THE BLOCK DEVELOPMENT OFFICER, SHANKARPUR, DISTT.-\n         MADHEPURA\n                                      -----------\n<\/pre>\n<p>3.   29.11.2010                 Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                                The Bihar Control Order 2001 notified on<\/p>\n<p>                  20.2.2007, Clause-7 dealing with suspension\/cancellation<\/p>\n<p>                  of license has come up for consideration before this Court<\/p>\n<p>                  in more than one writ application such as C.W.J.C. No.<\/p>\n<p>                  6966     of    2008   and   C.W.J.C.   No.   14703   of   2009.<\/p>\n<p>                  Considering the power of suspension \/cancellation and<\/p>\n<p>                  incorporation of the new provisions, vis-a-vis the earlier<\/p>\n<p>                  Bihar Trade Article (Licenses Unification) Order, 1984, this<\/p>\n<p>                  Court has held that the control order of 2001 visualizes<\/p>\n<p>                  suspension and cancellation of licence as two different<\/p>\n<p>                  punishments. As distinct from the suspension of a licence<\/p>\n<p>                  pursuant to the institution of a First Information Report, it<\/p>\n<p>                  has been held by this Court that once a licence has been<\/p>\n<p>                  suspended and action as required under Rules has been<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>           taken after a show cause notice, the licence shall remain<\/p>\n<p>           under suspension for 90 days.         Once the punishment of<\/p>\n<p>           suspension has been resorted to the authority cannot<\/p>\n<p>           proceed to cancel the licence as that shall amount to<\/p>\n<p>           double punishment which was not permissible in law.<\/p>\n<p>                     The   license   of   the    petitioner   having   been<\/p>\n<p>           suspended and not cancelled on 24.6.2009, he having filed<\/p>\n<p>           his reply, the period of 90 days having long expired, the<\/p>\n<p>           continued suspension of his license is therefore not<\/p>\n<p>           permissible under Clause 7(5).\n<\/p>\n<p>                     The respondents are directed to resume supplies<\/p>\n<p>           to the petitioner as his suspension has lost its statutory<\/p>\n<p>           effect.\n<\/p>\n<p>                     The writ application stands allowed.\n<\/p>\n<\/p>\n<pre>P.
