In the midst of the suit proceedings,<br \/>\napplication for injunction was moved and ex-parte injunction was<br \/>\nobtained which was challenged by way of Appeal from Order No. 23\/2007<br \/>\nbefore this court and the same was allowed by this court.  The trial<br \/>\ncourt was directed by this court to re-hear the said injunction<br \/>\napplication.\n<\/p>\n<p>2.1\tIt<br \/>\nis further the case of the petitioners that after re-hearing the<br \/>\ninjunction was granted against which the petitioners filed Appeal<br \/>\nfrom Order No. 65\/2007 before this court.  The said  Appeal from<br \/>\nOrder was allowed by this court and it was ordered therein that the<br \/>\noriginal defendants nos. 16 &amp; 17 shall carry out the further<br \/>\nconstruction and complete the same, but the final construction shall<br \/>\nbe subject to the final outcome of the suit.  Thereafter, vide Ex. 43<br \/>\nthe original plaintiff made an application for amendment and sought<br \/>\nfor mandatory reliefs therein which came to be granted by the trial<br \/>\ncourt vide impugned order dated 11.08.2009.  Being aggrieved by the<br \/>\nsaid order, the present petition is filed.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>M.B. Gandhi, learned advocate appearing for the petitioners has<br \/>\nsubmitted that in view of the observations made by this court in<br \/>\nearlier proceedings being Appeal from Order No. 65\/2007, the grant of<br \/>\namendment application shall amount to going contrary to the order of<br \/>\nthis court.  He has submitted that by the orders of this court, the<br \/>\nconstruction is permitted to be carried out and completed and<br \/>\ntherefore the plaintiff has no right to amend the prayer and say that<br \/>\nthe construction is illegal and therefore the amendment application<br \/>\nought not to have been granted by the trial court.\n<\/p>\n<p>4.\tThis<br \/>\ncourt has heard learned advocates for the parties and perused the<br \/>\npapers on record.  From the records, more particularly the order<br \/>\ndated 29.08.2009 passed in Appeal from Order No. 65 of 2007 it<br \/>\ntranspires that the construction is permitted to be put up with a<br \/>\nrider that whatever construction made by the present<br \/>\npetitioners-original defendants nos. 16 &amp; 17 the same shall be<br \/>\nsubject to final outcome of the suit.  In my view, the trial court<br \/>\nhas only allowed the amendment to be carried out.  No prayers<br \/>\nprejudicing the petitioners are granted by the trial court.  In that<br \/>\nview of the matter, this court is not inclined to cause interference<br \/>\nat this stage.  However, in the interest of justice it is directed<br \/>\nthat it shall be open to the petitioners to file additional reply to<br \/>\nthe amended plaint and lead all defences at the time of trial so as<br \/>\nto enable the trial court to arrive at a prudent conclusion.\n<\/p>\n<p>5.\tIn<br \/>\nthe premises aforesaid, petition is dismissed.  The trial court shall<br \/>\nconsider the additional reply, if any, filed by the petitioners to<br \/>\nthe amended suit and additional evidence adduced and decide the suit<br \/>\nin accordance with law without being influenced by the order of this<br \/>\ncourt.   Notice is discharged.
