Appeal No.377\/2008\n\nDate of Order :                                     09.01.09\n\n\n          HON'BLE MR.JUSTICE MANAK MOHTA\n\n\n\nMr.A.K.Acharya for the appellant.\nMr.Vishnu Kachhawaha , Public Prosecutor.\n\n\n     The present appeal has been filed by Rehmat Khan\n\nagainst the    order dated 24.08.07     passed by the learned\n\nAddl.District &amp; Sessions Judge ( Fast Track) No. No.1, Udaipur\n\nin Criminal Misc. Case No.114\/2007 whereby a warrant of\n\nrecovery of Rs.10,000\/- has been issued against the appellant.\n\n\n\n     The brief facts of the case are as under:-\n\n     It is revealed from the record that     one   case against\n\nSahjad Khan &amp; Ors. was pending under Sections 323, 326,\n\n307 and 149 IPC, in which          Sahjad Khan     moved a bail\n\napplication and a bail order was passed in his favour and he\n\nwas ordered to be released on bail on furnishing bail bond\n\nand surety bond of Rs.20,000\/-       each. It is stated that the\n                                2\n\nappellant became surety of the accused by        furnishing bail\n\nbonds of Rs.20,000\/-. During the proceedings he also\n\ndeposited Rs. 10,000\/- in the court vide Receipt No.031230. It\n\nis further revealed that the accused Sahjad Khan did not\n\nappear on 16.04.07 in the Court. Therefore, the matter was\n\ntaken up by the learned Sessions Judge and on 17.04.07 his\n\nbail bond was cancelled and proceedings under section 446\n\nIPC were initiated. It is further stated by the learned counsel\n\nfor the appellant that he filed a reply stating that Sahjad Khan\n\nhas been detained in another case and he will make efforts to\n\nproduce accused Sahjad Khan in the court. But vide the\n\nimpugned order dated 24.08.07 a warrant for recovery of the\n\nremaining amount has been issued. Against that the present\n\nappeal has been filed.\n\n\n\n       Notice of this appeal was given to the respondent.\n\nRecord was called, arguments were heard.\n\n\n\n     During the course of arguments learned counsel for the\n\nappellant submitted that the learned Sessions Judge has not\n\ngiven due consideration on the reply filed by the appellant. No\n                                  3\n\nopportunity was given of being heard and in a hasty manner,\n\nthe   total surety amount has been forfeited. Therefore, the\n\norder is liable to be set aside. It is also submitted that after the\n\ncancellation of the bail, accused has appeared before the\n\nlearned lower court and he has faced the trial. So far as his\n\nknowledge is concerned, the accused has been acquitted from\n\nthe main charge. He urged that looking to the duration of his\n\nabsence, a lenient view should have been taken. The learned\n\ntrial court should not have forfeited the amount, it is also\n\nreported that he has deposited 50% of the surety amount.\n\nThus, on the basis of aforesaid submissions, a prayer was\n\nmade to set aside the impugned order and the              recovery\n\nproceedings and the appeal may be allowed.\n\n\n\n      On the contrary, the learned Public Prosecutor refuted\n\nthe contentions and submitted that he was a surety and it was\n\nexpected from him to produce the accused on each and every\n\ndate of hearing,     but he failed to maintain his obligation.\n\nTherefore, the surety amount has rightly been forfeited.\n\n\n\n      I have considered the rival submissions. From the\n                                      4\n\navailable record it is not made clear that proper opportunity of\n\nbeing heard was given, before forfeiting full amount, as the\n\nappellant has submitted reply before the learned lower court\n\nbut the learned court has not properly considered his reply.\n\n\n\n           Thus, on the basis of aforesaid discussions, 50% of the\n\nforfeited amount is just and reasonable to be forfeited . The\n\nappellant has already deposited Rs.10,000\/- against the surety\n\namount of Rs.20,000\/- Therefore, the recovery of the remaining\n\namount of Rs.10,000\/-, by way of impugned order, is liable to\n\nbe quashed and set aside.\n\n\n\n           In the net result, the appeal is partly allowed. Out of the\n\nsurety amount, a sum of Rs.10,000\/- is forfeited, therefore,\n\nthe recovery of the remaining            amount by way of impugned\n\norder, is set aside . The appellant is not under any obligation to\n\npay any more sum.
