Respondents<\/p>\n<p>Prayer<\/p>\n<p>Appeal filed under Section 173 of Motor Vehicles Act, 1988, against the<br \/>\nJudgment and Decree dated 16.09.2004 made in MCOP.No.1192 of 2000 by the  Motor<br \/>\nAccidents Claims Tribunal cum I Additional District Judge, Madurai.\n<\/p>\n<p>!For Appellant\t &#8230; Mr.S.Srinivasa Raghavan<\/p>\n<p>^For Respondents &#8230; Mr.M.Ajmalkhan<br \/>\n\t\t     for R.1 to R.3<br \/>\n\t\t     Mr.Gokul for<br \/>\n\t\t     M\/s.Rajinish Pathiyil<br \/>\n\t\t\tfor R.5\t\t<\/p>\n<p>:COMMON JUDGMENT<\/p>\n<p>\tC.M.A.Nos.1093 to 1095 of 2005 have been filed as against the common<br \/>\njudgment and decrees dated   16.09.2004 passed in M.C.O.P.Nos.403 of 2000, 404<br \/>\nof 2000 and 1192 of 2000, by the Motor Accidents Claims Tribunal cum I<br \/>\nAdditional District Judge, Madurai.\n<\/p>\n<p>\t2. All these appeals have been taken for discussion and disposal as they<br \/>\nemerged relating to one and the same accident.\n<\/p>\n<p>\t3. The challenge in these appeals are relating to the quantum of<br \/>\nnegligence fixed exclusively on the driver of the van, leaving the driver of the<br \/>\nState Transport Corporation bus, even though it is an accident involving head-<br \/>\non-collusion between two vehicles in a broad road and that too, in broad day-<br \/>\nlight.\n<\/p>\n<p>\t4. The point for consideration is as to whether the Tribunal was justified<br \/>\nin fastening the driver of the van as exclusively responsible for the accident?\n<\/p>\n<p>\t5. Heard both sides.\n<\/p>\n<p>\t6. The learned Counsel for the appellant\/ Insurance Company being the<br \/>\ninsurer of the offending van, would develop his argument by drawing the<br \/>\nattention of this Court to the deposition of P.W.1 that the accident occurred<br \/>\ndue to the rash and negligent driving of both the drivers of the vehicles<br \/>\nconcerned namely, the van and the bus.\n<\/p>\n<p>\t7. According to the learned Counsel for the appellant, the Tribunal<br \/>\nignoring the trite proposition of law that whenever there is collusion between<br \/>\ntwo vehicles in a broad road, the drivers of both the vehicles should be equally<br \/>\nmade liable for the accident.  In support of his contention, he would cite the<br \/>\ndecision of the Honourable Apex Court in <a href=\"\/doc\/35549\/\">Bijoy Kumar Dugar v. Bidya Dhar Dutta<br \/>\nand others<\/a> reported in (2006) 3 Supreme Court Cases 242. An excerpt from it,<br \/>\nwould run thus:\n<\/p>\n<p>\t&#8220;12. Adverting to the next contention of the claimants, no doubt the High<br \/>\nCourt has not dealt with the point in issue.  However, we have noticed the<br \/>\nreasoning and finding of MACT recorded under Issue 2.  It is the evidence of<br \/>\nRajesh Kumar Gupta PW 2 who was travelling in the Maruti car along with the<br \/>\ndeceased Raj Kumar Dugar on the day of the accident that he also suffered some<br \/>\ninjuries in the said accident.  He stated that while coming from Digboi, the<br \/>\nMaruti car being driven by the deceased met with an accident at a passenger bus<br \/>\ncoming from the opposite direction and the movement of the bus was not normal as<br \/>\nit was coming in a zigzag manner.  The Maruti car being driven by the deceased<br \/>\nRaj Kumar Dugar and the offending bus had a head-on collision.  MACT has not<br \/>\naccepted the evidence of PW 2 to prove that the driver of the offending bus was<br \/>\ndriving the vehicle at abnormal speed.  If the bus was being driven by the<br \/>\ndriver abnormally in a zigzag manner, as PW 2 wanted the Court to believe, it<br \/>\nwas but natural, as a prudent man, for the deceased to have taken due care and<br \/>\nprecaution to avoid head-on collision when he had already seen the bus coming<br \/>\nfrom the opposite direction from a long distance.  It was head-on collision in<br \/>\nwhich both the vehicles were damaged and, unfortunately, Raj Kumar Dugar died on<br \/>\nthe spot.  MACT, in our view, has rightly observed that had the knocking been on<br \/>\none side of the car, the negligence or rashness could have been wholly fastened<br \/>\nor attributable to the driver of the bus, but when the vehicles had a head-on<br \/>\ncollision, the drivers of both the vehicles should be held responsible to have<br \/>\ncontributed equally to the accident.  The finding on this issue is a finding of<br \/>\nfact and we do not find any cogent and convincing reason to disagree with the<br \/>\nwell-reasoned order of MACT on this point.  MACT has awarded interest at the<br \/>\nrate of 10% per annum on the amount of compensation from the date of filing of<br \/>\nthe claim application till the date of payment.  It is a discretionary relief<br \/>\ngranted by MACT and, in our view, the discretion exercised by MACT cannot be<br \/>\nsaid to be inadequate and inappropriate.&#8221;\n<\/p>\n<p>\t8. It has to be seen in this case, whether there is actually head-on-<br \/>\ncollusion or not?\n<\/p>\n<p>\t9. The deposition of P.W.1 would unambiguously  demonstrate that when the<br \/>\nvan was negotiating along the broad road namely Madurai &#8211; Sivagangai road from<br \/>\nwest to east direction, the State Transport Corporation bus was coming in the<br \/>\nopposite direction from east to west and while so, both the vehicles dashed as<br \/>\nagainst each other; the accident occurred almost in the middle of the road, even<br \/>\nthough on either side of those moving vehicles, there were lot of space<br \/>\nincluding the mud portions of the road on either side.\n<\/p>\n<p>\t10. The perusal of the judgment of the Tribunal would clearly indicate<br \/>\nthat oblivious of such glaring admission on the part of P.W.1, it arrived at the<br \/>\nconclusion as though the driver of the van alone was at fault.  The<br \/>\nratiocination adhered to by the Tribunal that the driver of the van was not<br \/>\nexamined, is neither here nor there and for that matter, even the driver of the<br \/>\nbus was also not examined.  Simply because, the F.I.R was registered as against<br \/>\nthe driver of the van and that even the driver of the bus might have been made<br \/>\nto pay fine in the Criminal Court, there is no hard and fast rule that the<br \/>\nentire responsibility should be fixed only on the driver of the van.\n<\/p>\n<p>\t11. The reality as discussed supra would evince and evidence that the<br \/>\naccident occurred due to the rash and negligent driving of the drivers of both<br \/>\nthe vehicles.  Accordingly, the responsibility has to be apportioned between the<br \/>\ndrivers of the van and the bus belonging to the State Transport Corporation and<br \/>\nultimately, the respective owners should be made to honour the award.\n<\/p>\n<p>\t12. In the result, C.M.A.Nos.1093 to 1095 of 2005 are disposed of and the<br \/>\ncommon judgment and decree of the Tribunal is modified to the effect that the<br \/>\nnegligence on the part of the drivers of both the vehicles is apportioned to the<br \/>\nextent of 50% each and consequently, the respective owners are responsible to<br \/>\npay the award amount at the rate of 50% each.  The rest of the common judgment<br \/>\nand decree of the Tribunal shall hold good.  Consequently, connected<br \/>\nMiscellaneous Petition is closed.
