{"id":173374,"date":"2011-10-25T00:00:00","date_gmt":"2011-10-24T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/budhan-mistry-vs-the-state-of-bihar-on-25-october-2011"},"modified":"2015-10-17T10:21:52","modified_gmt":"2015-10-17T04:51:52","slug":"budhan-mistry-vs-the-state-of-bihar-on-25-october-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/budhan-mistry-vs-the-state-of-bihar-on-25-october-2011","title":{"rendered":"Budhan Mistry vs The State Of Bihar on 25 October, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Budhan Mistry vs The State Of Bihar on 25 October, 2011<\/div>\n<pre>                     IN THE HIGH COURT OF JUDICATURE AT PATNA\n                          Criminal Miscellaneous No.29310 of 2011\n                             Budhan Mistry son of Nathuni Mistry\n                                              Versus\n                                     The State Of Bihar\n                                  ----------------------------------\n<\/pre>\n<p>                    For the petitioner     :      Mr. Umesh Prasad, Advocate.<\/p>\n<p>                    For the State            :        Dr. Indiwar Kumari, A.P.P.\n<\/p>\n<p>                                    &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>3.   25.10.2011                Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                               The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Sections 302\/34 of the Indian Penal Code.<\/p>\n<p>                               Considering that during investigation there was<\/p>\n<p>                  material to suggest that the case was one under Section 304 of<\/p>\n<p>                  the Indian Penal Code, let the petitioner above named, be<\/p>\n<p>                  released on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>                  thousand) with two sureties of the like amount each or any<\/p>\n<p>                  other surety to be fixed by the court concerned to the<\/p>\n<p>                  satisfaction of Chief Judicial Magistrate, Jamui, in connection<\/p>\n<p>                  with Laxmipur P.S. Case No. 72 of 2010, subject to the<\/p>\n<p>                  following conditions: (i) That one of the bailors will be a close<\/p>\n<p>                  relative of the petitioner who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioner. The<\/p>\n<p>                  bailor will also undertake to inform the Court if there is any<\/p>\n<p>                  change in the address of the petitioner. (ii) That the affidavit<\/p>\n<p>                  shall clearly state that the petitioner is not an accused in any<\/p>\n<p>                  other case and if he is he shall not be released on bail. (iii)<\/p>\n<p>                  That the bailor shall also state on affidavit that he will inform<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        the court concerned if the petitioner is implicated in any other<\/p>\n<p>        case of similar nature after his release in the present case and<\/p>\n<p>        thereafter the court below will be at liberty to initiate the<\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse. (iv)<\/p>\n<p>        That the petitioner will give an undertaking that he will receive<\/p>\n<p>        the police papers on the given date and be present on date<\/p>\n<p>        fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>        delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
