Justice S.SIRI JAGAN\n\n Dated :13\/06\/2008\n\n O R D E R\n                           S.SIRI JAGAN, J.\n                    ==================\n                     W.P.(C).No.15215 of 2008\n                    ==================\n              Dated this the 13th day of June, 2008\n\n                            J U D G M E N T\n<\/pre>\n<p>     The petitioner and the 4th respondent which is a co-<\/p>\n<p>operative society, were applicants for selection and appointment<\/p>\n<p>of dealership of retail outlet of Indian Oil Corporation at<\/p>\n<p>Perumkadavila.      After     interview      marks      were      awarded.<\/p>\n<p>Subsequently, apparently on a complaint made by the 4th<\/p>\n<p>respondent, marks were changed. This is under challenge before<\/p>\n<p>me. One of the contentions raised by the petitioner is that before<\/p>\n<p>changing the marks the petitioner was not heard. The petitioner,<\/p>\n<p>therefore, seeks the following reliefs:\n<\/p>\n<blockquote><p>     &#8220;(i)  To issue a writ of Certiorari or any other appropriate writ,<br \/>\n           direction or order calling upon the records pertaining to Exts.P-9<br \/>\n           and P-11 and quash the same.\n<\/p><\/blockquote>\n<blockquote><p>     (ii)  To issue a writ of Mandamus or any other appropriate writ,<br \/>\n           order or direction directing Respondents 1 to 3 to appoint the<br \/>\n           petitioner as dealer of retail outlet at Perumkadavila in view of<br \/>\n           her top position in Ext.P7.&#8221;<\/p><\/blockquote>\n<p>     2.    The     learned     Standing       Counsel     appearing       for<\/p>\n<p>respondents 1 to 3 submits that the procedure prescribed does<\/p>\n<p>not contemplate a hearing of parties. According to him, when a<\/p>\n<p>complaint is received from one of the applicants, that would be<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>sent for enquiry by an investigating officer who would look into<\/p>\n<p>the complaint and submit a report, based on which appropriate<\/p>\n<p>corrective measures would be taken. For this, there is no<\/p>\n<p>necessity to hear the parties, is the submission made.<\/p>\n<p>      3.   I have heard both parties.\n<\/p>\n<p>      4.   I am unable to agree with the Standing Counsel<\/p>\n<p>appearing for respondents 1 to 3. The procedure would have<\/p>\n<p>been alright in the original award of marks. But when after<\/p>\n<p>awarding marks and publishing the same, it is sought to be<\/p>\n<p>corrected, naturally the parties are entitled to be heard in the<\/p>\n<p>matter. In the above circumstances, I am of opinion that<\/p>\n<p>respondents 1 to 3 should reconsider the matter after affording<\/p>\n<p>an opportunity of being heard to the petitioner as well as the 4th<\/p>\n<p>respondent before selecting one of them.
