PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.DLR Vyas, for the appellant.\n<\/p>\n<p>Mr.Bharat Devasi, for the respondents.\n<\/p>\n<p>                            &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>      Heard learned counsel for the parties.\n<\/p>\n<p>      The appellant is aggrieved against the order of<br \/>\nremand dated 24.3.2007 passed by the Court of District<br \/>\nJudge, Pali in Civil Appeal Decree No.65\/2006 by which<br \/>\nthe   first     appellate       court      upheld       the     judgment      and<br \/>\ndecree    passed    by    the    trial          court    and    by    the    same<br \/>\njudgment, remanded the matter to the trial court for<br \/>\nthe   purpose      of    deciding          the        issue    of    permanent<br \/>\ninjunction.\n<\/p>\n<p>      Learned counsel for the appellant submitted that<br \/>\nthe   impugned     judgment      of       the    first    appellate         court<br \/>\nwithout    reversing      any    finding          on    any    of    the    issue<br \/>\nrecorded   by    the     trial court,            is    wholly    illegal and<br \/>\n<span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>                                           S.B. Rukma Devi &amp; Ors.\n<\/p>\n<p>further,     the    first    appellate         court    by    the    impugned<br \/>\njudgment, upheld the judgment and decree of the trial<br \/>\ncourt for declaration and has not set aside any other<br \/>\npart    of   the   decree, then          the    first    appellate court<br \/>\ncould not have remanded the matter. Otherwise also,<br \/>\nneither it is a case of reversal of main point by the<br \/>\nfirst appellate court or it is a case where retrial was<br \/>\nfelt necessary by the first appellate court. The    first<br \/>\nappellate court by the impugned judgment has not set<br \/>\naside any of the findings of the trial court on any of<br \/>\nthe     issue,    then     the     matter     could     not    have        been<br \/>\nremanded. The first appellate court has not framed any<br \/>\nissue    nor     remitted    the    matter     to   the    trial      court.<br \/>\nTherefore also, the matter could not have been sent to<br \/>\nthe   trial      court.    The   first      appellate     court       in   the<br \/>\nimpugned judgment observed that the trial court should<br \/>\nlook into Ex.4 and in case, the trial court find it<br \/>\nnecessary to summon any officer, the officer may be<br \/>\nsummoned and thereafter, inference may be drawn. The<br \/>\ndocument Ex.4 produced by the plaintiff\/respondent is a<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>                                           S.B. Rukma Devi &amp; Ors.\n<\/p>\n<p>certified copy of the order passed by one of the party<br \/>\nto   the    litigation     i.e.     respondent      no.2     &#8211;    Rajasthan<br \/>\nHousing Board. Therefore, all the contesting parties<br \/>\nwere before the first appellate court and they took<br \/>\nopportunity to contest the issue involved in the suit<br \/>\nfor which evidence Ex.4 was produced.\n<\/p>\n<p>     Order 41 Rule 24 CPC is very clear in its terms<br \/>\nand it says that where the evidence upon the record is<br \/>\nsufficient to enable the appellate court to pronounce<br \/>\njudgment, the appellate court may, after resettling the<br \/>\nissues,      if     necessary,    finally      determine         the   suit,<br \/>\nnotwithstanding that the judgment of the court from<br \/>\nwhose      decree    the   appeal    is   preferred       has     proceeded<br \/>\nwholly upon some ground other than that on which the<br \/>\nappellate court proceeds.\n<\/p>\n<p>     The wide scope of Order 41 Rule 24 CPC makes it<br \/>\nclear that as far as possible and if all evidence is<br \/>\navailable on the record, the appellate court itself<br \/>\nshould decide the appeal as well as the suit and even<br \/>\nif the trial court has not framed the proper issues and<br \/>\nnot decided the issues, even then the appellate court<br \/>\nshould decide the issue. The remand of the cases by the<br \/>\nappellate         court    unnecessarily         has      already        been<br \/>\ncondemned in several judgments and there appears to be<br \/>\nno reason for the appellate court to remand the matter<br \/>\n<span class=\"hidden_text\">                                          5<\/span><\/p>\n<p>                                               S.B. Civil Misc. Appeal No.1549\/2007<br \/>\n                                         Narayan Prasad. vs. Smt. Rukma Devi &amp; Ors.\n<\/p>\n<p>          when evidence is already on record. The appellate court<br \/>\n          cannot remand the matter for rewriting of judgment nor<br \/>\n          for having opinion of the trial court on the evidence<br \/>\n          available    on   the   record, unless     it   is    necessary to<br \/>\n          remand for the purpose of determination of additional<br \/>\n          issues or when retrial is necessary.\n<\/p>\n<p>               Consequently, this appeal is allowed, the impugned<br \/>\n          judgment dated 24.3.2007 is set aside and the matter is<br \/>\n          remanded to the first appellate court for deciding the<br \/>\n          appeal afresh on merits.\n<\/p>\n<p>               Both the parties are directed to appear before the<br \/>\n          first appellate court on 6.1.2009.\n<\/p>\n<p>               The record be sent to the first appellate court<br \/>\n          forthwith.\n<\/p>\n<p>                                                      (PRAKASH TATIA), J.\n<\/p>\n<p>S.Phophaliya\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Narayan Prasad vs Smt.Rukma Devi &amp; Ors on 8 December, 2008 1 S.B.
