/p>\n<p>petitioner and his family.         Any complaint regarding<\/p>\n<p>invasion to their peaceful life in that regard will<\/p>\n<p>be   appropriately       attended    to   by  the   police<\/p>\n<p>promptly.      Even    if   the     petitioner  has   some<\/p>\n<p>apprehension for going to his own residence, it is<\/p>\n<p>for him to seek appropriate aid of the local police<\/p>\n<p>by making appropriate applications in which event<\/p>\n<p>the police officer will do the needful, in terms of<\/p>\n<p>what is stated above.
