Justice C.K.ABDUL REHIM\n\n Dated :13\/09\/2010\n\n O R D E R\n                   C.K.ABDUL REHIM, J.\n\n               --------------------------------------\n                 W.P.(C).No.14880 of 2010\n               --------------------------------------\n\n       Dated this the 13th day of September, 2010\n\n\n                       J U D G M E N T\n<\/pre>\n<p>                       &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>           Petitioner is approaching this court challenging<\/p>\n<p>the proceedings initiated under the Securitisation and<\/p>\n<p>Reconstruction of Financial Assets and Enforcement of<\/p>\n<p>Security Interest Act, 2002 (SARFAESI Act). Pursuant to<\/p>\n<p>default committed in repayment of a Housing Loan availed<\/p>\n<p>by the petitioner from the respondents, proceedings were<\/p>\n<p>initiated for taking over possession of the immovable<\/p>\n<p>property, which is the secured asset. The respondents have<\/p>\n<p>invoked Section 14(1) and Ext.P1 petition was filed before<\/p>\n<p>the Chief Judicial Magistrate Court.\n<\/p>\n<p>      2.   Eventhough      various     contentions    are raised<\/p>\n<p>against the proceedings, it is submitted that, repayment<\/p>\n<p>period of the housing loan, which was availed in the year<\/p>\n<p>2006, is 180 monthly installments. Therefore the petitioner<\/p>\n<p>is seeking indulgence of this court in permitting payment of<\/p>\n<p>defaulted installments and for continuing repayments in<\/p>\n<p>future in accordance with the original schedule. It is noticed<\/p>\n<p>W.P.(C).14880\/10-H              -2-\n<\/p>\n<p>that the petitioner has not availed any statutory remedy at the<\/p>\n<p>stages when proceedings was pursued under Section 13(2)<\/p>\n<p>and 13(4) of the Act.\n<\/p>\n<p>      3.    There is absolutely no merit for interference by this<\/p>\n<p>court with respect to the matter which is now pending before<\/p>\n<p>the C.J.M. Court. However, I am of the opinion that some<\/p>\n<p>indulgence can be shown in permitting regularisation of the<\/p>\n<p>loan account by paying the defaulted arrears.           This is<\/p>\n<p>especially because of the fact that the petitioner had remitted<\/p>\n<p>a sum of Rs.1,00,000\/- during pendency of this writ petition in<\/p>\n<p>compliance with direction issued by this court.<\/p>\n<p>      4.       Under the above circumstances, the writ petition<\/p>\n<p>is disposed of directing the petitioner to remit the amounts<\/p>\n<p>pertaining to the defaulted installments along with interest<\/p>\n<p>and expenses if any due, in three (3) equal monthly<\/p>\n<p>installments falling due on or before 30.10.2010 and on or<\/p>\n<p>before the last day of the two succeeding months.           The<\/p>\n<p>petitioner shall also remit the regular installments due with<\/p>\n<p>respect to these months along with the above said payments.<\/p>\n<p>The respondents shall keep in abeyance further proceedings<\/p>\n<p>for dispossession of the petitioner from the property till such<\/p>\n<p>W.P.(C).14880\/10-H              -3-\n<\/p>\n<p>time the petitioner regularises the account. It is made clear<\/p>\n<p>that on the event of default in payment of any one of the<\/p>\n<p>installments, the respondents will be free to proceed with<\/p>\n<p>further steps.\n<\/p>\n<p>      5.
