SIRIJAGAN, J.\n                   ---------------------------------------\n                   W.P.(C) No.25585 of 2010\n                   ---------------------------------------\n            Dated this the 13th day of August, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>                          &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;\n<\/p>\n<p>      Heard the learned counsel appearing for the<\/p>\n<p> petitioner and the learned standing counsel appearing for<\/p>\n<p> the respondent.\n<\/p>\n<p>      2. The petitioner is aggrieved by Exhibit P9 order of<\/p>\n<p> the first respondent wherein a plot allotted to the<\/p>\n<p> petitioner in Industrial Estate, Umayanalloor has been<\/p>\n<p> ordered to be resumed on the ground that the petitioner<\/p>\n<p> has not put the plot allotted, to the use for which the<\/p>\n<p> same was allotted.\n<\/p>\n<p>     3. The petitioner&#8217;s contention is that the petitioner has<\/p>\n<p>been and is still using the plot for the purpose of running an<\/p>\n<p>industry.  In reply to Exhibit P4 show cause notice the<\/p>\n<p>petitioner has submitted Exhibit P5. It is submitted by the<\/p>\n<p>petitioner in Exhibit P5 that for small periods the unit have<\/p>\n<p>to be temporarily closed and at other times the unit works<\/p>\n<p>even during nights, which depends on the availability of<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25585 of 2010       2<\/span><\/p>\n<p>work.       According to the petitioner, he supplies oil<\/p>\n<p>manufactured in the unit to other units in the very same<\/p>\n<p>Industrial Estate itself and therefore the finding that the<\/p>\n<p>petitioner had not used the plot for the purpose for which it<\/p>\n<p>was allotted is totally unsustainable.<\/p>\n<p>      4. The learned standing counsel for the respondents<\/p>\n<p>submits that it is after considering all the contentions of<\/p>\n<p>the petitioner and finding the same to be           incorrect,<\/p>\n<p>Exhibit P9 order has been passed.\n<\/p>\n<p>      5. I have considered the rival contentions in detail. I<\/p>\n<p>find that in Exhibit P5 reply to the show cause notice issued<\/p>\n<p>to the petitioner, the petitioner has specifically stated that<\/p>\n<p>the unit is presently functioning. It is stated therein that<\/p>\n<p>the petitioner manufactures oil for one month continuously<\/p>\n<p>in which case only they can make a profit.         When the<\/p>\n<p>petitioner goes out for sale of the processed oil the unit<\/p>\n<p>would be temporarily closed. It is further stated in Exhibit<\/p>\n<p>P5 that at other times during holidays also there would be<\/p>\n<p>work in the unit and even during night when work is<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25585 of 2010         3<\/span><\/p>\n<p>available.      It is specifically stated that the petitioner<\/p>\n<p>supplies oil manufactured in the unit to other units in the<\/p>\n<p>industrial estate itself. It is further stated therein that on<\/p>\n<p>some days the unit works during the whole night till<\/p>\n<p>morning. On a reading of Exhibit P5, I do not find any<\/p>\n<p>consideration whatsoever of the said averments in Exhibit<\/p>\n<p>P5 reply. There is no mention as to why the petitioner&#8217;s<\/p>\n<p>contention in Exhibit P5 cannot be accepted. Therefore, I<\/p>\n<p>am satisfied that Exhibit P9 is unsustainable for non-<\/p>\n<p>application of mind. Accordingly the same is quashed. The<\/p>\n<p>first respondent is directed to reconsider the matter in its<\/p>\n<p>right perspective giving reasons as to why the petitioner&#8217;s<\/p>\n<p>explanation is not acceptable.
