Justice K.T.SANKARAN\n\n Dated :20\/11\/2009\n\n O R D E R\n                         K.T.SANKARAN, J.\n                   ---------------------------------------------\n                         B.A.No.6774 of 2009\n                   ---------------------------------------------\n           Dated this the 20th day of November, 2009\n\n\n                                ORDER\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is accused No.3 in<\/p>\n<p>Crime No.634 of 2008 of Kasaragod Police Station.<\/p>\n<p>     2.   The offence alleged against the petitioner is under<\/p>\n<p>Section 511 of Section 420 of the Indian Penal Code.<\/p>\n<p>     3.    The prosecution case is that on 13.9.2008, the<\/p>\n<p>accused persons, seven in number, went to Malabar Gold, a<\/p>\n<p>jewellery at Kasaragod and purchased gold ornaments worth<\/p>\n<p>Rs.28 lakhs and 2 watches worth Rs.63,000\/-. Towards payment,<\/p>\n<p>they produced a debit card. The jewellery people insisted on<\/p>\n<p>identity proof of the concerned person. At that time, the accused<\/p>\n<p>persons went out under some pretext and later they escaped.<\/p>\n<p>The persons in charge of the jewellery had taken a photocopy of<\/p>\n<p>the debit card. The matter was reported to the police. The<\/p>\n<p>investigation revealed that the debit card was a forged one.<\/p>\n<p>     4.    The petitioner was arrested on 30.10.2009 and he was<\/p>\n<p>remanded to judicial custody. The petitioner moved an<\/p>\n<p><span class=\"hidden_text\">BA No.6774\/2009                      2<\/span><\/p>\n<p>application for bail. That application was dismissed by the Chief<\/p>\n<p>Judicial Magistrate, Kasaragod by the order dated 4.11.2009.<\/p>\n<p>      5.    The crime is of the year 2008. The investigation must<\/p>\n<p>have reached the final stage. Even if the petitioner is detained in<\/p>\n<p>judicial custody, that will not improve the situation in so far as<\/p>\n<p>the investigation is concerned.\n<\/p>\n<p>      6.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner on stringent conditions.\n<\/p>\n<p>      The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.50,000\/- with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Chief Judicial Magistrate Court,<\/p>\n<p>Kasaragod, subject to the following conditions:<\/p>\n<p>a)    The petitioner shall report before the investigating officer<br \/>\n      between 9 A.M. and 11 A.M. on all Tuesdays and Fridays,<br \/>\n      till the final report is filed or until further orders;<\/p>\n<p>b)    The petitioner shall appear before the investigating officer<br \/>\n      for interrogation as and when required;\n<\/p>\n<p>c)    The petitioner shall not try to influence the prosecution<br \/>\n      witnesses or tamper with the evidence;\n<\/p>\n<p><span class=\"hidden_text\">BA No.6774\/2009                   3<\/span><\/p>\n<p>d)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;\n<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.\n<\/p>\n<p>\n     The Bail Application is allowed as above.\n<\/p>\n<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                  JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Rameshan vs State Of Kerala on 20 November, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6774 of 2009() 1.
