     Specific issue raised in these writ petitions is covered by<\/p>\n
the judgment of this court in WPC.No.15847\/2008 and connected<\/p>\n
cases.     For ready reference the directions and observations<\/p>\n
issued in the said judgment have been extracted hereunder:<\/p>\n
            “56. In many cases, the orders are<\/p>\n
            purely mechanical, referring only to<\/p>\n
            the seizure of the vehicle and reporting<\/p>\n
            to the District Collector. There is no<\/p>\n
            consideration of the objections.         No<\/p>\n
            scientific or rational method has been<\/p>\n
            adopted in fixing the price of the<\/p>\n
            vehicle. It should also be remembered<\/p>\n
            that a direction to the owner of the<\/p>\n
            vehicle to remit an amount equal to the<\/p>\n
            price of the lorry, does not mean that<\/p>\n
            the amount to be so remitted is fixed<\/p>\n
            irrespective of the question as to<\/p>\n
            whether the offence detected is a first<\/p>\n
            offence or whether a recurring one. It<\/p>\n
            is here that the District Collector<\/p>\n

            should remember that the power which<\/p>\n
            is exercised under Section 23 of the Act<\/p>\n
            read with Rules 27 and 28 is a<\/p>\n
            substantive power that could result in a<\/p>\n
            person forfeiting his property.<\/p>\n<\/blockquote>\n
            57. It is keeping in mind the impact of<\/p>\n
            the power exercised by the District<\/p>\n
            Collector that they should proceed to<\/p>\n
            consider the objections and then pass<\/p>\n
            the order in terms of Rules 27 and 28 of<\/p>\n
            the Rules. I also take note of the<\/p>\n
            submissions of the learned counsel for<\/p>\n
            the petitioners that the Sand Act does<\/p>\n
            not provide for an appeal against the<\/p>\n
            order passed by the District Collector<\/p>\n
            under Rule 27 or 28 of the Rules.<\/p>\n
            Analogous provisions dealing with the<\/p>\n
            infraction of the provisions under the<\/p>\n
            Forest Act or the Abkari Act, which<\/p>\n
            obviously have a similar kind of impact<\/p>\n
            on the society, should be recalled. An<\/p>\n
            order of confiscation passed under the<\/p>\n
            Forest Act is vulnerable to an appeal<\/p>\n
            before no less an authority than a<\/p>\n
            District Judge and the same can be<\/p>\n
            challenged in revision before this court<\/p>\n

            under Section 115 of the Code of Civil<\/p>\n
            Procedure.        An order of confiscation<\/p>\n
            under the Abkari Act is also vulnerable<\/p>\n
            to an appeal and revision before the<\/p>\n
            competent court. The absence of such a<\/p>\n
            provision in the Sand Act obviously is<\/p>\n
            no indication that the provision relating<\/p>\n
            to confiscation under the Sand Act can<\/p>\n
            be exercised in a casual manner.        In<\/p>\n
            fact, it should impress the authority,<\/p>\n
            who is conferred with the power, that<\/p>\n
            he is required to do so, applying his<\/p>\n
            mind and acting as a quasi judicial<\/p>\n
            authority.\n<\/p><\/blockquote>\n
            58. Once it is accepted that the power<\/p>\n
            under Section 23 of the Sand Act, read<\/p>\n
            with Rules 27 and 28 of the Rules, is a<\/p>\n
            substantive        power  and   is   also,<\/p>\n
            therefore, quasi judicial in character,<\/p>\n
            then it follows as a logical consequence<\/p>\n
            that the District Collector should also<\/p>\n
            have the power to direct a release of<\/p>\n
            any     vehicle    which  is seized   and<\/p>\n
            produced before him, by way of interim<\/p>\n
            custody. Such power would obviously<\/p>\n
            be ancillary to the substantive power<\/p>\n

            exercised under Section 23 of the Act<\/p>\n
            read with Rules 27 and 28 of the Rules.<\/p>\n
            It is not for this court to exhaustively<\/p>\n
            lay down the guidelines regarding the<\/p>\n
            conditions that could normally be<\/p>\n
            imposed, while releasing a vehicle on<\/p>\n
            interim custody. But, going by the<\/p>\n
            discussion made by me above and as a<\/p>\n
            reflection of my own opinion, I feel the<\/p>\n
            following safeguards may be taken by<\/p>\n
            the District Collectors while passing<\/p>\n
            orders for release of a vehicle on<\/p>\n
            interim custody.\n<\/p><\/blockquote>\n
            (1) Deposit of an appropriate amount<\/p>\n
            as a pre-condition for the release of the<\/p>\n
            vehicle on interim custody.<\/p>\n
            (2) A condition that the vehicle shall<\/p>\n
            not be used for transportation of sand,<\/p>\n
            pending        final adjudication of  the<\/p>\n
            proceedings under Section 23 of the Act<\/p>\n
            read with Rules 27 and 28 of the Rules.<\/p>\n
            (3) That the vehicle shall not be used<\/p>\n
            within the precincts of the Taluk or<\/p>\n
            even       the    District, pending  final<\/p>\n
            adjudication by the District Collector.<\/p>\n
            (4) A condition that the vehicle would<\/p>\n

            be liable for immediate seizure and<\/p>\n
            further proceedings if it is found<\/p>\n
            involved          in any     other illegal<\/p>\n
            transportation while it is entrusted to<\/p>\n
            the owner on interim custody, pending<\/p>\n
            final adjudication under Section 23 of<\/p>\n
            the Act read with Rules 27 and 28 of<\/p>\n
            the Rules.\n<\/p><\/blockquote>\n
            59. The list mentioned above is, by no<\/p>\n
            means exhaustive, but only indicative.<\/p>\n
            If there is delay in passing final orders<\/p>\n
            beyond a reasonable period from the<\/p>\n
            date within which the objections could<\/p>\n
            be filed, at any rate, where there is a<\/p>\n
            motion by the aggrieved party for<\/p>\n
            release of the vehicle on interim<\/p>\n
            custody, it is necessary for the District<\/p>\n
            Collectors to pass an order on such<\/p>\n
            application, pending adjudication under<\/p>\n
            Section 23 of the Act.\n<\/p><\/blockquote>\n
            60. But, I also make it clear that where<\/p>\n
            the      District    Collector  deems   it<\/p>\n
            appropriate to release the vehicle on<\/p>\n
            interim custody, it would be necessary<\/p>\n
            that any one or all of the conditions<\/p>\n
            mentioned above should be imposed at<\/p>\n

            the time of release of the vehicle on<\/p>\n
            such interim custody and obviously,<\/p>\n
            conditions could be further imposed at<\/p>\n
            the time of passing final orders under<\/p>\n
            Section 23 of the Act.\n<\/p><\/blockquote>\n
            61.     Keeping    in  mind    the    above<\/p>\n
            guidelines, I am of the view that the<\/p>\n
            orders, which are impugned in all these<\/p>\n
            writ petitions are liable to be set aside<\/p>\n
            and the District Collectors are directed<\/p>\n
            to reconsider the issue, keeping in mind<\/p>\n
            the principles laid down by the Division<\/p>\n
            Bench on more than one occasion and<\/p>\n
            the observations contained in this<\/p>\n
            judgment.”<\/p><\/blockquote>\n
      2. Having noted that the power being exercised by the<\/p>\n
District Collector under section 23 of the Act is quasi judicial<\/p>\n
character and in the light of the parameters laid down by the<\/p>\n
Division Bench of this court and by me in the aforementioned<\/p>\n
judgment,     I have gone through the orders impugned in these<\/p>\n
writ petitions. I am satisfied that they cannot be sustained as<\/p>\n
the product of an application of mind to the relevant provisions of<\/p>\n
law.    Accordingly, the impugned orders are set aside.        The<\/p>\n

District Collector is directed to reconsider the issue in the light of<\/p>\n
the observations and findings made in the judgment in<\/p>\n
WPC.No.15847\/2008 and connected cases. Fresh orders shall be<\/p>\n
passed in this regard within three months from the date of receipt<\/p>\n
of a copy of this judgment after hearing the petitioners and after<\/p>\n
conducting a proper enquiry.\n<\/p>\n<\/p>\n
