SHAH\n\t\t\n\t\n\n \n\nDate\n: 28\/10\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India<br \/>\nthe petitioner-Gujarat State Road Transport Corporation has prayed<br \/>\nfor an appropriate writ, order or direction quashing and setting<br \/>\naside the impugned judgement and award dated 17\/11\/2009 passed by the<br \/>\nlearned Presiding Officer, Labour Court, Kachchh at Bhuj in Reference<br \/>\n(L.C.B) No. 21\/2004 by which the learned Labour Court has allowed the<br \/>\nReference quashing and setting aside the action of the<br \/>\npetitioner-Gujarat State Road Transport Corporation dismissing the<br \/>\nrespondent-workman from service declaring the departmental inquiry<br \/>\nheld against the respondent as illegal and in breach of principles of<br \/>\nnatural justice.\n<\/p>\n<p>2.\tShri<br \/>\nHardik Raval, learned advocate appearing on behalf of the petitioner<br \/>\nhas vehemently submitted that assuming without admitting that the<br \/>\nfinding given by the Labour Court, declaring the departmental<br \/>\ninquiry, is illegal and in breach of principles of natural justice,<br \/>\nin that case also, it will be open for the petitioner to prove the<br \/>\ncharge  by leading evidence  as if no departmental inquiry was held<br \/>\nat all, and, therefore, it is requested to remand the matter to the<br \/>\nLabour Court permitting\/allowing the petitioner to lead the evidence<br \/>\nand to prove the charge and the misconduct levelled against the<br \/>\nrespondent-workman.\n<\/p>\n<p>3.\tShri<br \/>\nDevnani, learned advocate appearing on behalf of the respondent has<br \/>\nsubmitted that in that case considering the fact that the<br \/>\nrespondent-workman is out of job since 2000 the Labour Court may be<br \/>\ndirected to decide and dispose of the Reference, on remand, within<br \/>\nthe stipulated time.  The learned advocates appearing on behalf of<br \/>\nthe respective parties do not invite any further reasoned order.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated hereinabove and the<br \/>\nbroad consensus between the learned advocates appearing on behalf of<br \/>\nthe respective parties and keeping the larger question whether can<br \/>\nthe Inquiry Officer and the disciplinary authority be the same and\/or<br \/>\nin case the Inquiry Officer and the disciplinary authority is the<br \/>\nsame,  whether the same would be in breach of principles of natural<br \/>\njustice or not.  Keeping all the aforesaid questions open, the<br \/>\npresent Special Civil Application is allowed in part and the impugned<br \/>\njudgement and award passed by the Labour Court, Kachchh at Bhuj dated<br \/>\n17\/11\/2009 in Reference (L.C.B.) No. 21\/2004 is hereby quashed and<br \/>\nset aside and the matter is remanded to the Labour Court, Kachchh at<br \/>\nBhuj for deciding the same afresh in accordance with law on its own<br \/>\nmerits reserving the liberty in favour of the petitioner to prove the<br \/>\ncharge and lead appropriate evidence and it will be open for the<br \/>\nrespondent to lead the evidence contrary.  The aforesaid exercise<br \/>\nshall be completed within a period of nine months from the date of<br \/>\nreceipt of the present order.  All concerned are directed to<br \/>\ncooperate with the learned Labour Court for deciding the Reference at<br \/>\nthe earliest and within the stipulated time stated hereinabove and<br \/>\nthe learned advocates appearing on behalf of the respective parties<br \/>\nhave assured the Court that their counter part shall not ask for any<br \/>\nunnecessary adjournment and will give full cooperation in early<br \/>\ndisposal of the Reference within the stipulated time stated<br \/>\nhereinabove.  It is made clear that this Court has not expressed any<br \/>\nopinion on merits  in favour of either parties and it will be<br \/>\nultimately for the Labour Court to pass an appropriate order in<br \/>\naccordance with law on its own merits.
