Justice ANTONY DOMINIC\n\n Dated :28\/01\/2008\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                      ===============\n                   W.P.(C) NO. 2257 OF 2008 R\n                =====================\n\n           Dated this the 28th day of January, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p>       The case of the petitioner is that a firm of which he was a<\/p>\n<p>partner was wound up in August 2004 and the sales tax<\/p>\n<p>registration was also cancelled immediately thereafter.      It is<\/p>\n<p>stated that by Ext.P1 revenue recovery proceedings have been<\/p>\n<p>initiated for realising the sales tax dues for the assessment year<\/p>\n<p>2002-03. The complaint is that till date even a copy of the<\/p>\n<p>assessment order has not been served on the petitioner.<\/p>\n<p>      2.   In view of the submission made as above, learned<\/p>\n<p>Government pleader was directed to obtain instructions in the<\/p>\n<p>matter. On instructions, today, it is submitted before me that<\/p>\n<p>assessment was completed on 8\/12\/2006 and that on 23\/2\/2007,<\/p>\n<p>assessment order was sent to the firm by registered post and<\/p>\n<p>that the same was returned unclaimed.            Therefore learned<\/p>\n<p>WPC 2257\/08<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>Government pleader submits that the Department cannot be<\/p>\n<p>faulted for initiating revenue recovery action.<\/p>\n<p>      3.   From the submissions made as above, what emerges<\/p>\n<p>is that assessment has been completed and a copy has been sent<\/p>\n<p>to the assessee in the address available with the respondents. If<\/p>\n<p>it has been sent as stated and the same was returned unclaimed,<\/p>\n<p>the Department cannot be faulted.\n<\/p>\n<p>      4.   However, having regard to the fact that the petitioner<\/p>\n<p>is affected by the assessment stated to have been completed on<\/p>\n<p>8\/12\/2006 and the consequential recovery action, I direct that on<\/p>\n<p>the petitioner approaching the 1st respondent, 1st respondent shall<\/p>\n<p>ensure that a copy of the assessment order is served on the<\/p>\n<p>petitioner forthwith.\n<\/p>\n<p>      Writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                      ANTONY DOMINIC, JUDGE.\n<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.
