Thereafter, a notification under Sec.6 was issued on<br \/>\n\t2-6-1976 which was published in the Govt. gazette on 1-7-1976. The<br \/>\n\tLand Acquisition Officer, taking into consideration situation of the<br \/>\n\tlands under acquisition, sale instances of Village Trajpar from the<br \/>\n\trecords of Morvi Municipality and the reports of valuers fixed the<br \/>\n\tmarket value of the lands, awarded compensation. Being dissatisfied<br \/>\n\twith the same, the claimant moved reference and the Reference Court<br \/>\n\tpassed the impugned award as mentioned in the earlier part of this<br \/>\n\tjudgment, giving rise to the present appeal by the State.\n<\/p>\n<p>Heard<br \/>\n\tlearned AGP, Ms.Manisha Narsinghani, for the appellant-State and<br \/>\n\tlearned counsel, Ms.Archana Acharya for Mr.S.B.Vakil for the<br \/>\n\trespondent.\n<\/p>\n<p>It<br \/>\n\tis submitted by learned AGP, Ms.Manisha Narsinghani, that the<br \/>\n\tjudgment and award of the Court below is contrary to law and<br \/>\n\tevidence on record. It is further submitted that amounts of<br \/>\n\tcompensation awarded by the Special Land Acquisition Officer on the<br \/>\n\tacquired lands and Rs.2,10,000\/- on the superstructures are<br \/>\n\tsubstantially high.\n<\/p>\n<p>It<br \/>\n\tis submitted by learned counsel, Ms.Archana Acharya for Mr.S.B.Vakil<br \/>\n\tfor the respondent-claimant that the lands of the claimant with<br \/>\n\tsuperstructures situated in Morvi Municipality bearing Census<br \/>\n\tNo.34-A, 48-B and 62-C were acquired by the State Government by<br \/>\n\tnotification under Sec.4 on 11-10-1974. The Land Acquisition<br \/>\n\tOfficer, taking into account the situation of the lands under<br \/>\n\tacquisition and comparable sale instances of various nearby Villages<br \/>\n\tand also the report of the valuers, fixed the market price of the<br \/>\n\tlands. Hence, the amounts of compensation awarded on the lands  and<br \/>\n\ton the superstructures cannot be said to be excessive. It is<br \/>\n\ttherefore urged that the appeal be dismissed.\n<\/p>\n<p>This<br \/>\n\tCourt has gone through the award of the Land Acquisition Officer as<br \/>\n\twell as the impugned judgment and award passed by the Reference<br \/>\n\tCourt. It is not in dispute that the Land Acquisition Officer has<br \/>\n\tconsidered the report of the experts who fixed the market price<br \/>\n\tkeeping in mind the sale instances of various surrounding lands. It<br \/>\n\tis also not in dispute that the lands under acquisition were<br \/>\n\tnon-agricultural lands having good quality and building<br \/>\n\tpotentiality. As regards the contention of learned AGP that the<br \/>\n\tamount awarded on the superstructures is very high, it may be noted<br \/>\n\tthat said amount fixed by trial court was agreed upon by the learned<br \/>\n\tGovernment Pleader appearing at the trial court and now it would not<br \/>\n\tlie in the mouth of learned AGP to challenge the same. Thus, the<br \/>\n\tamounts awarded by the court below have been after taking into<br \/>\n\tconsideration the entire material evidence available on record<br \/>\n\tincluding the evidence of experts and the comparable sale instances<br \/>\n\tand there is no infirmity in the findings arrived at by the<br \/>\n\treference Court and hence, they are not required to be interfered<br \/>\n\twith by this Court in this appeal. Moreover, the learned AGP for the<br \/>\n\tState failed to point out any such reason or material on the basis<br \/>\n\tof which a different view than the one taken by the reference Court<br \/>\n\tcan be taken by this Court.
