SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/07\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tHeard<br \/>\nMr.S.P.Majmudar, learned Advocate appearing for the petitioners ?<br \/>\noriginal defendants and Mr.Hemang Rawal, learned Advocate appearing<br \/>\non behalf of the respondents ?  original plaintiffs, except<br \/>\nrespondent No.8.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioners ?  original defendant Nos.2 to 5 have prayed for an<br \/>\nappropriate Writ, direction and\/or order quashing and setting aside<br \/>\nthe order dated 15.02.2007 passed by the learned Civil Judge (S.D.),<br \/>\nKalol (Ms.P.K.Vyas) below<br \/>\nExh.17 in Special Civil Suit No.108 of 2005 dismissing the<br \/>\napplication submitted by the petitioners under Order VII Rule 11 of<br \/>\nthe Code of Civil Procedure. On considering the impugned order passed<br \/>\nby the learned Judge, the manner in which the learned trial Court has<br \/>\ndismissed and\/or disposed of the application submitted under Order<br \/>\nVII Rule 11 of C.P.C. is highly deprecated. On going through the<br \/>\nimpugned order, it appears that the learned trial Court has even not<br \/>\ngone through the provisions of C.P.C. more particularly Order VII<br \/>\nRule 11 and the impugned order is passed by the learned Judge<br \/>\ndisposing the application submitted under Order VII Rule 11 of the<br \/>\nC.P.C. in most perfunctory and casual manner.  When the application<br \/>\nwas submitted by the defendants to dismiss the Suit under Order VII<br \/>\nrule 11 contending inter-alia that the Suit is on insufficient<br \/>\nCourt fees, in that case, it was incumbent on the part of the learned<br \/>\ntrial Court to decide and dispose of the same rather than disposing<br \/>\nof the said application on the noting made by the original plaintiffs<br \/>\nthat if at the time of final disposal of the suit, it is found that<br \/>\nSuit is on insufficient Court fees, then he will pay deficit Court<br \/>\nfees. Only in three lines the learned Judge has disposed of the<br \/>\napplication submitted under Order VII Rule 11 and no reasons has been<br \/>\nassigned. As held by the Hon&#8217;ble Supreme Court and this Court in<br \/>\ncatena of decisions, any order without reasonings can be said to be<br \/>\nnon-application of mind. Under the circumstances, impugned order<br \/>\npassed by the learned trail Court cannot be sustained and same<br \/>\ndeserves to be quashed and set aside by ordering the learned trial<br \/>\nCourt for deciding the application Exh.17 submitted by the<br \/>\npetitioners ?  original defendant Nos.2 to 5 under Order VII Rule 11<br \/>\nafresh in accordance with law and on merits and to pass detailed<br \/>\nspeaking order.\n<\/p>\n<p>3.\t\tFor<br \/>\nthe reasons stated above, the petition succeeds. Impugned order dated<br \/>\n 15.02.2007 passed by the learned Civil Judge (S.D.), Kalol<br \/>\n(Ms.P.K.Vyas) below Exh.17 in<br \/>\nSpecial Civil Suit No.108 of 2005 is hereby quashed and set aside and<br \/>\nthe matter is remanded to the learned trial Court for deciding the<br \/>\napplication Exh.17 in accordance with law and on merits within a<br \/>\nperiod of three months from the date of receipt of this order and\/or<br \/>\non production of certified copy of the present order and the learned<br \/>\ntrial Court to pass detailed speaking order. Registry is directed to<br \/>\nplace xerox copy of the impugned order dated 15.02.2007 passed by the<br \/>\nlearned Civil Judge (S.D.), Kalol (Ms.P.K.Vyas)<br \/>\nbelow Exh.17 in Special Civil Suit No.108 of 2005 (Page Nos.55<br \/>\nand 56) before the Administrative Unit Judge of Gandhinagar District<br \/>\nfor his kind consideration. Registry is also directed to communicate<br \/>\npresent order to the District Judge, Gandhinagar for his<br \/>\nconsideration also. In the facts and circumstances of the case, there<br \/>\nshall be no order as to costs.
