No.19770 of 2010\n              SASHI NATH PANDEY @ SASHI KANT PANDEY\n                               Versus\n                          STATE OF BIHAR\n                            -----------\n<\/pre>\n<p>2.   16.6.2010.             Heard learned counsel appearing on behalf<\/p>\n<p>                  of the petitioner and the State.\n<\/p>\n<p>                            Petitioner   is   in   custody   in   connection<\/p>\n<p>                  with Kadamkuan P.S.Case No.110 of 2010 for the<\/p>\n<p>                  offence punishable under Sections 399\/402, 414 of<\/p>\n<p>                  the Indian penal Code,      section 25 (1-b) A, 26 and<\/p>\n<p>                  35 of the Arms Act.\n<\/p>\n<p>                            Learned counsel for the petitioner, with<\/p>\n<p>                  reference to the statement of allegation as set<\/p>\n<p>                  out in the first information report, submits that<\/p>\n<p>                  no case under either of the sections is made out<\/p>\n<p>                  against    the   petitioner.     He   submits   that   the<\/p>\n<p>                  recovery of the motor-cycle was not made from the<\/p>\n<p>                  possession of the petitioner rather the motorcycle<\/p>\n<p>                  was recovered from the possession of one Pintu<\/p>\n<p>                  Paswan and this petitioner was standing near the<\/p>\n<p>                  motorcycle. He submits that the admitted position<\/p>\n<p>                  is that this petitioner was arrested from outside<\/p>\n<p>                  the hotel and that the allegation of planning for<\/p>\n<p>                  committing dacoity is not true. He further submits<\/p>\n<p>                  that the petitioner has clean antecedent and has<\/p>\n<p>                  never been involved in any criminal case and in<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>support    whereof       he     has     filed      a    supplementary<\/p>\n<p>affidavit. It is further submitted that the father<\/p>\n<p>of the petitioner was admitted in the Hospital of<\/p>\n<p>Dr.   Akhileshwar        Prasad    for       treatment        near    Nala<\/p>\n<p>Road when he was arrested.\n<\/p>\n<p>          Having         regard         to        the        submissions<\/p>\n<p>aforesaid, let petitioner Shashi Nath Pandey alias<\/p>\n<p>Shashi    Kant     Pandey         be     released        on    bail     on<\/p>\n<p>furnishing bail bond of Rs.10,000\/- (ten thousand)<\/p>\n<p>with two sureties of the like amount each to the<\/p>\n<p>satisfaction       of    the    Chief        Judicial        Magistrate,<\/p>\n<p>Patna     in    connection       with        Kadamkuan         P.S.Case<\/p>\n<p>No.110     of     2010,        subject        to       the    following<\/p>\n<p>conditions, (a) that one of the family members of<\/p>\n<p>the   petitioner        would    stand       as    bailors      for    the<\/p>\n<p>petitioner       and    who    would    also       indicate     his\/her<\/p>\n<p>relationship       with        the petitioner, (b) that the<\/p>\n<p>petitioner       would    file    an     affidavit           before   the<\/p>\n<p>court    below    regarding       his    clean         antecedent     and<\/p>\n<p>which shall be verified and                  if the same is found<\/p>\n<p>false, learned court below would be at liberty to<\/p>\n<p>initiate proceedings for cancellation of his bail<\/p>\n<p>bond and for taking him into custody, (c) that if<\/p>\n<p>the petitioner is found to be involved in any<\/p>\n<p>other case of same nature, the bailor would be<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>      under duty to inform the said event to the court<\/p>\n<p>      concerned entitling the court below to initiate<\/p>\n<p>      proceedings for cancellation of his bail bond and<\/p>\n<p>      for    taking      him     into    custody,   (d)   that       the<\/p>\n<p>      petitioner would be attending the court below on<\/p>\n<p>      each and every date fixed in the case and failure<\/p>\n<p>      on    his   part    to    attend   the   proceedings      on   two<\/p>\n<p>      consecutive         dates      fixed     without    reasonable<\/p>\n<p>      explanation        to    the   satisfaction   of    the    court<\/p>\n<p>      below, would confer liberty on the court concerned<\/p>\n<p>      to initiate proceedings for cancellation of his<\/p>\n<p>      bail bonds and for taking him into custody.<\/p>\n<pre>ahk                           (Jyoti Saran, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sashi Nath Pandey @ Sashi Kant &#8230; vs State Of Bihar on 16 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
