awarding reasonable compensation towards loss of<\/p>\n

9. The Tribunal has erred in not awarding  *<\/p>\n

circumstances of the case, we”‘–award’v~a surnt. of.:._i?1.5.\u00a70O0\/– = ‘<\/p>\n
towards loss of consortium, a_:lsum,of \u20ac.l’G,f):QO\/w.} towards
\nloss of estate, a sum of  loss of love and
\naffection and a sum of   “transportation and<\/p>\n
funeral expenses.;5’ _. . ”\n<\/p>\n
10.    contributory negligence
\nat 10%, on  deceased is concerned, the<\/p>\n
same cannot be sustained and it is liable to be set aside<\/p>\n
 A. for_t’he reason’tI1at..,…_.it could be seen from the materials<\/p>\n
 ‘aylai1abIe:”o;rit.  that, bus has hit the motor cycle in<\/p>\n
bumper and the same is not in dispute.<\/p>\n
 is also not in dispute that, driver of the bus<\/p>\n
A “ll light the cigarette instead of driving the vehicle<\/p>\n
 and caused the said ac\ufb01ent and therefore, the said<\/p>\n

accident was solely due to the negligent driving by,\u00bb the<\/p>\n
driver of the bus, as he is not supposed <\/p>\n
Cigarette while driving the bus as per  <\/p>\n
conditions of the Corporation. <\/p>\n
has not been looked into or eonlside-red <\/p>\n
by the Tribunal while fixing  negligence
\nat 10% on the part ofthe ‘Further,  is clear
\nfrom the contents of jvarid the sketch
\nthat, two    right side.\n<\/p>\n
Having   thelrilatter, we are of the
\nconsidereld    has erred in fixing
\nthe  at 10% on the part of the<\/p>\n
deceased. anld’-.ti1’e’l’ is liable to be set aside and<\/p>\n
 it is set aside, fixing the entire liability on<\/p>\n
the’-lrespozndenft\u00bbCorporation<\/p>\n
  Having regard to the facts and circumstances<\/p>\n
it it it   the case as stated above, the impugned judgment and<\/p>\n
award’ passed by the Tribunal is liable to be modi\ufb01ed.<\/p>\n
