    The  Writ      Petition            is      filed      assailing<\/p>\n
Ext.P2 order passed by the Munsiff refusing to<\/p>\n
issue  Commission           in       O.S.2029\/98            on  the<\/p>\n
application of the petitioner\/plaintiff.<\/p>\n
    2.  The    petitioner\/Laila                    Beevi    is  the<\/p>\n
plaintiff in O.S.2029\/98 on the file of the<\/p>\n
Munsiff’s Court, Ernakulam. It is common case<\/p>\n
that the said case was ordered to be tried<\/p>\n
along   with      O.S.830\/95,                O.S.1696\/96        and<\/p>\n
O.S.1699\/96.    I.A.2664\/08              was       filed    by  the<\/p>\n
petitioner in O.S.2029\/98 to issue an urgent<\/p>\n
commission claiming for a consolidated report<\/p>\n
and plan drawn to scale showing the properties<\/p>\n
scheduled  to        the        plaint            in      O.S.830\/95<\/p>\n
O.S.1696\/96 and O.S.1699\/96 with the pathways<\/p>\n
claimed by the plaintiffs therein. The learned<\/p>\n
Munsiff  vide     Ext.P2           order         considered     the<\/p>\n
W. P. C. No.16161 of 2008         -2-<\/span><\/p>\n
      request         so   made and  dismissed   the  I.A.<\/p>\n
      refusing to issue a commission as prayed for<\/p>\n
      and hence, this Writ Petition assailing the<\/p>\n
      said Ext.P2 order.\n<\/p>\n
              3. It is not in dispute that O.S.830\/95<\/p>\n
      O.S.1696\/96 and O.S.1699\/96 are suits filed<\/p>\n
      against          the  petitioner\/plaintiff  claiming<\/p>\n
      right of way through her property having an<\/p>\n
      extent of 38 and odd cents. The court below<\/p>\n
      has      observed     that  in  O.S.2029\/98  at the<\/p>\n
      instance           of  the  petitioner   herself   a<\/p>\n
      commission was issued vide I.A.7927\/1998 and<\/p>\n
      the Commissioner filed report and thereafter<\/p>\n
      another Commissioner was appointed and that<\/p>\n
      Commissioner filed report dt.15\/09\/07 after<\/p>\n
      measurement of the properties and that is<\/p>\n
      Ext.C5 in the suit. Similarly in O.S.830\/95<\/p>\n
      vide I.A.3389\/95 Ext.C1 commission report was<\/p>\n
      got down and thereafter in the said suit<\/p>\n
      itself         another  Commissioner  inspected the<\/p>\n

      property and filed Ext.C2 report on 23\/10\/96.<\/p>\n
      Ext.C3 is another commission report obtained<\/p>\n
      conducting measurement of the properties with<\/p>\n
      the help of Thaluk Surveyor. In O.S.1696\/96 a<\/p>\n
      Commission was issued with the assistance of a<\/p>\n
      Thaluk Surveyor and Ext.C4 Commission Report<\/p>\n
      was      obtained     on  23\/10\/99.  The  court  has<\/p>\n
      observed that all the above commissions were<\/p>\n
      being issued after hearing both sides and that<\/p>\n
      the      points     sought to  be  reported  in  the<\/p>\n
      present         application are   also  reported by<\/p>\n
      previous commissions and that the suits which<\/p>\n
      are ordered to be jointly tried were listed<\/p>\n
      for trial on more than two occasions and that<\/p>\n
      the      petitioner     had no   case  then  that a<\/p>\n
      commission to get down a consolidated report<\/p>\n
      is necessary as is prayed for now. The court<\/p>\n
      has further observed that there is no reason<\/p>\n
      stated for appointment of another Commissioner<\/p>\n
      and that the available data and details are<\/p>\n

      sufficient for a fair and just disposal of all<\/p>\n
      the connected cases that are being tried along<\/p>\n
      with O.S.2029\/98 and that the Commissioners<\/p>\n
      have given all the relevant details on all<\/p>\n
      material         aspects so that the  request for<\/p>\n
      appointment of another Commissioner or the<\/p>\n
      same        Commissioner   for  submission  of  a<\/p>\n
      consolidated report is totally out of place.<\/p>\n
      The commission reports so marked already in<\/p>\n
      the case examining PWs.1 to 4 are Exts.C1 to<\/p>\n
      C5.\n<\/p>\n
              4. It is further observed that this Court<\/p>\n
      has vide judgment in W.P.C.5554\/08 dt.15\/02\/08<\/p>\n
      directed the trial court to include the case<\/p>\n
      in the list for trial in the last week of<\/p>\n
      March and accordingly, all the suits which are<\/p>\n
      being jointly tried were listed for trial on<\/p>\n
      22\/03\/08 and the present commission application<\/p>\n
      is filed on the day on which the case stood<\/p>\n
      posted for trial in the list on 22\/03\/08. The<\/p>\n

      court has further observed that the petitioner<\/p>\n
      has no case that the two commission reports<\/p>\n
      obtained in her own case has to be set aside.<\/p>\n
      Hence, so long as those reports are there and<\/p>\n
      are not set aside, it is improper to issue a<\/p>\n
      fresh commission.\n<\/p>\n
              5. It is submitted before me by the<\/p>\n
      counsel for the respondent who appears for the<\/p>\n
      plaintiffs in the other connected suits that<\/p>\n
      ex     parte       commissions   were issued in O.S.<\/p>\n
      Nos.830\/95 and 1696\/96 and in 2029\/98 and<\/p>\n
      thereafter again commission was issued with<\/p>\n
      the assistance of a surveyor in all those<\/p>\n
      suits       and     that  commission  issued in O.S.<\/p>\n
      2029\/98 for measurement of the property was<\/p>\n
      even subsequent to order of joint trial of all<\/p>\n
      the suits and that a fresh commission again<\/p>\n
      for measurement and for noting the details<\/p>\n
      would be most inappropriate.\n<\/p>\n

              6.     Counsel for   the respondents   also<\/p>\n
      submits         that the plaintiffs   in  all   the<\/p>\n
      connected suits who claim pathway through the<\/p>\n
      property         of the plaintiffs in   O.S.2029\/98<\/p>\n
      namely Smt.Laila Beevi who is the petitioner<\/p>\n
      herein are claiming the same pathway through<\/p>\n
      the property of the petitioner and it is not<\/p>\n
      that they are claiming different pathways for<\/p>\n
      their use.\n<\/p>\n
              7. In the light of the discussions made<\/p>\n
      above, I am of the view that there is no merit<\/p>\n
      in this Writ Petition and that Ext.P2 order<\/p>\n
      passed by the court below dismissing I.A.<\/p>\n
      2664\/08 for issuance of a fresh commission has<\/p>\n
      only to be confirmed.\n<\/p>\n
              8. In the result, I dismiss this Writ<\/p>\n
      Petition.\n<\/p>\n<\/p>\n
